Hello all!

 

Finally sent the AOS package on 4/18, FedEx shows received 4/19. Let the wait begin! 

However, I realized after checking everything a dozen times, I still managed to forget to include current pay stubs with the I-864! I sent in tax transcripts for 2018, 2017, and 2016, as well as my passport bio page. My income is well over the poverty line - I'm guessing I'll get an RFE for either current pay stubs or employment letter? Does anyone have any experience with this? Thanks! :)

Woke up to several text messages this morning with case numbers. So relieved to finally be in the queue. We sent our package on 4/12 via usps and it was it wasn’t picked up from the lockbox until 4/16. Does anyone know the average wait between the NOA1’s and the biometric appointment?

Assuming you're adjusting from a K-1 (and if you're not, this is not the right forum; the forum for non-K1/K3 AOS is here: https://www.visajourney.com/forums/forum/130-adjustment-of-status-from-work-student-amp-tourist-visas/ and K3s basically aren't issued anymore ), have married, and are not recently widowed or divorced and filing through some more obscure provisions ...

 

A number is on your NOA2 from your petition

current immigration status - we put 'K1 visa'; different guides will give different answers as to what to put there as there's not really a name for the status you're in post-K1/pre-AOS; don't worry too much about this.

class of admission - we put 'fiancee visa', but it's the same deal as above

receipt # of underlying petition and date - your I-129F case # (probably starts with WAC) and the date is the 'received date'

current marital status - married

How many passport style photos did you submit for the whole package? Just 2 or straight up 6? (2 per form)

Also, in the cover letter, did you put the USC name or the k1 holder's?

K-1 holder's, but note that the cover letter is not an official form or document; it's just to help the person reviewing your case out. So don't stress out about addresses or formatting or who it says it's from.

Good luck with getting through it quickly as well!  I am fairly certain that as long as you don't leave the country you are still able to work under your TN until the green card is approved, so you shouldn't have an issue.  It is a long time not to leave the country though!

Anastasia's bio page in all cases, and her K-1 visa page for the I-485.

My bio page as proof of citizenship for the I-864.

And I just realized there's a typo on the cover letter we sent, so I'm going to need to trust my advice :D

Actually, not so true.  

 

My attorney has affirmed...if I do NOT receive my I-765 IN-HAND by August, 2019, I must IMMEDIATELY stop working.  I will be permitted to remain in the US until my case receives its determination (hopefully, an approval of the I-765), and once I get the card IN-HAND, I can resume working again.  My employer will NOT allow me to continue working 1 second if my status is expired, and quite frankly, I wouldn't do anything to violate those restrictions, either.  

 

The time-frames for processing is ridiculous, but I guess there's nothing I can do until then.  Hence, the "UGH"... LOL  :)
