On the form I 864, (I am the petitioner/sponsor for my spouse) on part 6 i know I address where I work and my current individual income(I know my taxes and proof of income is required), and then there is the part where it asks "Income you are using from any other person who was counted in your household size, including, in certain conditions, the intending immigrant.(....) Please indicate name, relationship and income." Part 6 item #3. Me and my husban have combined our financial sources, and he works. Do I have to put down his income? If so, am I required to also prove it with previous taxes, because he didn't do his taxes for the two past years, but we will try and get a letter of employment from his boss, would that work?

has he been legally working in the country? if so, then he should have filed taxes

did he enter on a work visa or how has he been able to legally work in the US?

the same proof you show, the joint sponsor or household member has to show

have you guys submitted joint tax return? If it's not and your income is sufficient, then you don't need to show his income.Since you have mentioned that he is working ,is it in USA or does he authorized to work here?

The intending immigrant's current income would only be shown and documented if both the following two things are true.  1.  You don't qualify based on your own income. AND 2. The intending immigrant's income will continue from the same source once in the USA.  If either one of those is not true, you either do not need to, or cannot combine income.  If both apply, you would.
