hi wanted to apply for brother and sisterinlaw im a us citizen want to apply for them they have visit visa my question is can i apply for them during their stay here .what are the steps thanks.

You can, at any time, file an I-130 for your brother which will start the process. They MUST leave the US before the expiration of their current visit.   In about 20 years or so, NVC will contact him to continue the process.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

They cannot stay beyond the time given by CBP when they arrived.  The sibling visa will take at least 20 years for India.

 No.  An I-130 confers no immigration rights or work authorization.

I am not sure you understand the process, if they want a work permit they need a basis for applying for one first.

 

Also you just apply for your Brother, spouses only come into the equation when the Priority sate is current the same applies to minor children.

 

I would expect this to take a lot longer than 20 years but to some extent we are guessing.

you can apply, they need to leave before the end date till CBP admitted them for on their visit. As mentioned by other posters it will likely take more than 20 years before they can potentially immigrate once the priority date is current for the sibling category.

They will not be able to live or work in the United States for at least 20 years.  So, no.

Immediate family: parents, spouse, children under 21:  About 2 years for their immigration visa.  Also can Adjust Status if in the US.

 

Unmarried Son/Daughter over 21:  9-11 years to immigrate, cannot adjust status.

 

Married Son/Daughter (and their family as derivatives):  15+ years to immigrate, cannot adjust status.

 

Brother/Sister (and their family as derivatives):  18+ years to immigrate, cannot adjust status.

NOID issued May 17th 2019

June 5th,2019   USCIS received my response on the  NOID// Addressed the NOID myself, No lawyer ever used in case.

July 1st, 2019  10 YEAR GREEN CARD APPROVED

July 5th, 2019   Approval letters for I-130 & I-485 received in the USPS  mail.

July 11th 2019   Green Card in Hand

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
