Certificate of Naturalization PROBLEM (merged)

Hello, so I got US citizenship through my father when I was a kid (9 at the time), he was a permanent resident then became a naturalized US citizen. Problem is I never received a naturalization certificate, I've always had a US passport as proof of citizenship. Would this be enough to prove US citizenship ? or is it necessary to file form N 565, pay $555 fee and obtain a certificate this way?

As long as you already have a valid US passport, that will be your proof of citizenship without any issues. It should be accepted just about anywhere as proof. I would save the money, and not worry about the actual certificate.

You don't get the naturalization certificate because you did not naturalize but became the citizen thru father. Passport is enough to prove US citizenship. However if you want to have something as a proof that never expires, you can apply for certificate of citizenship thru N600 but not necessary.

You already have your correct answers.  Please be assured my answer is intended to be helpful.  When reading form instructions it is critical to read carefully and pay attention to (and interpret literally) all words including little ones like "or".  It is your failure to do so that prompted your question.  As you move forward such attention to detail will guide your actions including informing you of questions you DO need to ask or be sure of the answers to.

 

Your parents had the option and you still do to apply for a "Certificate of Citizenship" but it was not then and is not now necessary for anything I can think of, as long as you have a US Passport.

If you want your own certificate you can apply for it using form N600 but it's not required and will cost you money. If you have the money go for it otherwise, your US passport is all you need to prove your citizenship.

So I am filing CR1 for my spouse and am still at USCIS stage. I had a consultation with an immigration attorney and am dumbfounded. I became a US citizen though my father after he was naturalized. I don't have any evidence of us citizenship besides my us passport. I know the instructions say that it is enough for citizenship evidence but the attorney told me that it could be real problem once the interview comes. She says that there's a 50/50 chance that it could be approved and in case it gets denied that I would have to start all over again after I get my certificate of citizenship. Is this true? Anyone have experience in this, specifically in Ecuador? Any info would be appreciated.

I am not sure it is as high 50/50, but yes in theory a CO can demand your original evidence of U.S. citizenship.  
 

In your case this would either be a certificate of citizenship or the evidence that was used to get your first U.S. passport.  
 

 The  department of state issued you your first passport and is the same entity that is going to issue your spouse’s visa. 
 

Thus I think it is more likely the state department will review your file to re-verify your status than it is that it will issue an RFE.

No, it is not true.  Never heard of this happening but the Immigrant Visa Unit is Ecuador is often difficult to deal with.  Is your father's Naturalization Certificate available to be combined with YOUR birth certificate as a little back-up?

 

Really sounds like the lawyer just wants some extra fees for an unnecessary process.  Scare tactics.

 

Your father's Naturalization Certificate and YOUR birth certificate would have been the initial supporting evidence for your first passport.

Thanks for answering, yes my father's naturalization certificate and my Ecuadorian birth certificate are readily available. Hopefully that will be enough.
