The answer is BOOM!  An I-797 appears in my mailbox? No updates along the way. And the process is now taking 5-8 months but closer to 8 then 5. https://egov.uscis.gov/processing-times/more-info

The K-1 is expires 6 months after the medical exam.  Once you enter the US, you must marry within 90 days from the date you entered the US.

Kowatti reacted to Ben&Zian in ESTA Entry with K1 Visa Marry after 90 days
Once you enter you will enter on the K-1 visa. They will void it and you will have the 90 days to marry and AOS. If you leave, you won't be allowed back in trust us.

Best option is to adjust the flight for say 10 days later so you can have time to marry as planned within the 90 day window. That is a must.

Or as suggested, get to the US, do a simple court house wedding like a lot of us do, then use the planned wedding as more of a ceremony for friends and family but at least you have fulfilled the 90 day requirement and even can already have filed for AOS.

You can try apply for emergency AP, but I doubt you'll get it.

Delay?  No.  (Maybe a few minutes)  Extra scrutiny?  Maybe.  Depends on the individual circumstances.  It is never reliable to get immigration advice third hand.  Have HIM, come ask for himself.

Did I read correctly that USCIS employees are being diverted away from green card cases (people who pay fees so USCIS can operate) to asylum cases (people who pay nothing, most of whom don't even qualify for asylum)? If that's the case that kind of bothers me considering my wife and step son just started the ROC process and from what I read that process is taking up to 2 years these days. Not to mention I am having to jump through a bunch of hoops trying to get an extension letter for my step son. So essentially people like us who pay for USCIS services are supplementing illegal aliens trying to play the system and were having to wait longer as a result.

That's good info for everyone to have Greenbaum.  I am sure some people make mistakes, send in their paperwork, review copies of the I-129F later & find out they missed something or made a mistake.  I have seen this come up several times in different forums.  Thanks.

They want to see everything--police reports, court hearings, evidence of whatever the crime was and the outcome of the crime, whether the charges were dismissed, sentence given, everything.  If you don't have the documents, request copies.  Most of it should be available in the court with jurisdiction over your case.  Attach all of the documents you can find.

Hi.  I always wondered the same thing at the begining.  Ours was extremely accurate.  As time progresses & your timeline changes/updates, it becomes more accurate.  That is assuming there are no issues that you have to respond to.  Good luck in your journey.

Sit back and relax. Its going to take way more than just 3 months. More likely 6 +

Take this time to research and prepare for AOS so you're not shocked about that long waiting time for green card and being unable to work, travel, etc.

Hi.  I received our case # within 2 weeks.  It varies.  You might want to contact NVC @603-334-0700 or 603-334-0888.  The 0888 # worked out better for me, so you can try that one first.  They are open 7:00 am & probably the best time to call.  It can take several weeks before you hear anything from them.  The K-1 seems to be a little faster & spousal visa takes longer.  Ask if they have received your case & also do they have a case # for you.  Best wishes.

Hi.  You are only required to meet your beneficiary fiance face to face within 2 years of filing.  You don't have to wait to meet her parents to start the process.  The I-129F fiance petition instructions gives you most of the information you need.  Good luck.

It is always advisable that you do not book  flight tickets before the visa in in the passport and delivered to you. With immigration anything can go wrong.

I want to encourage you to be positive & things will work out.  VJ members are trying to help with the knowledge they have.  I can tell you from personal experience that when an African country is considered "Muslim" country or anything other than Christianity, although we know it's not fair, the consular seem to scrutinize people from there because of their belief.  Consulars overall are not bad people.  They use certain guidelines for the decisions they make.  This is a sensitive area people prefer not to talk about.  I empathize with you & understand what you must be feeling.  If your passport was kept, it's a good thing & something to give you hope.  Hugs to both of you.....................

So sorry.  A lot of beneficiaries from Africa are given this form, especially from countries the US considers high fraud.  Senegal is famous for giving them out.  It must be so frustrating for you.  Hang in there.

Kowatti reacted to Sailormooon in redacting "What's App" conversations
Hi, my husband and I have a large age gap (24 years). I'm 24 whilst he's 48. I had 3 years worth of chats with Him. I sent WhatsApp transcripts to my email by clicking on his name on whatsapp and choosing to 'export chat'. I then used Microsoft word and wrote down each month e.g January, February, March...  and copied some of the chats we had during the specific month. I left out all the juicy bits! That made it a lot easier, more organized and less documents to send in...

Btw, in regards to your 'less frequent' issue, I only copied 4  little conversations per month.. It was literally a small paragraph per month to show we consistently talked. It looked like we barely talked per month even though we talked every single day! I just know they wouldn't want to look thru all our conversations! You don't need to worry!

I think they put more importance on your face to face meetings so make sure you've got pictures together, plane tickets, hotel reservations etc etc.

We had 0 problems during the interview and throughout the process. No one mentioned the age difference! I am now in the USA and have filed for my AOS. Hope this helps!

Welcome to the world of immigration. Many people are shocked to learn that, yes, they can be considered "too married" simply by having some form of ceremony. The phrase "too married" is simply an unofficial phrase used by people who are in the know of this process. In reality, the proper term would be ineligible to receive a fiance visa. ANY perception of a marital union, whether culturally normal/legal/unlegal, or not can be used against you. The key word in that last sentence is perception! Below are only a few threads where members have been denied. This is why research is paramount when going through this process.

If you are so confident, then why ask others here?  If there is an issue of being too married for a K-1 (which has happened to numerous others here on VJ), the problem will likely arise at the consulate interview stage.  USCIS is the easy part.

I'll have to admit that it certainly sounds like a wedding, but only the CO's opinion really matters.....good luck.

You can defend it all you want, but it won’t matter.  @Roel is preparing you for the worst case scenario.  Even though not a “wedding” by your norms, it certainly sounds very formal, which is where you could run into problems.

I wish you luck, but just be prepared incase it does not go over favorably for you.  You will have to then marry, and re-file for a CR1.

The IO can take cultural norms into consideration but having photos in a church with a priest who stamped a certificate sounds an awful lot like a wedding. This is why it is highly recommended on VJ to not have an engagement ceremony at all or send pictures of engagement parties.

Since youve already sent off the petition you have two options.

    1. Wait it out and see what happens. Then, if you get denied the k-1, marry and file the CR1.

    2. Withdraw the k-1. Marry in Jordan or another country and file the CR1.

What kind of certificate is it? Are you sure you’re not already married?
