I'm not sure how that means they aren't properly trained (not saying that IO was or wasn't...). I'd be surprised if every IO knows the residency rules for every state off the top of their head.

Because  I have a weak argument. I do not possess a house or rent an apartment, I have never worked int his country , have never paid any taxes or utulities, so you can see my weak position.

I doubt they think you weren't in the marriage unless you either couldn't produce a marriage certificate or they thought you divorced. More likely they didn't believe you met the burden of demonstrating that you are living in marital union.

For naturalization under the 3 year rule, the burden is on you to show that you are in a marital union at the time of filing and still legally married through naturalization.
For naturalization under the 5 year rule, they can still ask for bona fide marriage evidence and review your entire case, but the burden shifts to them if they try to question the marriage.

    I would just re-file the N-400.
You were denied on the basis of eligibility, a hearing via N-336 will net you the same outcome as your initial interview.

The point is IF you move out of the US you are no longer a resident of the US and do not qualify for citizenship nor to keep your GC. A GC requires you to LIVE in the US. You do not live in the US if you move to Canada.

I could possibly see this. Biggest thing is if they are allowed citizenship they would immediately petition parents and all illegal relatives and, again then what's the point of illegal status if they can bypass the system. Hence why immigration reform is needed and would help address some of these things.

love_my_wife reacted to Octavespan in Couldn't make it to biometrics appointment. Asked for rescheduling. Nothing happened since.
From what I have read, It could take them several weeks to reschedule and mail the new date to you.

In your shoes, I would probably either:
    1) give USCIS a call and see if they have an update
    or
    2) If you have a copy of your biometrics notice, do a walk-in and explain why you missed/couldn't attend the assigned appointment.

Please note that this isn't legal advice... just what I'd do. Good Luck!

The contract issue has nothing to do with immigration. It’s a civil matter between her and the hospital

love_my_wife reacted to WandY in Can't find speeding ticket happened long time ago
No, you're wrong. If you bother to read the actual N-400 form, you will understand that it is not asking for infractions. Please read the form, or maybe you should ask an immigration official. Speeding tickets are almost always at the municipal level and count as infractions. If the fine was paid via the mail, it's an infraction. If a court appearance was warranted, then it might have risen to the level of a more serious "citation," such as a misdemeanor. You think the word "citation" means something beyond what it means. It doesn't. Which law school did you go to?

love_my_wife reacted to corvusheart in Is it worth it to be a US citizen now?
I would highly recommend becoming a US citizen. But it is ultimately a personal choice.

    1. Protection from deportation (the exception is if you lied or misrepresented yourself on your N400).
    2. You can vote.
    3..US passport has strong benefits.
    4. As far as I know you no longer have to update your address with uscis everytime you move. (if I'm wrong someone please correct me).
    5. Some US jobs you can get only with citizenship.
    6. If you fall into a bad situation and need financial assistance you will be eligible and won't have to worry about the public charge penalty.
    7. Protection from ever-changing immigration laws. We know not what will happen in the future. But if anti immigration laws get passed it could effect LPRs who come up for GC renewel.
    8. A fishing license is cheaper for a citizen VS LPR. 😛

You have to disclose it on the application---a speeding ticket is a citation ("cited").
You don't have to provide documentation on it, since each ticket fine was less than $500.

There is no potential harm in having traffic violations on the N400 (well, unless there are multiple speeding violations over a short period of time raising questions about the GMC requirement, or includes DUIs).  The IO will be more concerned about whether the ticket fines have been paid, in this instance.

Honestly speaking, yes it seems u r asking too much questions without even reading the instructions first. You’ll get good responses if you read the instructions/guidelines first and ask the questions in areas of confusion or doubt.

You will find answers to bunch of ur questions in the following link regarding payment, files upload format, online access, RFEs  if they need any more information.

    https://www.uscis.gov/file-online/tips-filing-forms-online

For bonafide marriage evidence, provide the ones listed in n400 instructions.

    for other answers.
    3. Passport application is only after oath ceremony and receipt of naturalization certificate which will happen after lots n lots of months of processing.
    6. People have been ignoring minor tickets but doesn’t hurt to disclose them if already paid. Online or email receipts shud be good.
    8. Travelling is fine as long as u make sure u son’t miss important appointments.
    10. Dates approximation is fine.
    11. I don’t think you’ll be allowed to do biometrics/interview in a foreign country.

Thanks for all the well-wishers, once more.

I had my oath earlier today (well, yesterday now) in Dallas. There were 110 people being naturalised from 35 different countries, with the most being 23 from India and 24 from Mexico.

There was a minor issue where I had to scribble out the name of my home town on the "Signed at" location on the N-445 questionnaire, since I had already filled that in before arriving. The MC announced that only Dallas or Irving was acceptable there, but it was a quick fix.

Other than that it was a nice event, with a lot of people there, and friends and family. One of the cops I know from the PD showed up, which was a really nice touch and meant a lot.

So, this chapter of my life is now over. Onto the next...
