I129F denied due to 2 year meeting requirement, next steps for person with flying phobia? (merged)

Sorry, one more question.

 

Although I originally filed the I-129F, I got an RFE to provide more evidence for the doctor's letter. When I got the RFE, I hired a lawyer and he included a "Form G-28 - Notice of Entry of Appearance or Accredited Representative". 

 

When I write the letter to withdraw to USCIS, does my lawyer need to send OR can I send? The lawyer is the one who received the denied letter.

You can send the letter, but you hired a lawyer so he can and should do it.

August 6, 2021 N-400 submitted by mail

September 7, 2021 I-751 Interview, Sept 8 Approved and Card Being Produced

October 21, 2021 N-400 Biometrics Completed  

November 30,2021  Interview, Approval and Oath

December 10, 2021 US Passport Issued

August 12, 2022 PHL Dual Nationality Re-established & Passport Approved 

April 6,2023 Legally Separated - Oh well

I really get that this is your real life, and we are giving advice only based on a snippet.  But I think you should go the "move to Sri Lanka" route.  Immigration wants evidence that you have a "real" marriage, and living with someone for a long period of time and being around their extended family is about a real as it gets.  Also, travel is so much more difficult in these times.  If your job will let you go to Sri Lanka, go.  Be with your love and be together.  You don't know what might happen with getting in/out of Sri Lanka, the US or the Bahamas.  Regulations are changing all the time, and none of us can predict what might happen next.  At least if you're stuck, you're stuck together.  

 

Dealing with US immigration is pretty shocking for your average American who isn't used to it.  We understand your frustration!  It's not "fair" sometimes.  And you have no choice but to deal with their sometimes arbitrary boundaries.

 

I realize a lot of the advice you're getting isn't the answers you were looking for.  But please know we are giving you our best advice based on our own experiences. For what it's worth, I married someone I'd been dating (in person) for over 5 years.  I'd known him for many more.  And the first year of marriage/living together was SO hard as we adjusted to living together.  If your love is as strong and true as you think it is, then it can face the scrutiny of a bunch of strangers.  Take the time to think about the advice and turn it over in your mind. If something is eliciting strong reactions from you, maybe there's a reason.

On J visas.  Spouse won DV lottery while in US.  Did AOS from the US.

 

Boston field office, GC holder for 10 years.

Citizenship received in 2016, took ~5 months from application to passport.

Spouse received citizenship in 2019

How about addressing the fear itself-

there are many good courses to overcome Fear of flying - getting a basic understanding of what goes on - UP there - what the noises sounds sensations etc are and perhaps try it in a controlled environment have helped many passengers- contact your airline for additional information about finding help to overcome fear of flight. Where are you based ??

Be careful with sending that kind of money, my lawyer explicitly told me not to send any money or accept any money from my fiancée due to fraud, its a huge red flag. Also not meeting is another, they honestly don't care about your reasons. You cant look at these guys to have any sympathy. You need to satisfy their needs and wants at all costs, if you want to ensure your visa approval. Best of luck to you. I hope you can figure it out

I'm a person that i should I say is or was afraid of heights. I have problems driving across bridges; whether it be over water or not. I drove to Tibee Island years ago and I had a very serious panic attack. 

 

I still have phobias with height. Especially when it came to fying on planes. But, when I meet my husband on a Christian prayer page years ago; I had to meet him. I went to spend time with him and his family.  My mom went with me. I was on connecting flights (3). Even, when we landed in Togo, Lome.

I had to walk across a building with glass windows.  I turned around and a military officer turned me around. I think with a gun. So a gentle and his wife grabbed my hand. My mom was in a wheelchair, so they pushed her.

 

But, I'm stating this because nothing could keep me from going to spend time with my then fiancee. I have been back I believe 4 times since 2018. I am one person that is afraid of flying, but for love I did it. I would not change a thing. My Pastor, my church,  my husband,  and his family prayed without cease for me. I would not have changed a thing. I love flying now as a result of it. I have done my last past visits to Nigeria alone. Because,  I miss him so much. I hope this helps you. It really depend on the size plane if you will really feel anything in my opinion...

I promise I'm not meaning this in a rude way. But I've followed this thread for 10+pages now. I have to ask this ------- are you serious ? I read some of the things you've done and said and expect and my mind is blown. This isn't like inviting someone to come visit you on vacation ----this is PERMANENT IMMIGRATION ! How could you ever expect things to be simple and easy ? Especially now in the middle of a worldwide pandemic and with a President who is absolutely bent on ensuring that immigration is difficult, at best ! As someone many pages ago said, We've all been through this ----when I petitioned for my husband to come on a CR1 from Morocco --our petition was about 8 inches thick ! We made sure every single aspect of our relationship was covered ----and that was even with me living in Morocco for over a year. You're going to have to suck it up, I'm sorry to say. IF this is a legitimate relationship AND you truly want to live together in the US you will have to be willing to make any/all sacrifices to make that happen. You need to be trying every single avenue available to get over this "fear of flying" you have. And relying on the excuse that "unless you have it, you wouldn't understand" isn't going to mean anything to an immigration officer looking at your case. They literally will not care. My advice is to not ask for advice from a group of people who have risked everything, including their health and futures to ensure their spouses were with them and expect some sort of special treatment. None of us got that and neither will you, especially now. You've already dealt your hand, now you're going to have to deal with what you end up with. Good luck !  (And I'm sorry if the issue has been resolved but I just couldn't read another page of comments)
