You cannot file as Joint if the spouse has no SSN or ITIN..........You can amend to Married-Filing Separately.........but tax filing is an IRS matter, not an immigration matter......

Thank you for the answer. I know it is an IRS matter but seems like it effects immigration because all the conversation since last night about this filing status makes me crazy. People say if your tax return is filed as single when you are married, your spouse might get problems during the interview in the consulate. That is why I am freaking out.

I've not seen anyone have any issues at the interview due to incorrect filing status.

Sometimes it can make it seem as though the marriage isn’t genuine if the USC filed as single if there isn’t enough sufficient evidence of bona fide marriage in other ways, especially in high fraud countries. However, many people still get approved for their visa with a “single” tax return. That being said, it still can be an issue at IRS (tax fraud); anyone who has had their tax person tell them to file as single when you are married: FIRE THAT PERSON!! They are WRONG. As others already said you can either file as married filing separately (no ITIN needed, mail file only, no e-filing, writing “NRA” under spouse’s social security area) or married filing jointly (requires W7 application for foreign spouse to get an ITIN). You are, by law, not allowed to file as single if you are married before December 31 of the tax year you are filing for, you must file as married regardless of whether or not your spouse is in the country

Thank you for your explanation.

At the NVC processing now.

Apart from;  Tax transcript,  Affidavit of Support,  Marriage certificate,  Certificate of Citizenship,  Passport page of the Beneficiary,

What other documents are we required to upload to NVC?

Passport photo and birth certificate and police certificate for the beneficiary.

Also if previously married then divorce decree.

Can't think of anything else

The I-130 I filled was bearing my wife's last (maiden) name but now it's changed to my last name.

Do we continue with her maiden name as it is with NVC until the interview day or can we proceed with the new last name from now on in the subsequent documents we are submitting?    Trying not to mess with anything at this stage

I’d modify it with NVC... her visa will need to reflect the same name as all of her legal documentation, e.g passport etc

VJ'ers, Just curious after receiving a DQ email, how would one know:

1. When their file ACTUALLY leaves NVC? - Do you call NVC (after a week or so) and ask if your paperwork is sent already?

2. When does the consulate receive your file? Do you call the consulate and ask if your paperwork has been received?

3. Is there another thread (after this one) where one can follow timeline/progress of files leaving NVC and received by consulates for respective countries?

Thanks,

-KK

You’ll need to upload both the passport page with photo, and passport type photos.. the instructions are pretty much self explainetory, there’s also example of doc required on their webpage
