Nouchigang got a reaction from Firebread in DC/Baltimore AOS
    Hello,

From personal my experience and what I read on VJ for the Baltimore office, if they did not approve you on the spot, yes it is normal not to hear anything for while at this office, you should expect an answer or follow up after 3-4 months. And you dont hear anything back please call to schedule an Infopass to make an inquiry.
I havent seen a lot of activity from this thread or other Baltimore threads for a while now, I think most people just dont come back after getting approved or we are not a big number here on VJ.
In the mean time,  If you havent done so, please make sure to create an account with USPS informed delivery, it is free and you can do it online, make sure to create accounts on both: https://egov.uscis.gov/casestatus/displaySignUpStep1.do and https://myaccount.uscis.dhs.gov/
If you move please make sure to file an AR-11 online asap and also please fill one AR-11 for each receipt numbers.
Also please keep up with updated  USCIS policy because some employees are not aware of them.

Let me explain why I am saying that: In my case, it has been almost a year now since my interview (adjusting from B2, interview was June 26 2018) and I havent had an answer yet. They sent me a RFE at the end of April 2019, probably triggered by us moving and filing the change of address. After getting lost for a while I finally received the letter 1 month and a half letter and they requested a new I-693 but the one I gave last year is still valid because they changed the validity for medical exams to 2 years in October 2018.
When I called to speak to an IO and tell them I do not understand why they are requesting a new medical exam from me because I already provided one in hand in hand to the immigration officer last year and it is still valid because the validity has changed and, it is now 2 years. The officer was surprised and even started to argue with me, I told him to double check, When he did verify, he realized his mistake and he even told me "well I learn something thanks to you". Can you imagine how many people got wrong information from him?!
Anyways all this to say, please stay on top of it, call every month if needed, to check on the status, and if you dont get approved after the 4 months please go talk to somebody at the field office
    Good luck

Paul received his notification that his EAD expedite had been approved and the card was being processed yesterday.

We had zero issues. We submitted the expedite ourselves and then also (same day) though our senator.

We did not send a bazillion pages - a letter explaining why the expedite was requested, the NOA1 and biometrics with stamp, and his job offer letter, and a screenshot of his bank statement. I think it was 6 pages total.

We submitted it about 2 weeks ago.

Coincidentally, yesterday was his birthday and he said it was the best birthday present ever

Alright! I finally got my work permit, after having called them 3 times and 2 weeks of waiting after that. When talking to the operator I did emphasize on a new job offer and a possibility of losing it. It could also be because my case is out of normal time limits, but the last time I called they told me it actually was not since it hasn't been 25,5 months yet. When I asked to talk to the tier 2 officer they refused. Oh well, we'll see what happens next...Just in case, the time line for the permit processing is attached. Thank you guys for participating and good luck to us all with everything! Will keep you posted 😁🤞

They just cleared the cheque on the 14th---so only a few business days (not including weekends) since.  Wait at least another week or so---It can sometimes take up to 30 days to receive the NOA...hopefully you hear something sooner rather than later.

The good news is the cheques were cashed, so at least you know it was properly received.

Hi everyone, my husband had his interview this morning and he was approved! Thank God! He was asked the following:

How many times did your wife visit you in Morocco?
What are the dates of her visits?
What is her date of birth?
    Is your wife sponsoring you?
What does your wife do for a living ?
What's the name of the company she works for?
What is the company address? (He admitted he did not know the answer to this and I suspect she just wanted to make sure he wouldn't make something up)
She asked where I was and he told her "She is outside waiting with my father, I have her passport here" and she told him "No need, your visa is approved"😛.

Out of all the documents my husband had with him, the only thing she wanted to see was the police certificate, court record, his birth certificate and our marriage certificate.

    He also observed a bit while inside the consulate so here's what he told me;

-A lot of people around him were being denied
-He noticed they either did not provide enough relationship evidence, they were caught flat out lying to the CO, or they could not speak English well.
    -He witnessed one K1 approval

So there's that. She told him it would take a week or more for the visa and she kept his passport. I've been in Morocco much longer than I anticipated and so I need to get back right away. Hopefully he gets his visa quickly so we can return home together.

Thank you so much to the helpful members here at Visa Journey. I can't believe we did it on our own without the " help" of lawyers. This site definitely provided invaluable help on this journey. Good luck to all who are waiting, your time is coming soon. Thank you again and sorry this is so long.

OP, it is sad to learn what has happened to you during the waiting period in your process. The best decision you have made was to get an attorney to fight this unjust deportation of your spouse. Moving during a process is quite normal and all we can hope for is that the postal service does its due diligence and send mails to the correct address while the sender provides the postal service with the accurate address information. Neither was done in a satisfactory manner and you are now left with a ridiculous deportation letter.
It irks me to see that applicants are paying DHS an arm, a leg, a kidney AND your first born child just to file a green card application but they don't even have the decency to do their own process right!

Yes, I’m seeing this happen more often and recently. It makes you wonder. At least send them certified so someone has to sign for it. I moved, updated my address with uscis, saw that they updated it and they sent an RFE to my old address. Luckily, my friend still lives there and let me know. But what if she didn’t? Our 130 would have been denied for something sent to the wrong address, an error on their part since they updated the new address. And when I called them and told them, all I got was attitude as if it was my own fault. It’s really getting ridiculous at this point. Sorry had to vent about this. Poor guy...it’s really not fair!

