Don't carry anything with you through the border that you don't want searched. Declining to a search at the border is not going to end well (especially for a non-USC).

Encrypt electronic data with a good key.

Timeline

This afternoon the White House issued its legislative framework to accommodate the Dreamers and reform Immigration.

as you know the deadline for Dreamers is March 5th.

the proposal includes ending all family immigration except for spouses and children under 18. No parents, grown children or siblings.

The critical point will be what they will do with pending petitions for the categories they will eliminate?

one proposal is to invalidate all pending petitions at both USCIS and at NVC. That would mean even if we have our petition approved at USCIS but not the NVC we will be eliminated from the process.

To keep up to date there is plenty of coverage online on any of the US News sites.

H.R.4760 Securing America’s Future Act. Proposed by Senator Bob Goodlatte. He was present at the White House bi partisan meeting at the White House on January 9th where Trump said he supported the Bill.

It is stated in the clause ‘Inadmiissability’. As of the date of legislation neither USCIS or NVC can adjudicate or process any pending petitions.

this is still a plan, a proposal still, nothing has been approved or set in stone yet. i think the original post is a little misleading and may sow fear which i hope was not OP's intention.

 

there is one article that said "The administration would continue to allow people who have already applied for entry to be processed under the old system." which to me makes sense and is fair all things considered.

what i do wish they would do is remove the option to AOS from a B1/B2. B1/B2 holders can marry and all but they must exit the USA and return to their home countries to complete the process if they want to AOS.

Where did you get this information?  They would never do that, just the process of lawsuits demanding refunds for all pending (100s of thousands) cases would be enough, please refer to the wording of the present legislation pending:

 

"The White House would apply the new limits on family unification prospectively, continuing to process a backlog of hundreds of thousands of visa applications, many of which have been pending for more than a decade".

the problem is people quoting online articles and not going straight to the source. I am not into politics and their lingo, but from what I understand from the bill it looks like they are indeed planning to cancel all of the pending petitions from USCIS and NVC levels if it passes. You can find that info in the official Securing America's future Act (H.R. 4760). Here is the quote:

 

"INVALIDITY OF CERTAIN PETITIONS AND APPLICATIONS

 

(B) PENDING PETITIONS.—Neither the Secretary of Homeland Security nor the Secretary of State may adjudicate or approve any petition under section 204 of the Immigration and Nationality Act (8 U.S.C. 1154) pending as of the date of enactment of this Act seeking classification of an alien under section 201(b)(2)(A)(i) with respect to a parent of a United States citizen, or under section 203(a)(1), (2)(B), (3) or (4) of such Act (8 U.S.C. 1151(b)(2)(A)(i), 1153(a)(1), (2)(B), (3), or (4)). Any application for adjustment of status or an immigrant visa based on such a petition shall be invalid."

Hi everyone. i just want to know ur thoughts about the RAISE Act... Do u think it will pass or not?? The possibility of it passing really scares the out of me since it will hinder our plans of petitioning my mom two years from now. my mom was divorced by my dad in the US so right now, she can only rely on us for the petition. My brother still needs two more years before he can apply for Us cItizenship so we cant really do anything but wait.

Honestly I do think it will pass and if you are doing a petition 2 years from now then don't think she will be able to come here unfortunately. What they might do is make it retroactive, basically meaning if you already have a petition on the books by a certain date then they will accept it but no one past that date.

I would agree with the above. I think there is a good chance that is might go through and also think they might take into consideration current applications but likely put an end to future applications. 

 

But we will never know for sure until it either passes or not.

I had heard yesterday with ending the DV lottery, they would take those annual spots and apply those to people already in the system to help with the 'backlog' of petitions; but yea, if not already in the system, it wouldn't matter so.

but they do have made another visa category for parents in the RAISE Act... have u heard about it? accdg to what ive read the parents would be granted a 5 year renewable non immigrant visa as long as they would not work in the US and their US Citizen child could arrange a health insurance for them... i’m not sure, however, if the parents should be of certain health condition and age first before applying for the said visa. do u have any idea on this?
