  1. Yes, you will need an original BC for the interview. Yes, you must include photocopies of the originals like BC and MC. The part you quoted is NVC - national visa center which is completely different from USCIS

  4. You need a marriage certificate before you file AOS. There’s no other option than to wait for one. Meanwhile, I would start getting the forms and paperwork in order so it’s ready as soon as you have the marriage certificate. Also, do not send originals to USCIS. Photocopies only.
  5. From the years I have been on here, there hasn’t been any other solution that to keep checking. I know it took some people weeks to a few months to finally find an appointment. I remember one member who emailed the consulate after weeks and weeks of trying and they were able to help. This didn’t work for others.

  9. Whatever you do to minimize possible contact with police. Depending on a state, regular police can refer to ICE if they suspect a person is in the country unlawfully. Anyone can be stopped by the police at any time, including if you’re passenger in car so probably don’t drive or be a passenger in a car… this is just one example though

  11. Multiple members including myself already advised that overstay is forgiven for spouses of US citizens. Yes, you still are subject to deportation IF in unfortunate circumstances you come into contact with ICE. If this is causing too much worry and anxiety, perhaps it is a sign to marry, depart and pursue CR1 visa through consular processing.

  14. Thanks for clarifying. Then no, you were not issued a US visa in this instance either
  15. No, it is not as a visa is something issued at consulate abroad, not the US. I’m not sure what was the basis of your previous GC but if it was as a result of a CR1 or IR1 visa for example then you’d list that.

  21. *** Topic moved from Bringing Family members (other than spouse) forum to Adjustment of Status Work/Student/Tourist visas forum *** Follow the guide linked above. Overstay is forgiven for spouses of US citizens when adjusting but it’s not recommended as you’re subject to deportation. We had a case here where a person was stopped for a traffic stop and ended up in ICE custody. If you pay for and apply for I-131, it can take a few months. So anywhere from a couple of months to a year. Otherwise you’ll have to wait for a GC. You can find processing times for your local field office (LFO) on USCIS website.
