  1. Hi!! I am having a huge issue right now. What should you do if your name is too long to fit in the name box on DS 260? I have 4 given names and 1 surname. the last 3 letters of my given name won't type on the box. Does anybody know what to do?
  2. Hello All! I am new to this forum and have read so much helpful information from all! I wanted to ask for your advice on my current situation. Here is our story: I am a US Citizen from New York City (29 years old, Colombian-American, professional). My husband is a Colombian Citizen from the capital, Bogotá (31 year old, professional). We met and fell in love early last year and I decided to move to Colombia in May, after my husband was denied a Tourist Visa in April to come to the US. We decided to try for the tourist visa AGAIN while we lived abroad together. So, I worked remotely from May-November and in November he was denied ONCE AGAIN of a Tourist Visa! They claimed the reason behind this was that the visas were scarce and they suspected he would want to stay in the US (he has a 12 year old daughter in Colombia and didn't request to travel with her). After this, I traveled back to NY between November 2019-January 2020 and then returned to Colombia on January 3, 2020. We married on March 2, 2020 (civil ceremony) and we FINALLY applied for the I-130 on March 10, 2020! Now, unfortunatey, I traveled back home a few days ago (the 18th) because of the COVID-19 pandemic, and had to leave my husband behind in Colombia. Obviously, we are aware that this visa process will be a VERY long process, and we are trying to find some kind of a solution to expedite this, if possible. 😓 I really cannot afford to live in Colombia for another year, and have planned to just keep visiting my husband every few months. What would you all recommend for our experience? Do you all think perhaps my husband could travel to visit me in the US (perhaps with a special permission or a tourist visa)? Thank you for reading!!! Geraldine 🙂
  3. Hi! I was just wondering if it's allowed for a US Citizen to work in Canada (physically, not just online) while residing in America on a daily basis? For example: people who lives here in Niagara Falls, NY. As US Citizens are they allowed to have a job in Canada side (do the commute and immigration every morning to CA and come back at night to US)? How will this affect their taxes? I tried to look for answers online but it’s usually the other way around.
  4. Hi, I will be filing N-400 in mid-July using the 3 year rule of being married to U.S. citizen while being a permanent resident. I still have pending the removal of conditions (I-751) but since it may take a while I will go ahead to start gathering documents and apply. Please feel free to start the discussion of what documents to gather, tips, etc. Thanks!
  5. Hello good people! My boyfriend and I are planning to get married soon. I'm on a F1 visa and he's a US greencard holder. After we get married we plan on starting our life here in the US. It looks like things are expedited when you're married to a US citizen, while it takes longer when you're married to a resident. My question is, does it matter if we got married now while he is on his greencard? Or should we wait till he becomes a US citizen? He's already done with his finger print. Also, what if we just got married now and he could file my greencard application once he becomes a citizen? Wouldn't my application still be treated as the application of a spouse of a US citizen? Or the fact that we got married when he was on his greencard slow down the whole process? Thanks in advance!
  6. I could not find clear and legitimate answer to the following questions; not even with lawyers or USCIS webpage. Hope someone would share his/her knowledge and experience with the same situation. Please do not guess and provide documentary evidence justifying your answer. Background: I am a US Citizen. I am a postdoctoral fellow. I receive income which is denoted as fellowship grant or other income. This income is taxable. I file 1040 along with schedule 3, and state taxes. No taxes are withheld (employer does not report to IRS). So it is a self-reporting income, and there is no W-2/1099 Misc./etc. My income is above poverty line. What is going on: My I-130 petition has been approved by USCIS for my spouse living abroad, and now the case is pending with NVC. I need to submit affidavit of support. Questions: Which form should I use I-864 or I-864ez? I know that I could use only my income on form I-864ez, but instructions say that I should be showing my income with W-2, which I do not have. Here is what I-864ez instructions say: "The income you are using to qualify is based entirely on your salary or pension and is shown on one or more Internal Revenue Service (IRS) Form W-2s provided by your employers or former employers." The bold italic part does not apply on me, so I am not sure if I can use I-864ez. Can I use I-864 irrespective to whether I qualify to file I-864ez? I just paper filed my 2019 taxes. Transcript will not be available until April or so. NVC application is pending now, so I can not wait until transcript becomes available. What proof on income can I use? I have a copy of my 2019 federal and state taxes I just filed, and a letter from my employer stating my income and that they do not send W-2/I099 misc./etc. I can also get my December 2019 pay stub showing YTD amount paid to me (income). This probably could be use in replacement of W-2/1099 misc. I could also get a bank statement showing ending amount each month, and the final amount available now (but this will become an asset, so I will not be able to use I-864ez). Looking forward for your advise. Thanks!
