Timeline

In short, no it isn't discrimination as they are legally allowed to vet potential tenants prior to leasing property to them by making use of a standard US form of identification such as a SSN. It is no difference to asking for a drivers license or ID card/book at a bank. I am not sure why he has not obtained a SSN yet but I would suggest doing it ASAP as this was literally the first thing I did when I arrived here on my K1 Visa

Unforutely even when his SS card comes, it will not help for leasing an apartment as he will not yet have a credit score 

if you have a credit card and good credit add him to that account / it will help him with this needed score for future 

 

and it is not discrimination  / all of us are asked for this same info in order to lease or buy

I definitely wouldn't call it illegal, or discrimination. They likely want to be able to verify the people potentially living in their facility, and run background checks. In all honesty, I'm not sure I'd want to live somewhere that isn't willing to require that.

 

SSN can be obtained immediately for a K1 - it's recommended that it's done as soon as possible, and can be done before AOS is even submitted. Yes, it can take up to 4 weeks, but may not - my husband received his in half the time.

My husband was interrogated by CIA and Mossad at JFK before boarding a plane to Israel. They thought he might be an Islamist LOL because he hung out at Islamist websites to gain knowledge and hack into them... (He is a white hat.)

Yeah I saw that thread as well and was thinking that he must have come across all wrong and just been snarky in general.

The credit score affecting it will be hit or miss.

It'll depend heavily on the OP's income and credit score since he has none. If say she makes 30k a year and they're looking at a 700 a month apartment, they're probably fine because it'll be slightly less than 30% of their total income for the month. But if she makes 30k a year and they're looking at a 1000$ place, with no credit score on the guys end, yeah they probably won't get it.

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Ok, I was just wondering. They only have 1 active Mod for that forum and that's why it's not cleaned up alot. Don't get me started about the other issues and why I had to create a alt to post anymore there.

Agree'd. Much like say someone not getting a job because they're old. They're never going to be told that the reason they didn't get the job was due to age, they company will simply say "Thank you for your time and application, but we have decided to move onto other candidates! We will keep your application for 6 months!".

And again, we're all asked of these things.

Her fiance is currently not a K-1 visa holder, a visitor, or a legal permanent resident. He's simply legal within the US without a determined status pending the AOS application, but it doesn't mean he shouldn't be required to fill out the paperwork and provide needed info just like EVERYONE else....

I mean realistically, if they just let him slide, there would be people who say they discriminated against them because they were asked for such info and the fiance wasn't. 🤣

Go for smaller independent landlords. A lot of the large property management companies have rigid rules and cannot make exceptions on a case by case basis.

 

I added my wife to my lease when she moved here at the apartment I had been staying for several years. I was on really good terms with the landlord so he didn't ask for anything other than a scan of her passport page.

If he had just said that we are unable to rent it to you, it would have been fine.

 

The purpose of the SSN is to do a BC / credit run, since he just came here, he is not going to have it, but that shouldn't be a thorn.

 

You could:

1. Submit the i-94 as proof

2. submit an ITIN number instead of SSN

 

Wish I knew THAT instead of waiting for the EAD.

This is another reason the CR1 is so much better than the K1

You check the ds 260 for immigration to do the SS #

you can add the spouse as nonresident alien to tax returns giving him/her ITIN 

with that ITIN you can add to banking account (before they even come here)

and i was able with a POA add Adil to one utility bill and my one credit card

when he came he had SS card within 3 weeks and a credit score because he was on a bank checking and savings, water bill and credit card for all the years we waited to be approved
