    I hate seeing cases like this. You situation isn't easy but the attorney should have immediately seen the issues. 
     
    Only two real options.   File the I-130 for your son and try to expedite it (doesn't really meet urgency but free to ask)  or get married and file I-130s for the both.

    Get a K1. It will allow you to do the thing you planned to do anyway (though it may mess up the timing).

    Uhm, yep, that's pretty high. 2 out of 3 people will not get a B visa from Nigeria. 
     
    Sidebar: On that list, it says the Vatican City has a refusal rate of 8.33%. Wonder what priests/Cardinals/Bishops are not allowed in the US 😂

If the deceased U.S. citizen filed an I-130 visa petition before the death, it converts to an I-360 automatically, though the immigrant will need to advise USCIS of the death first." OP would contact NVC and provide a copy of the death certificate.

    Even having one misrepresentation is bad. But with one, maybe you were naive, young, stupid mistake, uninformed, or careless.
     
    With two it is viewed as habitual.. and that leads to being perceived as an immoral character.
     
    Unless you have been missing the news regarding immigration and this current administration, being an immigrant who commits misrepresentation (and more than one for that matter) should be avoided at all cost.

    Hire a more competent lawyer. The difference between getting married and going the CR-1 route instead of the K-1 is that the CR-1 provides an EAD (ready to work when he/she lands in the U.S.). Not so with the K-1.

    Well, it seems that your friend plans to overstay and marry a US citizen.   Argentinians can point to him as to why it's hard for them to visit family in the US.

    Green card marriages aren’t legal, either.
    Not many people manage to meet and confirm they have found their life partner within the space of a B visa authorized stay period. Though it does seem to happen much faster when a green card is involved 🙄

    Hi folks.
     
    I'm really sad and depressed. I need help.
    Here's my story.
     
    It's been really tough and (removed) for me, if I'm honest. I had a great couple of months and then he's turned into some kind of control freak who is hell bent on blaming everything on me. I live with him in a basement in his aunt and uncle's house (I was sick for almost 2 months because of the conditions, poor food quality,) he hasn't and will not file for the AOS because he didn't do his taxes and other reasons he won't say. There's also the fact that he spent all the money his mother gave us in July last year to file for the AOS and a second lump he got from some tax returns he waited for me to get here so I would get him more returned!
    He keeps telling me that he spent it on me but none of it adds up. 😞 

    He's tried setting me up for under the table jobs he knows I can't do and then I'm labelled a bad person for not taking them.
    Every day is a walk on eggshells. I'm pretty sure he is a sociopath so my emotions mean nothing nor recognised. I'm just called a bunch of names and so on. Everything is my fault.
     
    I'm an emotional punchbag and get grief for not being happy or "loving" towards him. My life is "pointless and meaningless". 🙄 I feel empty and like I have nothing now. Not sure why I'd give him all the good stuff when I'm treated like dirt. But, hey ho.
     
    I'm a mess. I really didn't expect any of this and I'm really scared about what to do or what I can do. I sure as hell can't afford to eat, let alone pack all my stuff and my cat to go back. I gave up everything for him. Home, job, family, friends...
     
    I'm really scared. I cry every day because I don't know what to do. 😭
    I'm pretty sure I'm illegal and I'm really nervous about it. I'm also not sure what to do and if this is even the right place for this. 
     
    So, I'm looking to go back. I want to go back. I do not want to be trapped, illegal, and have no independence what so ever. I have no reason to stay here anymore. It's terrible really. His family even sat down with me and have noticed how cr@ppy things have been with his behaviour towards me and everyone. Nothing has changed since the talk.
     
    This has been a huge waste of time and money for me. My passport ran out, AOS was not submitted, I have not got a penny to my name nor any help available to me. I paid for everything to be here. He did nothing.
     
    I should have read the signs and listened to people from day 1.
     
    Sorry for the rant. I have no one to talk to. I have this secretly tucked away so he doesn't see. 😞
     
    My questions are;
    What can I do with regards to divorce? What is the process?
    I just want it over and done with so I have no ties to this awful life anymore. We have no joint accounts, nothing that "we" have. All his stuff and my stuff. No kids. Nothing is shared.
     
    Does anyone know someone I can talk to? Preferably free. I need help. I need to get home.
     
    Would I be able to return to the USA for vacations later on?
     
    Is there a duration of time before I renter the US as a tourist?

    Don’t you think they’re being a bit dramatic about all this “largest peacetime repatriation effort” stuff though? It’s people going home from holidays, it’s not like they’re being rescued from disaster zones.
     
    Also isn’t this what travel insurance is for? I understand that it’s hard to get hundreds of thousands of people onto other flights in a short time if you’re trying to do it en masse... but individuals can have other alternatives rather than waiting for the government to do it at no extra cost but at some undetermined future time. After all these are people holidaying abroad, one assumes they’re not on the breadline.  I don’t mean to sound unsympathetic, but there are likely to be alternatives for those who really need them. Maybe Madagascar or something would be very tricky, but for those who need a flight back from the US before their authorized stay expires, certainly many options.

    I'll have my interview next week and after this thread I hope that nobody is going to ask what I miss most/ what I'm looking forward too most when seeing my partner again. From now on my answer will be arts& crafts 😂😂

    The child was in their custody at the time they applied and got their green cards.
    they left their child with his grandmother when they moved to the U.S a year ago.
     
    the problem is the kid could easily just get a green card if they mentioned him in the paperwork.

    I have overstayed for 4 hours.... That counted as a day and I got my VWP revoked... Before I knew about it, I traveled twice back to the US... Until I decided to stay for the summer with my wife (while we waited for the interview). They pulled me to the side and said I had overstayed. I told her I've never done that, the officer then asked me whether or not these dates were correct, and told me the dates of over a year ago. I said they were correct, and three months is not the same as 90 days... Some months have 31 days... And it was dumb to stay so close to the limit, lesson learnt, so I indeed overstay. It doesn't matter if for 4 hours or 179 days. They were very understanding of my situation, and they knew of my plans to marry next time in the USA. I didn't lie about anything and I took the next flight back home. Didn't even get the chance to see my 3 month old who was waiting just outside that room. He's six now, I haven't seen him yet. But fortunately the senator was able to expedite my interview, and recently it went to Application received, hopefully it is issued next week, since my savings are running low for daycare while my wife works. what helped in my case was a Sworn statement I made with the officer at the time, I don't think that is a option for you, considering your situation... Anyways, I really wish you the best of luck, 3 years is a long time, but consider this: the USA and Canada are relatively close... So even if you can't travel south, they can travel north...