  7. Quick question: My husband is completing the I-130 to petition for my son (his stepson under 18) at the same time as petitioning for me. Under Part 4 - Information about the Beneficiary, Information about the Beneficiary's Family, the instructions state "Provide information about the beneficiary's spouse and children". Do I simply put N/A for my son or do we complete this with the complete family information (i.e. Person 1 is me as his mother, Person 2 is his stepfather, Person 3 is his biological father, etc.). Note that I have a Custody agreement whereby my son's father has expressly consented to my son and me moving to the US, so there's no problem there (son's dad and I were never legally married, but we did a Custody Agreement in order to determine Child Support, etc.). We just need to know what to put on the I-130. Thanks very much!
  8. Hi All, I am in serious confusion after reading a ton on new 90 Day rule for filing Adjustment of status after reentering into USA . Please Help me OUT . Background- I came into USA in Dec 2015 on F1 Student Visa and I am currently a full time employee on STEM OPT. During my say here i fell in love with a girl and she happen to be a US Citizen . We got engaged in FEB 2019 (We Traveled to India for the Celebration with Friends and Family ) . And we again went back to India this DEC 2019 For Wedding Celebration . After returning back to USA on Jan 2 , 2020 we got legally married on Jan 06 , 2020 . And now we are planning to apply for AOS based on our Marriage this week. (During my entire stay in USA , I travel out of USA 3 times ) . My serious concern here is will the new 90 Rule hunt me here as i reentered the states on Jan 02 ,2020 AND soon got married after reentry and now applying for AOS GC . Will it be considered a fraud if i apply right now ? Or should i just go ahead and file AOS as my Visa is getting expire in 8 months from NOW . Suggestions are very much appreciated , Thank you
  9. I like to add a joint sponsor but doesnt allow me to upload the documents. Do I need to submit any documents to let them allow it ? But I saw they suggest you to submit all the documents at the same time . Otherwise they will delay your process. I need help with this . Anyone face this problem? I am the petitioner do I need to proof of us citizenship AOS ?
  10. Hi! I am a lawful permanent resident at the moment and will be filing my citizenship this May 2020. Also, I am getting married in the Philippines this April 2020. I am planning to petition my then spouse after I take my oath and get my certificate of naturalization. I need an advice whether to change my last name or not on my marriage certificate to be filed in the Philippines. Would this cause conflict when I apply for my citizenship? Should I just wait for my citizenship application to legally change my name? If so, what would be the effect of this when I petition my spouse after obtaining my citizenship knowing that my legal name would already be different from what is on the marriage certificate. Please help.
  11. HI Vjers, Just wanted to get your opinion... I would like to petition my mom and daughter. What would be the pros and cons for filing the petition at the same time and the pros and cons for filing the petition separately? (like few months away from each other) Thank you in advance.
  12. Hello all, I am in a dilemma at the moment. Initially they told us to be watching the Visa Bulletin for when it will get to our turn( For Family Based i30 Visa) Now we are told (and I checked online status as well) that the status is showing ISSUED. It was said to be issued in may 2019 This is where the confusion is. My son and his family still have their passports with them and they have not done any interviews also. I am lost here. Oct 2008 is the date. I need to know if anyone is in thesame category can say how the whole process happened! I am so lost. Consulate is Nigeria. Married Son of a US Citizen priority date October 2008
  13. Moderators please move this to the right forum, if I posted it in the wrong one. I became us citizen from GC holder through marriage with my US wife. I have been here for almost 15 years . We had different kinds of marital problems thruout and recent I did a major mistake and now have ton of credit card bills and hospital bills. Our relationship will never be the same and if the condition goes worser, I may have to return to India. We file taxes jointly and I have applied for bankruptcy by my own . I know it is $2350 to give away us citizenship and Indian OCI is $ 275. Anybody can give me a detail of the process ?? Would be greatly appreciated.
  14. We currently have a lawyer that helped us get the I130 together and sent in. I'm really trying to figure out if how much he is charging for the I601a is a decent price. Can anyone give me some info on your situation? Anyone doing this part without a lawyer?
  15. Good morning! After doing research in the forum, I could not find a similar case so I will try to briefly expose my mother-in-law's situation and hope to hear your opinion about it. She wants to come to the US to visit her children that are US Citizens. She is still married to their father (naturalized US Citizen in the 1990's), although they have been separated since the mid 1990's but are still officially married. Never really got divorced. She had a green card that was abandoned in the early 2000's and haven't returned it yet which I assume is the first step to take. She has no intention to live in the US but also doesn't work or own property in her home country as she is supported by her mother that is sick and she currently takes care of. Would it be advised for her to come to the US with the intention of divorcing her husband or can she prove she is not willing to stay without doing so? What would be the options or next steps she should/could take? Thanks! Alex
  16. Hello, I'm married to a US citizen and we will be filing for AoS very soon. However, I have done unauthorized work for about a year almost 3 years ago while being on F-1 status. Will this make me ineligible to get a green card through my spouse? I'm very worried about it.
