    Having a wife that is an overstaying a visa and has had children in the US ( are they his  ?  )   I can't think of a single thing that would overcome the presumption of immigrant intent .  Any officer that would grant a visa under those conditions should be sent back for retraining.  Sorry but any non immigrant visa is a no go until there are more ties to his home country than the US.   Maybe your friend and the kids could all move to a 3rd country with the husband for a decade or so .

    Getting a security clearance with a foreign spouse depends on many things.  The country of the spouse , how close they still have to that country and what the actual assignment.  A lot of the money spent in clearing a person is background checks but a person can get cleared for one project and still not be allowed on another.

    The problem with immigration is it isn't a right to bring a foreign person into the US. You have officially asked for permission to bring a non USC person into the US. The US is checking to see if it wants to say yes or no to that request. Certain countries have earned a spot on the "check them out really good" list and undie bomber boy earned Nigeria a spot on that list ( AP was rarer before ) There isn't much to do as the government isn't prone to energenic movement on such things.
    Hopefully you are well known amoungst his friends,family and neighbors so the field investigators get the right answer when they are poking about.

    The purpose of a visitors visa is to visit , To abuse it and enter knowing you don't intend on leaving shows a lack of moral ethics and I wish there was a way to screen this type of person out of the immigration process. The US already has enough unethically people here we don't need to open the doors for them.

    They are now forced to make a decision based on the data in front of them.  If a namecheck hasn't returned they will deny the visa.  That is their only option at this point, waiting is no longer an option.

    I grew up rural poor in the United States.  Fast food wasn't an option , still isn't because it is at least a half hour drive away from where I grew up and for anyone think it is cheaper than home cooked hasn't ever really been broke. We wer poor as in we didn't have a water heater , indoor plumbing was something my father did shortly after I was born.   I wore hand me downs so gosh awful ugly even my sisters would tell mom to stop making me wear them at times.   A lot of what we ate was given to us or foraged and canned .  Food for free isn't necessarily good on it's own but can be used to help build a meal .  If I have the rice/noodles I can spend a bit on meat to with it.   A lot of greens and fruits can be gathered in season.   
       Having grown up on that side of poor,  I studied and have  engineering degrees and a masters and now enjoy being on the other side of middle class.  What I think the issue is that we don't prepare ( push) young people into becoming productive adults.

    Yes and AOS can be applied for based on the original I130 filing without paying for a new I130. If the old one is hung up in security checks it will hit the same snag in many months on a new petition.,

    Why would you withdraw the case  and pay a new filing fee ?  You should file the I485 and attach a copy of your NOA1 from the old case and get on them to find it.    Are you are USC ?

    The OP put CR/IR1 as a class. It seems they have may have a misconception that all "family" petitions take a year.   But assuming they are at the other end of the process and sponsor means provide an affidavit of support for his wifes / the OP's sister  then the child would still be underage and could come.  It all depends on the details on where the petition is ( not yet filed, approved and sitting on a self for the next X years or nearing an interview )
