want to take my wife on a cruise! But.......

Timeline

A cruise to the Caribbean would be leaving the United States. If she doesn't have her Green Card or AP then she will be abandoning the process and won't be allowed in and will have to start over on a CR1 visa

Mostly depends if it's an open or closed circuit cruise. But it would be safer not to even if it's closed circuit IMHO.

If you are traveling under the Visa Waiver Program (VWP), your I-94W (immigration stamp) that you were issued when you first entered the U.S. can be used for reentering the U.S. at the end of your cruise - as long as the cruise ends before your 90 day admission period has expired and you did not travel beyond adjacent islands or contiguous territory, and you were not outside the U.S. for more than 30 days.

If the cruise takes you beyond that 90 day admission period, you will have to apply for a new admission, and you will have to convince the CBP Officer that you were not taking the cruise in an attempt to circumvent the 90 day limit for VWP travelers.

I wouldn't even try it........She is leaving the US.......and, if that ship stops at any foreign ports, it's definitely a no-go...

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I think I've seen somebody report it working in the past couple years.

Is it something I would suggest? No way. As noted, you are risking not being admitted.

Few thoughts come to mind.

 

You said you got married just last month---presumably the AOS has been filed?

 

If the AOS has been filed along with AP, then you'll have to wait until that is in hand for any traveling.

If the AOS has been filed with no AP, then it's a no-go as she'll be abandoning the AOS process if she leaves the US.

 

There are separate issues she may face attempting to reenter if the AOS has NOT been filed as of yet...because there'd be (I presume) no legal basis for reentry at that point, anyhow, since the K1 was already used beforehand.

 

@geowrian ?  Thoughts/correction on the last statement?

Closed circuit only works for citizens and residents not for a k1

You've confused the heck out me here, but I'm always eager to learn. I would have assumed there is no difference whatsoever between someone who leaves shortly after AoS while AP request is pending  vs. someone who leaves shortly after AoS without ever requesting AP.

 

Does it matter if AP has been requested if the the person leaves without AP approval?

If the person leaves before AP is approved, the AOS can be deemed as abandoned and the person may have issues reentering the US.

Leaving the US while going through AOS, and the AP is still pending is not advised.

It is not advisable to leave the US without an AP. 

 

Does it matter if AP has been requested if the the person leaves without AP approval?  Nope. Without an AP it is not advisable to leave the US.
