yes she can enter US as a tourist for tourist purpose.  Unless the CBP officer asks about Pregnancy there is no need to volunteer that information.

I agree with this. Thank you!

Most likely she’s gonna be over stay her visa, have to lie to CBP officer because the chance of her to enter USA if she said “ I want to give birth here“ is very slim. Abort mission !

no she will not overstay her visa. She has six months upon entry.

Maybe...Maybe not.  Her authorized stay will be determined at the time of entry by CBP.

So when is she flying, this week? You think she’s going to have no bump forever?

Let’s do the math here : preggie 3 months, come to US, won’t giving birth for the next 6 months. There’s no way she will leave US 1 day after giving birth to avoid overstay

I would have a plan B ready.....especially if she gets pulled into secondary inspection.

I am not sure how pregnant she is. I havent seen her in a year or so. She says she is not showing yet. She is beyond 3 months, that was just my guess. My apologies.

Always, always have a plan b! She will be truthful. But she will not volunteer information.

So when they ask “what is the purpose of your visit”, she will be truthful?

And you will see my edit above to clarify. They have specifically defined the purpose of giving birth as being outside a legitimate tourist visit.

but that "defined purpose" was for APPLICANTS. She already applied and received the visa. Applicants and visitors are different things. Just my two cents.

yes, tourism. Thats what her visa is for.

yes, tourism. Thats what her visa is for.

But tourism is not her reason for coming. Her reason is to give birth here. That's what she needs to answer if she wants to stick to the truth. If she gets a secondary inspection and they find the stuff about the clinic and everything that could hurt even more.

If CBP uses that definition too

CBP does not use that definition: https://www.cbsnews.com/news/birth-tourism-pregnant-travel-visa-trump-administration/ "A Customs and Border Protection spokesperson told CBS News that the new rule doesn't affect the agency's regulations regarding admissibility of foreign travelers, and it "does not otherwise modify the standards enforced by CBP officials at ports of entry.""

Current CBP policy on "Can I visit the U.S. while pregnant and what are the risks involved?": https://help.cbp.gov/s/article/Article-882?language=en_US "If it is determined that you do not have sufficient medical insurance to cover any unexpected or expected medical care while in the U.S., you can be denied entry. "

That is what I am trying to understand. I mean technically she is allowed in as a tourist and can visit up to six months as a tourist. They do not ask if you are pregnant or not upon arrival. Theoretically, she is coming for tourism and happens to be pregnant. I think this is possible. I called CBP and they said it is possible but she needs to have some notes in her file at consulate. The Russian US consulate has been closed over a year now and they do not answer phones, like he was suggesting to me.

6 months as a tourist yes, but she’d need to fly while the airline still permits her to travel and it’s likely that she’d have a noticeable bump at time of entry or she’ll be close to overstay what if baby comes late? Or if there are complications? while she may be as you say a tourist, it’s evident from your comments that she’s not travelling for tourism she’s travelling to give birth... so saying tourist would be a lie...

secondly does vacation insurance cover birth by choice in a overseas hospital? How does she expect to pay for the hospital etc and what if there are complications? This could be an extremely expensive venture even if things go straight forward...

tell your friend to have a medical related visa or have the baby in her home country... far too risky lying about purpose of entry etc
