  1. In my opinion the best POE is the one where your plane travel ends because if there is any delay at immigration you do not risk missing your next flight. 

    When I arrived with a k1 the immigration office was quite crowded and it took a while to process it so knowing my husband was outside waiting with no rush to get into another plane helped curb the stress.

  2. I got the biometrics appointment last month and a week later I received the 24 months extension letter.

     

    I hope to get approved without interview. It is such an hassle to go to the USCIS service center. There are no public transit options and I don't drive so it is always a two people having to take a day off situation to make it happen. 

     

    Congrats for everyone that already got approved. 

     

    Soon it will be naturalization time, not looking forward to pay another big filling fee. 

  3. A normal petition without complications is very easy to prepare. Like someone said before, consider the spousal visa instead of the k1 if that works for you. In the past k1 visas had the advantage of being faster but now everything takes ages so that advantage is no longer relevant.

     

    I came to the US on a k1 and let me tell you that the months I lived without being able to work or leaving the country were awful. Not only I felt bad to live at my husband's expenses, staying at home without my friends and family all day was driving me insane.

     

    Lastly, I worked for a few months at an immigration lawyer and in my personal experience my boss was an amazing person, but she would be the first to tell you that no petition is guaranteed and that having a lawyer does not make things go faster. Actually, for simple cases like yours, they were put on the bottom of the pile and priority was given to complicated cases that are time sensitive like asylum requests, criminal background, writing wavers, etc. They also do not get the documents you need, you still need to do all the work. They just explain what is requested, give you a check-list and make sure everything is put together at the end. For some people this may be important, especially if they have problems understanding the instructions or have complicated backgrounds, but you seem on top of it.

    I searched to see if anyone had the same problem, but I couldn't find any topic.

     

    I was talking with a friend about green cards and when we needed to apply for removal of conditions and I realized that my green card has the dates for residency and expiration based on the dates I sent the package and my friend had the dates based on when the petition was approved. I tried to find what dates would be correct and it seems that mine is wrong.

     

    Does anyone know if this happened before and what was done to solve the problem? I do not want to apply for ROC on a wrong date. I also used the green card for employment and driver's license and I do not want to be accused of any illegal activity, but I just learned know that my card may be wrong. I tried to contact USCIS but had no success.

    It seems you did that already, but just in case, always download the forms directly from USCIS website to make sure you have the most recent edition. If you send an expire version of any of the forms they will just send everything back without even looking at it. At the USCIS website you will also have a list of additional documentation you need to send with each of the forms. Make sure you follow that list and come back here if you have any questions about any of the documents required or types of supplemental proofs.

    As mentioned before, if your wife is not planning to continue her studies you need to apply for AOS as soon as possible to avoid her being out of status in the country.

    Immigration officers do not work directly with domestic violence, they will not do anything for your case at this point. You should report to the police, move out and protect your son and yourself, that should be your priority. Never stay alone with him again, keep all text messages, pictures, phone calls, etc that prove his abuse/infidelity, that will be needed for the future, if not for the domestic abuse charges, at least for the divorce. 

     

    Regarding immigration, the only thing you need to do is to file for divorce and make USCIS hear of this. He will still be able to apply by himself, if he can lift the restrictions or not it is his problem, not yours. You can file a visa fraud report but unless you have material proof that he entered the marriage in bad faith just to get the visa he will have good chances of not being denied. Just being a terrible spouse is not proof of visa fraud.

     

    If he has a cunning lawyer or some brains he will try to charge you with domestic abuse, be prepared, gather proof, find a lawyer, do not meet with him or talk with him alone. If he has a lawyer, everything you may say will be used against you.

    I'm in a same sex marriage and I didn't found any extra hurdle because of that during the process so far (We currently have the conditional green card). 

     

    There is a lot of things to worry about during this process, but that isn't one.

     

    Regarding the visa, with the time it takes to get the k1 and then the green card or EAD when in the US, I would advise you to get married in a country that allows it and then file for a spousal visa in his home country. If you have the means to do it of course. Australia, the USA or many EU countries are good options.

    With the original documents I sent, as well as the RFIE and supporting documents, they should have all they need right? Where does this stuff disappear to? 

     

    I took a copy of all the documents and also the originals as was requested on the letter. I didn't print the forms again, only the affidavit of support.

    The officer only took the proof of bona fide relationship documents (a few printed facebook posts, our rental lease with both our names, a phone bill, my name on my husband's health and life insurance). All the other documents like marriage certificate, birth certificate, etc he said they already have them all in the file but the letter requests them nonetheless in case any was missing from the petion, got lost, or if they wanted to see the original for some reason. He also wanted to see the photo album we took with wedding photos and other photos in our vacation.

  9. Hey everybody,

     

    I received the notification yesterday that the EAD card was being prodcued. This would be great, but my interview for the AOS is tomorrow and they say we need to take the EAD/AP card in case we have one. Since the card is being produced but I don't have it yet, will this cause delays on my green card processing? Will they make me go back to deliver the EAD/AP card when it gets home and only then process my green card?

     

    I also received a status update on all my cases that "name was updated", but I didn't request any name change. Does someone knows what this status update means?

    I got the interview notice about a week after I got the email notification. They sent it to the old address but the USPS forwarded the mail to the new address and all was fine. USCIS also sent another notification a few days later for the new adress with a duplication of the interview notice in case I didnt get it last week. That was more than I expected from USCIS ahah

     

    But the main thing is, the interview is in early September! I'm really excited to start job hunting in a few weeks.

    I had a similar experience. I tried to get it after arrival with my maiden name but the lady, as I later found out, didn't know how to open a SAVE request because I had an "unmatch" status. After getting married I tried again. This time with a more knowledgeable employee and with my marriage certificate and passport she opened a SAVE request, overcome the unmatch status in a few days and in two weeks I got the card on my married name. 

  13. I'm both doing a master's degree and volunteering at the local animal shelter once a week. I researched a lot about this to make sure it was ok and I came to the conclusion it was. With the university I confirmed with them. They just asked me to send a copy of my passport and k1 visa and I got accepted, there is the caviat there it is a online program, but it is still from a recognized state University. With the animal shelter it is pretty forward, I'm not stealing the job of anyone, there are plenty of Americans there also volunteering, it isn't or ever was a paid position.

  14. For personal reasons I will have to go to my home country around November. I hope to get at least the AP until then, but the predictions are getting pushed later every week 😕 does any one tried to request a expedite AP? If yes, what reason have you gave? Does substantial financial loss apply if I already had bought the flights? 

     

    I'm getting so frustrated with this. My husband can support us for now, but I really want to start to contribute to the household and be able to travel abroad.

    I married early this year in Indiana and no SSN was needed. The process here is actually very easy. No waiting time either, we got the license and the marriage certificate the same day. 

     

    This apply to my county, but I guess the rules would be similar in the state.

  16. I just came from the bank and had to fill a W8 form to open a joint account with my husband. No big deal, it only asks for address, ssn and basic stuff like that. The only thing is that the permanent residency has to be somewhere outside the country. I put my mother's address back in my home country.

     

    The consultant at the bank said it is mandatory to fill one until I get the green card.
