They will probably reject the petition and send your whole package back....along with an extra fee....If so, you will resubmit the package, a new form of payment, and the service charge (if they send it).

If they are unable to process payment then they will reject and return the packet. You can fix the error and refile.

Because you live together you WILL be combining your individual incomes on your I864 exactly how I explained above. He cannot fill out an I864 BECAUSE you live together. USCIS will not accept an I864 from him because of that. He will fill out an I864a.

i would say your sputum test is probably negative otherwise why they will send a sick person at the interview and you waited 2 months for this test result which is a good thing that is also mean it is negative if it was positive they would ask you to come to hospital and start the treatment
that is what i think..so be calm and prepare for your interview goodluck

They might ask for more tests(e.g,sputum test) for tuberculosis which takes 6-8 weeks and if she comes negative she is free to go for her interview and if the results comes positive then she has to do treatment for 6 months and then she will go for her interview...(i am in the condition right now)

Congratulations! Was just wondering why didn't you opt for direct consular filing instead as you have lived overseas for more than 6 months vs the K1 visa? Hope you can shed some light

I’d like to share about our K1-Visa process with you all! I am an American woman with a Pakistani Fiancé. We both lived in China during the entire visa process.  First we assembled our documents for 1-129F and mailed it to America on January 25th 2018. They received our documents on February 10th 2018. Our case was approved on August 20th 2018 and was delivered to NVC. We got our case number from the NVC on September 11th 2018 and they also sent our case file to the Consulate in Guangzhou on that day. The Consulate received our case file on September 26th 2018. We received packet 3 on October 10th 2018. We mailed packet 3 documents back to the consulate in Guangzhou on October 11th 2018.  We received Packet 4 via E-mail on October 16th 2018. After that we made an interview appointment for November 3rd 2018. We also made an appointment at an approved hospital in Beijing at Beijing International Travel Healthcare Center for October 22nd 2018. Due to abnormal chest X-rays, my fiancé had to do the extra sputum tests which tests for tuberculosis. The extra tests were taken three days in a row from October 24-26. The results for these tests could take from 6-8 weeks so we had to cancel the interview online and notified the Consulate about the testing. As soon as the hospital received the results (which were negative  ) they informed the consulate and mailed us the documents on the 26th of December. We received the medical documents in the mail on the 28th of December.  Also, on the 26th of December we received the email from the consulate with a new appointment date and time. The date was set for January 7th. We went to the interview in Guangzhou on the 7th. MY fiancé got a green 221(g) asking for additional documents (petitioner Domicile and Notarized Police Certificate covering entire time in China). We mailed the additional documents as well as his passport via CITIC bank on January 10th 2019. The consulate received it on January 14th.  The visa was issued on January 22nd. We received the passport with the Visa inside and documents on January 27th 2019. We are headed to the States on January 30th 2019!   Thanks everyone for your help and good luck to those still in the process!

Incorrect. Marriage is required during the 90 days in order to not need a I-130 petition. AOS can be filed after the 90 days, but its recommended to file within the 90 days if possible.

Don't understand why some people are being judgmental. A person may not earn enough simply because he/she is just out of college, or it may be hard for him/her to find a job. Maybe the fiance is still in college and just working part-time? Everyone's situation is different.

I have no need to review iinstructions for petitions but feel free to review the “who can file” part when you get time.

I will summarize the rules for you.

You (USC) cannot petition for a fiance or spouse to live in the United States unless you (USC) live or intend to live in the United States with that immigrant.  If you (USC)  dont live there, you as (USC) have to demonstrate that you intend to.  The petitioner in this case lives abroad and has to meet that burden of intent to reside in the US before the visa can be issued.  You are correct that this is done at the embassy or consulate, not at the petition stage.

As a bonus:  the USC must either accompany or precede the beneficiary when the beneficiary leaves for the US.  Hope that clears things up here.

That’s more than enough.  The list I provided was our list for (successfully) proving intent to domicile last year and yours should be more than adequate.  I was using my brother’s address at the time but told then at the interview we would lease something after the visa is approved and in-hand.  Best of luck to you.

AdeelNaz reacted to Paul & Mallory in I-693 help! Being told I need another physical exam by Civil Surgeons
Many people have already addressed this but it looks like you're still concerned with finding a civil surgeon locally.

If your DS-3025 is marked COMPLETE and no further actions are necessary (such as any vaccinations you did not complete in your original physical/medical) YOU DO NOT need to see a local civil surgeon. A copy of your DS-3025 was sent to USCIS already but you can provide a copy with your AOS application. That's what we did.

In our situation, my husband did need to see a civil surgeon locally because he had one more vaccination requirement to fulfill stateside, based on how they administer them in Sweden versus the US. With that being said - yes, MANY civil surgeons stateside will tell you that you have to complete the entire physical exam with them in order for them to do anything. Unfortunately, it's pretty difficult to argue them on it based on how they are sanctioned. So in cases where you do need to see one for AOS fulfillment purposes, you will probably have to hunt around. We called every single list that was provided on the actual USCIS website for civil surgeons searched by our zip code - none of them wound up being helpful. There is a user-started thread here on the forums (it was started years ago but has been added to over time) where people share local civil surgeons that were able to do what they needed. Just search something like "local civil surgeons DS-3025 I-693" and it comes up close to the top, I believe. I can't remember the exact name of it.
