    The deportation is not a problem if it's only for overstaying.  
     
    Have you considered the disadvantages of the K-1?  Have you considered the CR-1 spousal visa?

    To be clear,  there IS a work eligibility category for a  K1 (a6) on the i765, but it is only valid for the period on the i94.  Since it is taking longer to approve the i765 than the duration of the i94, it is typically not exercised

    You cant be serious.  Live together and beat their @&& if they act like that.  That works.  They’ll come around.  

    Your AOS is definitely in jeopardy.

    You're asking if you should lie on your application. The answer is a resounding "NO"!  What you are talking about is immigration fraud. You do need to be living together to prove it's a bona fide marriage. I would recommend family counseling. I'm sure it's hard for the children to adjust to their new situation and a professional may be able to help.

    There is no requirement to have a green card to obtain health insurance or be added to your spouse's plan. You can be added to their plan as soon as you marry.

    If you are living together abroad, what sense is there in doing the K-1 visa? Why not get married already and file for a spousal visa. It’s much more beneficial for your wife.

    By the time you have gone through the whole divorce process you would have already been approved for a spousal visa. Just go with the spousal visa, no need to complicate things further. 🤦‍♀️  Plus you would probably just get more questions about why you got divorced and decide to re-marry.

    I'm sorry what?
    This is extremely absurd. Just stick with the spouse Visa and you wont have to deal with 12 months of AOS process after K1 Visa. Not to mention if I was a consular officer and see in my file that this couple was married, then divorced and immediately applied for K1 so they can get married again - I'd throw it into the "scam" folder.

    you are married. you file a CR1. anything else could be interpreted as immigration fraud.

    I have overstayed for 4 hours.... That counted as a day and I got my VWP revoked... Before I knew about it, I traveled twice back to the US... Until I decided to stay for the summer with my wife (while we waited for the interview). They pulled me to the side and said I had overstayed. I told her I've never done that, the officer then asked me whether or not these dates were correct, and told me the dates of over a year ago. I said they were correct, and three months is not the same as 90 days... Some months have 31 days... And it was dumb to stay so close to the limit, lesson learnt, so I indeed overstay. It doesn't matter if for 4 hours or 179 days. They were very understanding of my situation, and they knew of my plans to marry next time in the USA. I didn't lie about anything and I took the next flight back home. Didn't even get the chance to see my 3 month old who was waiting just outside that room. He's six now, I haven't seen him yet. But fortunately the senator was able to expedite my interview, and recently it went to Application received, hopefully it is issued next week, since my savings are running low for daycare while my wife works. what helped in my case was a Sworn statement I made with the officer at the time, I don't think that is a option for you, considering your situation... Anyways, I really wish you the best of luck, 3 years is a long time, but consider this: the USA and Canada are relatively close... So even if you can't travel south, they can travel north...

    EAD can still arrive anytime before the green card decision is adjudicated.
     
    The same thing happened to us, and according to USPS tracking, my wife's EAD arrived at our mailbox in the middle of our green card interview😂

    Wow, my fiance in Turkey right now is afraid just to sneeze on account that her visa may be denied. And here, your partner is getting drunk and getting into fights and then not telling you about it until a month later. I know you're here looking more for visa rather than relationship advice, but I'll say this anyway. People who drink to such a level that they get into fights when they're drunk and turn into liars....it is likely this man will never stop drinking and he will lie more and more to conceal that fact from you. Lying may even be one thing, but he kept from you a fact that very well could impact if/when you two get to be together. 
     
    To be fair, I think people should be free to make mistakes in their lives and it shouldn't mean they can't come to the U.S. altogether on account of that. But are you certain this is his only arrest and could he have be convicted of anything else? If you decide to continue this relationship and go through with the visa, you really better make sure there's nothing else he's concealing from you.

    It seems that you are actually dealing with two problems. One, as you promptly identified, is the situation of the K1 visa once the arrest is disclosed. Let's assume, however, that the visa gets approved and your fiance is able to move to the US. Does he have a strong support network in the place where you are both planning to live? Friends, family? Are you both prepared for him to be unable to work, or to travel, or to gain a relative level of independence from you for several months? 
     
    The whole immigration process will go far beyond the K1 interview so it would be wise of you to have a serious conversation with your fiance when you feel less frustrated and disappointed. The AoS phase is not an easy one, and the challenges of adapting to a new culture and a new routine are tough even for those that do not have a problem with substance abuse. The fact that he turns violent when he overdrinks might pose a threat to your own wellbeing, so please don't overlook it. We tend to let emotions cloud our judgement because we are so anxious to have our beloved ones close to us, but in immigration we need to use reason. It's a long, tiring, expensive process, so make sure to consult with a specialist if you feel overwhelmed, and plan ahead (financially and emotionally) to avoid bad surprises in the future.

    Please go to an ALANON meeting right away. They are for people whose loved one is an alcoholic. All your pleas and his promises will not help the situation.

    Had the green card interview in LA today! Was pretty quick, asked some of the questions that we filled out already in the AOS form, asked about how we met, our finances, looked at some photos, and then it was done! Said she'd make a decision in a week, was hoping it'd be instant like some people here but fingers crossed! Still no update yet.
     
    In other news, USPS says EAD arrived in our mailbox this morning in the middle of our interview hahaha

    Had my AOS interview yesterday at the Honolulu field office. Was nervous of course, but the interviewing officer was friendly and put us at ease, whole process took an hour, and......

    EAD approved on online case tracker after 211 days! Just 6 days before the GC interview lol
