    Knowing ahead of time that the fees did not stop after I immigrated on my K-1 visa, my now spouse and I prepared for the fees while I was abroad as well as when I immigrated. The fees for a K-1 were petition fee, photocopying, medical ($350 now in Canada), trips back and forth (her to Canada and me to the USA) as well as travel to the Consulate for both her and I, immigrant visa fee and then the cost of a wedding. There could be a few more costs but I cannot remember them at the moment. After immigration there was the AOS fee. Again this was all a joint venture and the fees do not stop with AOS. There is ROC and later on Citizenship if that is what she desires. With all these fees there is associated traveling to get biometrics done and possible interviews. A biometrics or Local Field Office (LFO) could be anywhere from half hour away to two hours or more away. We paid for these fees and travel out of our joint bank account, again a joint venture. If she is already informing you that she is not going to help with fees during the process then I think that is a sign that you should not be pursuing this relationship. A marriage is a joint effort, not one person taking on the responsibility. It may be hard to hear but you asked in your other post if you were being used for a green card. I gave you my honest answer to get to know her more to observe her desires. I would hate for you to spend the money to petition her to have things not work out. Ultimately it is your decision but members here are giving you good advice. 
     
    I was talking to someone recently who stated that if there is a negative vibe or feeling, its there for a reason and you need to listen and not ignore that. If it turns out to be untrue fine, but do not sweep things under the rug. The fact that you asked if this person is using you for a green card and now about who pays for the AOS brings up red flags for me. Marriage is all about give and take and if she is making a big deal about who will pay for what then there are more problems that will surface. Will she expect to be showered with expensive gifts that you cannot provide? Will she believe that because you are an American you are rich and can make all her dreams come true? My now wife and I often joke around saying, "I hope you didn't marry me for the money." I often tell her that is not why I married her as I knew her financial situation going into our marriage and took it on debt and all. These are things that you need to talk about with her and plan. 
     
    I do think that, if you have not already, you need to sit down with her in person or online (I would suggest online, again money) and briefly discuss hers and your financial situation and what will happen after marriage. They do say that the number one reason for divorce is money. And aside from this, if she immigrates and get a conditional green card and you end up divorcing she can still retain a 10 year green card and remain in the USA. All she has to do is prove that your marriage was entered into in good faith. The main three topics I believe that need to be discussed are children, money, and faith, if that is something that you devote your time to. If any one of these things do not line up and are major deal breakers for you it is a no go. 
     
    I hope this helps you make a decision and I would caution you to be wise and discuss how she reacts to things with others. Whether that be here or with a local family member or friend. I was just reading a scripture today as faith is important to me. It states, "Without consultation, plans are frustrated, But with many counselors they succeed" (Proverbs 15:22). Have people that you can talk to about the situation and challenge you to think critically and objectively assess the situation. Do not make a haste decision, this is the rest of your life you are talking about and you want to be as happy as you can be.

    It would be to your benefit that he DOES gain citizenship. That is one of the few ways a sponsor is relieved from "the hook" of supporting an immigrant.

    Personally, if I was you, I would be talking about very important and serious topics. If you guys are thinking about marriage (CR-1) or pursuing the K-1 you need to get serious about where you are both at with the serious deal breaker topics. There was a recent poster on this site who got all up in arms when his wife decided that she did not want to have children or live in the same house that the mans mother purchased and now he wants to revoke her visa after it has been approved. So, that being said, I would discuss deal breaker topics with her to gauge where she is at and go from there. If there are deal breakers that you are not willing to compromise then you go your separate ways, if not then you can proceed to the next step. I would also have her answer the questions first as you do not want her parroting what you say since you think she may be using you. 
     
    For me and my now wife, when we were pursuing the K-1 we discussed children. I stated that I would not mind having a few more children and she wanted children at the time. A few years into our marriage she stated that she did not want to have children and I was okay with that because it was not a deal breaker for me. 
     
    Remember, once you marry her you deal with her flaws and all so get as much information as you can. For me, I would rather break it off in the beginning than get a few years into a marriage and then have to get a divorce cause that could be ugly and costly...Just my two cents. Hope this helps.

    Agree very straightforward case, and as Arken says you can update any changes in interview. Simple online filing for you in my opinion. The nice thing about online filing is that depending on your answers, the system actually tells you what documents you need to upload.

