Because in this stage, it would just be creating ‘paper’ evidence to try to show a real marriage. It’s just a paper trace.

 

How much sense does it make to have a joint bank account when both spouses still live in a different country? Unless of course the foreign spouse also deposits money to that account to contribute to the utility bills etc. Or unless the joint bank account is only 1 of the many other evidences of co-mingling life and finances. 

A couple that married on the first visit, who have not spent a lot of time together but do have a joint bank account is a little strange to say the least. And a tough embassy will have seen this over and over and over....

So what we do with the case since we already filed , before she came the first time we already talking about marriage and already on video call all the time .. we spend 3-4 hours on the video calls and chats a day .. and the age is not the issue here because she have met my mother and sister and were at our wedding too and we have pictures , how can I make them understand that this is love and not me desperate to leave

I agree.  

 

One thing I did do was leave my wife a debit card,  not to contrive evidence but to cover business while she left her job and started transitioning over in prep for moving.  If asked (she wasn’t) I suppose she could have produced it.  Moving is expensive LOL.  (Especially for girls.)

 

I always advise enrolling a spouse in health insurance if possible. Marriage opens an enrollment window.  Helps with the support affidavit.  I add a copy of the health insurance card to every affidavit I’ve ever filed.  Usually good in the US, but not usable overseas excluding emergencies.

 

There are small things like that, things that any newly married couple would do, that are normal actions but most of the asset combining is done when spouses live together and it is abnormal when they do it early.

 

Who adds someone who lives thousands of miles away to a lease anyway?  FLAG.  What’s the purpose?  None.  Only logical reason can be to contrive evidence.

As far as I know It’s a taboo in Nigeria for a man to marry someone older than them let alone a 20+ age difference. And just because the family met the American lady or witnessed the marriage doesn’t necessarily mean they truly support the marriage. I personally know of instances where the man’s family were fully aware of the purpose of the marriage (to get a green card) so of course they had to make the US citizen feel welcomed in the family until the immigrant secures the green card. When that has been accomplished, that’s when true colors are revealed. Matter of fact, it’s the man’s family that will end the marriage and even find someone else for their son to get married to. Based on my knowledge of the African culture, I just find it hard to believe under normal circumstances that a Nigerian male citizen would marry a woman 23yrs older than them. However it’s very common to see younger females marry older men, old enough to be their grandpa.

The question arises how would your mother and sister feel about you marrying a local girl the same age and under the same circumstances?

 

Probably a lot differently.  So even that’s a flag. It’s OK now though why?  

 

Personal note:  My parents were horrified that I was marrying a “foreign girl” I never met.  I didn’t care.  LOL  THAT’s normal.

 

Those are the things you have to be prepared to overcome.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

I think you just need to wait it out and see. There may be some red flags, but you are already 6 months in, wait a little longer to hear from USCIS- they are the ones to determine the outcome, not us. . I understand the anxiety of it all and not knowing, but you're close. You should create your timeline here to help others.

Yea it happens , even here in vj , there are a lot of marriages like that too , some with much age difference than mine .. and if I’m denied my plan is to reapply with my wife and continue applying until I get approved 

Then, Good luck, Hopefully you are working hard enough to be able to afford visa process + attorney ( as you mentioned )+ other expenses and not leaning on your wife's income :)

If you get denied and reapply without adding more evidence of real, face to face time, i.e., many weeks or months together, the outcome will most likely be the same--more denials.  You need a long discussion with your wife about how she can visit you in Nigeria for a month, two months, maybe longer as that is what you will need to overcome the potential (and very likely) denials.  And also discuss a backup plan to live together in Nigeria permanently if that's what you have to do.  If you really love this woman, not just as a path to the US, but really love her and want to spend the rest of your life with her, you won't care where you eventually live together.  Check out the process to get a spousal visa for her to live with you in Nigeria as a backup plan.  Good luck!
