Question about K1 Extension

Hi Everyone,

 

I got engaged to my fiance back in January and filed my I-129F in Early February. I got my NOA1 on Feb 14th 2023. Everything so far is good. The only thing I want to ask is this:

 

1) I might soon be starting Federal Police Academy (This is six months long)

 

2) With above mentioned situation, I know that after the K-1 is issued, I have six months to go pick her up and bring her here to marry her within 90 days. I have no problem marrying her within 90 days of her arriving in the US. My only worry is if the K1 is issued while im in the middle of police academy. There is no way I can get out of police academy until its complete. Can I request to be given more time to be allowed to go get her and bring her back here?

 

This is for Pakistan. Please let me know.

You have a long way to go so this is not an issue.

Religious Ceremony? The K1 might not be for you. 

What things can I delay? Any information would be appreciation. I know I will be okay but I my anxiety is getting the better of me

I would be more worried about the Religious Ceremony.

Nothing you can do to delay , short of withdrawal now ( since you are only 3 months in and the a 1.5 to 2 year timeline is worrying you)..and refile once you are ready. 
 

Avoid religious ceremonies or you will be shooting yourself in the foot and end up w refusal..consulates know local culture

 

Send your mom to chaperone her trip to US if you are in the Academy.

This will invalidate the K-1 visa, and if CBP learns of it, entry will be denied:

 

 

Since you plan to ask the embassy for an extension to have the ceremony, the embassy might revoke the visa once it confirms the ceremony took place.

As a police officer, if a speeder you pull over uses that same argument, will you let him go without a citation?

 

Speaking of which, it is not a good idea for  a police officer to put himself in a position to appear to have committed a federal crime (misrepresentation to obtain an immigration benefit). So for your own protection, when your fiancee and you arrive at the port of entry, proactively mention to the officer that you had a religious ceremony. If the officer lets it go, cool. If he denies her entry, still cool because you told the truth.

By immigration interpretation, you will be too married for a K-1.  Don't do it.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

6 month from date of medical. Given the embassy is Pakistan, I doubt it will be good for even 5 months from date of issue.