Mail sent first class by USCIS is sent as Official Mail, which is a classified under government service mail. This type of mail may not be forwarded under all circumstances. For instance, I've seen it forwarded where the same Delivery Unit (DU) covered both the original and forwarded addresses.
Presumably the denial notice was generated after the COA propagated to their system, hence it was actually delivered to the new address. Mail is not an Act of God by any means.

While not moving mid-process is optimal to avoid mail being sent to an old address, it's not exactly practical or even possible in all cases. Immigration shouldn't be a factor in whether or not to move.

Agreed!  My 751 reminder was mailed to my old address (and forwarded to my new address), even though I updated my address online a day after we moved (9 months before the letter was sent).  Sometimes moving is unavoidable, so it would be nice if USCIS could reconcile their systems so these things don’t happen.

@greg1984 - Definitely try to resolve with a tier 2, and failing that an attorney should be helpful.  I hope this works out for you without too much of a hassle given that you did nothing wrong to be denied.

    PD: 01/22/2019
Assigned to Nebraska Service center... praying a miracle to have it approved sooner rather than later.
I may suggest to my brother to try to get his senator involved if we dont hear anything after 6 months. He lives in TX

Congrats to all the one that already got approved

Nouchigang reacted to SpaceAge in Beware bad information on AOS deadline for K1 (fresh out of jail)
Did you even read the post!?
I did not ‘just’ marry with no mention of adjusting, I had COMPLETED the AOS pack with a signed check on time but I made the monumental error of waiting for my husbands 1099 tax form to be resent to the correct address. This meant I was just over two weeks late after also having issues with my marriage licence going awol directly after the wedding, I had proof of both issues. I was trying to go through the ‘proper channels’ as I had the whole K1 process.

I have just served 5 weeks in jail, I am now fully aware of my mistake here of not realising the I94 was what I should have been looking at, not the steps of the K1 on USCIS which did not imply filing in he 90 days, only marrying.

I had not been on Facebook seeking legal advise as someone implied either, I came out of jail and looked up the sources of what I know is now dangerous bad information, such as VisaJourney, and included it in the post to simply warn others. Visa Journey BTW stand by the fact you CAN file after 90 days, yes you probably can but if you show your id to law enforcement you could be in my unfortunate shoes which is very distressing and upsetting.

At the end of the day, noone is going through this but me, I am trying to warn others and not looking for sympathy. I feel bad enough as it is that this has happened when I thought I had done everything right. I know numerous people who filed after 90 days without issue but none have had to show ID to encounter the consequences, the consequences we know know are jail.

I filed my completed AOS through the court last week with amendments by the lawyer to say I now overstayed and had been arrested. The signed document I had completed was used with dates within the 90 days as I had fully intended to post it but waited on the tax form. I was not actively looking to overstay as many are implying.

I have been to the US over 17 times and never overstayed during my relationship, I understand most ‘mumbo jumbo’ on the forms and on USCIS website, but I am still not seeing a clear part on USCIS about the I94 expiration date and the K1 and this was my downfall. I am not the only one to misinterpret this reading elsewhere.

I am not replying to many more posts on here, I feel bad enough right now and was simply warning others to make sure they file in 90 days no excuses. Just send it even if you will get an RFE as I wish I had as it has cost me EVERYTHING. There is not more to this story as others have implied either, i was not driving, I was not committing any crime, I have no criminal record, I am just unlucky to have showed my documentation when asked.

Jail in the US is no joke. ICE did their job which will delight some people commenting and I agree with them, I have also however spoken to real people detained for being illegals with NO paperwork or any visa and have changed my own opinions on that. Some of the reasons people come to the US are horrific, I understand a little more as to why those people are risking their lives to do so but in my case I moved for love and was doing what I thought was the right thing or I would not have had an approved K1 to enter on in the first place.

I hope noone else has to go through anything like this, I am not perfect and make mistakes and some it seems are larger than others!

When will this ignorant misleading statement finally die a painful death? It gets spammed on every ESTA/B2 AOS thread and to date no one can demonstrate a verified case where someone was denied for "intent".

At our interview it didn't come up at all except that the officer crossed out "B2" and wrote "Advanced Parole" under the "most recent entry status" or something like that. Literally nothing about it was mentioned.

Having said that, the AOS process is excruciating nowadays, and I've heard the large TX offices are especially slow with interviews. So know what you're getting yourself into.

If you are driving to the office for the interview (and not taking a cab or a bus) there are two parking lots/garages right by the office.  We did the one on Harrison and it was a piece of cake!  You can prepay for it, too.  (We used SpotHero.)

I don't know, I just started the process this year. Upon the insistence of my attorney, I included the medical with my package. She insisted that doing so would help minimize delays. I'm not sure if that is true, but my PD is 2/27/19 and I already have my interview scheduled on 5/20/19, so 82 days, which is way faster than I ever anticipated. So maybe submitting the medical with my package did help speed up the process, but it is not required to be submitted initially.