    You are within the regular time frame which is 4-7 months after applying. OP only filed EAD and did not file AOS. Due to this they have wasted money as their EAD will expire before it gets approved as the current wait is 4-7 months. Hope that future K-1 holders can learn from this post that applying for an EAD upon arrival or without AOS not a viable option.

    Like you said, its a very straightforward case. No need for a lawyer and no need to worry about anything you mentioned in your post. Even if you are unemployed at present, you can still go for citizenship. You financial account doesn’t affect the application. 
     
    anything changes in terms of address, employment, travel  outside US, you can update that during the interview.

    No need to freak out, everything is going to be ok. Just to be clear, the I-485 was denied because you did not file the I-864 to go with it? Or you did file the I-864 but no evidence (taxes, paystubs, ... ) to support it? 
     
    Anyway, the fix it to file another I-485 /I-131/I765 this time with the appropriate I-864 and supporting documents. Nothing has changed, you're still a spouse of a US citizen. Your entire stay was authorized. As long as there is a pending I-485 for you, you are in a period of authorized stay. 
     
    Unfortunately, the mistake has costed you guys more money and time. Fortunately, that's all it is, just money and time. I don't think you're at risk of being deported, as long as you file another I-485 within 30 days.

    As long as you receive the notice and get it to them to re-schedule before the appointment I think you will be fine. 
     I applied online and my biometrics appointment letter was sent by mail and online. I received it online within a few days of mail sent. If you get it online and realize that you cannot make the appointment I would send it as soon as possible. 
     
    Or you could wait until you do not have to travel so much and then apply. Also remember that there are residency requirements attached to applying for Citizenship.

    That is why I mentioned if you get the biometrics appointment letter online to reschedule. Print off the letter and reschedule according to what the letter states. If you have your itinerary great, if not share that you have business to attend to and will be out of the country. I believe they will reschedule. I don't even you have to have a reason to reschedule. Be careful though to not not reschedule a lot.

    She can’t use the VWP (visa waiver program) to live in the USA. 
     
    She has two choices:
     
    -she continues to live in her home country and visits you occasionally on the VWP. Assuming she never overstays, maintains strong ties to her homeland, doesn’t work while she is visiting (not even remotely for a company back home) then she should have no issue with frequent visits. I visited my husband over 40 times using the VWP - some visits were 4 or 5 weeks apart. 
     
    - she moves here permanently for which she would need an immigrant visa. The process takes approximately 12 to 14 months and she can visit you during this processing period. She cannot move here permanently until the visa has been issued. Once she arrives, she can visit her family whenever she wants but she must maintain her residence here in the USA. If she wants to continue working in her homeland this is not the correct path for you. 
     
    There is no visitor visa that would allow her to stay for a year. A year is not visiting. You either live here or you are a visitor.

    If you applied online you should be able to see the oath letter once they send it out. When I was informed that I would be receiving my oath letter they sent it by post and it appeared online as well after it was mailed.

    I agree with all the other posters here that are stating that if his sister's wedding is that important to him then he should delay the visa. As stated, his visa is good for 6 months after his medical. It still maybe cutting it close. These are things that he should have thought about before making the appointments for his medical and interview if he knew about ahead of time.

    Make that four Canadians in a row. I love pineapple on my pizza. Unfortunately for the last six years I have been deprived of this. Whenever I tell someone that I have had a Hawaiian style pizza (pineapple, bacon, and ham I believe) they are like, ewww. I tell them they don't know what they are missing. But yes, pineapple for sure belongs on pizza.

    If you have preconceived intent to marry and complete AOS when you enter on a B1/2 visa that is considered immigration fraud. There is a loophole though where a person could come to the USA without preconceived intent and make a decision to get married and AOS and it is on USCIS to prove otherwise, if my mind serves me correctly.
     
    Here is my story:
     
    When my now wife and I were convinced that we were going to move further in our relationship and it was going to become more serious we looked at both her immigrating to Canada and me immigrating to the United States we looked at our options. We decided that the K-1 would be the most moral as if either of us entered the others country there would be a chance we did not get admitted due to getting married. We felt that the K-1 was the best option for us and pursued it. 5.5 years later I am now a United States Citizen and helping others on this wonderful forum.

    More information is at this link, Family of Green Card Holders (Permanent Residents): https://www.uscis.gov/family/family-green-card-holders-permanent-residents. You will have to get married as fiance(e)s can only be petitioned by US Citizens.
