Healthcare Marketplace Legal Presence Proof

Hi all!  I am signing up for my husband to be added to my health insurance through ACA/healthcare market place, specifically in Nevada.  It's asking to confirm his legal presence in the USA and the documents listed don't really align with our situation.  Of course he has a K-1 visa in his passport, but technically that doesn't qualify as an immigrant visa.  As we are still compiling our AOS packet, and he is still in legal status on I-94 until the end of January, we don't have any other "proof" that he is allowed to stay.  Has anyone dealt with this before?  The documents they are asking for are immigrant visas, green card, notices of action, student visas, etc.  If we have to wait until we get a NOA for AOS, we will be outside of the open enrollment/special enrollment period.  Any ideas on what to do?

You need to look for options outside of Obamacare

He's in a limbo period and therefore doesn't have the proper qualification to get a Marketplace plan. While his status is legal, it doesn't meet the Marketplace requirements at this time.

 

Regarding your question about the NOA and whether or not that qualifies for a special enrollment period: call them now and ask. It might, it might not. I'm not 100% sure. Please update us if you find out any info.

apply for the SS Card immediately with his I 94 /  don't wait on that

Yes,  K1 has so many drawbacks that the entire process from petition to 10 year green and all steps in between is longer than a CR1 ,  more expensive,  and a lot more paperwork and interviews

not sure why anyone tries it anymore except that traveling to another country sometimes just can't be done because covid shut us down or semi down over and over those who met in less than 2 years have to try the K1

My husband came on a K1 in April of 2019 and we got married in May. I don't know if the requirements for Obamacare have changed since then, so you should call them and ask. I was able to add him using his 1-94. We had applied for his SSN, but his card hadn't arrived yet at that point. They accepted him and told us to submit his SSN when he got it.

She can use Obama care . It not welfare and that is what is for.  if the  job doesn’t offer it . You get a subsidies with the insurance that is not welfare . I am self employed and have it .

Employment status is irrelevant to the OP's question.  What they are asking about is proof of legal presence, which is a requirement of ACA plans on the healthcare marketplace.  Btw, I passed the eligibility check on healthcare.gov even though I stated that I am unemployed.
