Which visa while waiting for spouse visa?

I think your spouse should reconsider options because there is no way you will receive a spousal visa within the next 6 months, imo.  Personally, I wouldn't remain outside the US.

thanks! I know, that's why I was asking for other options, solutions. I wonder what people do while waiting. What other visa is a good choice

You are desperate to get inside the US.  You are desperate to avoid any separation. You have clear immigrant intent, making the issuance of ANY non-immigrant visa very unlikely.  Like other people, in your exact situation,  visits outside the US during the process are the most practical solution, imo.

What do you mean what other people do while waiting? Continue school, their employment, live their lives normally. Only after visa in hand do they quit their job and move.

My wife and I were separated for a year during the process.  It sucked, but we managed through (2 times per day) video chats....for the entire year.

There is a fairly easy solution that @Crazy Cat mentioned earlier.  Have him go back to the US and file the I131 for a Re-entry permit.  He will need to stay in the US  until they schedule the biometrics, but he can request that the re-entry permit be sent to the nearest consulate.  Once he had the biometrics and assuming there is no issues with approval of the I131, he is good for two years outside the US as an LPR.  If your spousal visa application drags on past that timeframe, I believe he can apply to extend the RE permit another 12 months.

You're really desperate to come to US. I'm not seeing any B1/B2 being issued. 

 

Now, since you and your husband haven't even filed anything, you're just making the wait longer. He can go online and file I-130 for you to Kickstart the process. Holding everything captive because you don't want to be separated is just delaying things. 

 

I'm surely surprised he came to US for a week in December and left with a GC. That's a record time. @sardine

I know that the waiting stinks.  Even living in Canada my USC husband and I had to live apart.

 

i guess I don’t understand why the re-entry permit that Crazy Cat suggested won’t work.  Have your husband return to the US, apply and receive the permit and then return to Spain to be with you for the duration of your wait.  That seems like the best advice you received.

You really need to research and learn the terms if you want good info here.   This thread is worse than "Who's on First."

 

Also, 90% of us here have had to tolerate some level of separation from our partners.  You are no different or special than anyone else.  It is simply a reality with US immigration.  If waiting is not an option, perhaps immigrating isn't the best choice for you two.
