MY K-1 WAS REVOKED ( HOW DO I APPLY FOR CR-1)

You are required to stay in touch with the Embassy as the application will expire after one year. You have to keep enquiring, also you need to keep an eye on the NVC website where you submit documents as sometimes after 1 year the visa application status changes from submitted to reopened. It’s automatically doing this. It needs to stay in submitted status. 
If it was sent back to USCIS you can contact them directly to find out why it was revoked. The Ombudsman through Department of Homeland Security is who you contact for cases at USCIS, they can investigate. https://www.dhs.gov/case-assistance
 

Thank you, it was very helpful. We submitted a request to the USCIS and we have our fingers crossed. Maybe they'll let us know the reason for denial.

Approved without interview as of Feb 15th, 2024. Was not a combo interview with N-400.

Service Center: NBC, application # starts with IOE#.
Biometrics waived. Got NOA mail Jan 5, 2024 says Interview in Nashville, TN on Feb 6, 2024.
Queue for review and approval. Already in line for Oath Ceremony as of Feb 13th, 2024.
NOA as of 4/29/24 - Oath Ceremony scheduled for May 30th in Chattanooga, TN.

Hi everyone! I reached out to the senator to help us with our case as many of you suggested. The senator had one of his employees reach out to USCIS to help us get some answers and this is what they sent me this morning (the response from USCIS) @Eseskay

 

What do you guys think? Any advice on what to do now? I find it absurd that our case basically disappeared into thin air without any explanation. USCIS apparently never received our case once the US embassy wrote back to me telling that our case had been sent back to USCIS.

@Boiler I don’t think you know what you’re talking about, there are further steps to this. It can’t just be like “oh move on, do this, do that.” We already know that.

I know, I meant no disrespect but it’s possible to reach out the senator again to check. Because the embassy says it sent the case back to USCIS but USCIS said they never got it. There’s something wrong.

Looks like you removed the attachment so I can’t quote from it but I seem to recall it quite clearly said (in uscis terminology) that it”s dead, but that you can file another petition.  In other words: move on, file another petition.

I read your attachment.  Actually, @Boiler knows exactly what he is talking about.....your case is, by far, not the first of its kind.  Once a case like this is sent back, it just dies with no action.......As was stated, the normal course of action is marriage and a CR-1.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

It is currently either at the Consulate waiting to be sent back, on its way back or has arrived but has not been logged into the system yet

 

It does not really matter where it is, it is dead.

 

So you have to decide what to do next, the usual one assuming you want to proceed is to marry and file a CR1, some people decide that need to reverse the process and move, I am sure some break up, but the normal one is that they decide to marry and file as married.

HELLO everyone! Here is an update with what has been going on with our case @Eseskay:

 

I did what everyone suggested and reached out to my Senator. The senators office reached out to USCIS to find about our case and why the embassy sent it back to them for revocation. Attached is the response from USCIS (labeled as USCIS response). After that response, I decided to reach out to the senators office again and ask them to reach out to the embassy this time to find out why USCIS never received our petition which they claimed was sent back for revocation. Attached you will also find the response from the NVC office (labeled as NVC response).

 

What does this means? Can someone please help?
