    I am considering applying for a fiance visa or a spouse visa for my girlfriend who lives overseas.
     
    However, I have a concern due to a prior arrest. I was arrested, a little over a year ago, for what would fall into the category of dating violence. I was charged with criminal mischief in the fourth degree and for harassment in the second degree.  I received and ACD (Adjournment in Contemplation of Dismissal). My record has been sealed since the accident. Apart from my arrest, I am an upstanding citizen. I am college educated, and have a steady work history.
     
    Is it likely my that my case will be denied because of my arrest? I understand IMBRA, and its intend to protect immigrants, but if the Fiance visa is not a viable option should I apply for a CR1 visa instead?  Please, advise.

    Nothing to suggest she would qualify for a work visa, if she did then her Employer or another one would need to go through the process and most unlikely to be quick.

    OP, I feel your pain and understand what she was trying to do.  There is no US visa for dating.  When I first met my now husband two years ago in Brazil and fell in love, we researched all the US visa requirements and concluded that it would be a waste of time and money for him (young, single, Brazilian male) to even try for a B visa to visit me in the US, because of all the overstays that happen all the time.  So I went to visit him many times, to develop our relationship and decide if we wanted to get serious and eventually be together, either in the US or in Brazil.  Eventually I made nine trips to be with him in Brazil, and one trip together to London and Paris.  We got married in Brazil and I filed a petition for a CR-1 visa for him.  He arrived in California three months ago and life is good.  I recommend the same approach in your case.  Go to Brazil as often as you can and see where the relationship goes.  Then decide if you want to be together in the US and if a K-1 or CR-1 works better in your situation.  Good luck!

    So he plans to overstay until he suckers someone into marrying him to get that overstay forgiven? Charming. You’re not going to find advice on that here. When his visa period is up, he needs to GO HOME.

    Well, it seems that your friend plans to overstay and marry a US citizen.   Argentinians can point to him as to why it's hard for them to visit family in the US.

    Hi there. This is not a problem. My husband was living with me in Argentina. 
     
    Is important he have a domicile address on the US and you guys need to communicate your address in Mexico. 
     
    Will help if you have a joint account in Mexico and more stuff who helps  to prove bonafide marriage.

    Is not your case. The CO would told you if you are in a bad AP.
    My case, after interview, was in AP for 2 days and then my visa was issued.

    Hi there. I arrived on September 26th and get my green card this week ( October 28th).
     
    You can check the Status in this link:

    The number is the IOE. You will find it in your Green card fee receipt.

    Check it out if you can delete the others but if is not available just upload the new one and add a note.

    Hi there. This is not new. 
    Any Consulate will tell you that. They just need translations if the documents are in a third language.
     
    They will not ask for translations in your interview but however you need to translate everything for submit to the USCIS and/or NVC.

    Hi Talo. Don't freak it out! Everything will be ok. 
     
    My lawyer made thousands of mistakes in my forms too. I ask her to make me a documents where she explains is her fault.
     
    In my interview I waited to see if the CO would ask me about the mistakes before I present it the paper. He didn't!
     
    My case was approved and I'm here in the US right now. 
     
    Be calm and confident!!.

    I dont think you understand. You CANT do what you are staying. You may not enter the US with the intent to adjust status (IE filing an I-485). If you go down this road you risk ever coming to the US again
     
    Your work authorization will be your green card which you will get when you enter the US on a CR1 visa. Which will be about a year to 16 months after you file the I-130.  You are not the first person in this situation and people wait a long time to be reunited with their spouses. You are going to have to get in line just like everyone else
