Hello everybody. Please help me understand what could be the outcome of the following:

1. My husband is a US citizen. On May 19th it will be 2 years since the case was filed. My interview was on February 7th 2019, and it didn't go as well as expected. The main reason was that Maltese to English translation of the annotation in my divorce certificate was not certified (I translated it myself, and the officer said it was a conflict of interest) even though the rest of it was in English and even the annotation itself had English words Annulment/Divorce. So, we've been told we would get a letter with further instructions and have been waiting for it ever since. I keep getting text notifications that my case is still being reviewed. If it drags until or after May 19th 2019, could the case go into default or get closed, or what could happen? What should we do about it?

2. My work permit has naturally expired together with the extension and my timely filed renewal application has not been denied. I filed for it on July 27 2018. I called them, they said it was clearly out of normal processing time frame. They sent an I-request on March 28th and I am still waiting for the answer. I'm not sure whether or not I can work at this point, this article is not quite clear. - https://www.uscis.gov/i-9-central/42-automatic-extensions-employment-authorization-documents-eads-certain-circumstances - Could you please tell me if I can still work or not?

I do not know if you are in a category that gets the 180 days but sounds like if you were it has expired.

1. Your case processing has no correlation with May 19. 

2. If it has been more than 180 days your current EAD has expired, you can’t work. You have to wait for the new EAD

Hello,

 

Im sorry about your situation, since you havent received your renewal and it has been over 6 months in my understanding I dont think you can continue to work unfortunately.

But what you can do is to Call USCIS and request an expedite for your work permit based on severe financial loss. Because you are no longer able to work since your work permit is still not renewed due to slow processings but you still have financial obligations to face. Also after you request the expedite  get in touch with your local senator so that they can make a request on your behalf and get a push on your expedite.

Now about your interview you have to wait 120 days so you have to wait to until then. After that schedule an Infopass go to the office and see what happens. 

I hope you get approved soon.

10/30/2018: Went to Infopass, officer has not made a decision yet, an email was sent to him tell him I came to inquire

03/26/2019: Moved so updated our address online with USCIS

04/16/2019: I-130 petition approved

04/20/2019: approval notice received in the mail

04/22/2019: received notification of RFE for AOS I-485

06/01/2019: RFE finally received after being lost in the mail, asking for a new medical exam

06/06/2019: Response to RFE sent, received the next day 06/07/2019

06/17/2019: Received notification of another RFE, 3rd time will be the charm hopefully

06/22/2019: RFE received for new medical

07/02/2019: Went to doctor for new medical

07/11/2019: I-485 approved without new medical exam

07/18/2019: Green Card received in mail

Yes, there is no defined time for them to review a case. Hope you get your approval soon.

Hello, Thank you for the informative answer! Do you happen to know how long the expedite could take? I already called them about this on March 28th. Also, they don't hold infopass appointments in my field office :(

No sorry I dont know  how long expedite takes, it varies some people have a response in 2 weeks other in months its really like the lottery lol, here is a thread about expedite, you can also search on VJ and see how long it took for other people: 

For the Infopass it is actually for everybody now: you do not have the option to schedule it yourself like we used to online but you can call (call if possible very early at 8 AM Eastern time) and ask to speak to a Tier 2 officer and tell them you would like to schedule an Infopass about your case, but like I said before wait for 120 days after your interview to try to schedule it, because you need a really valid reason to be able to schedule one.

A little off-topic, but how dumb is this? It feels like they went backwards from having self-service online to having to use humans to do something so basic. This is just clogging up Tier 2 time and making it harder for people to schedule these appointments

It is to reduce the number of appointments.

I figured as much, that it was to 1) discourage people from scheduling them at all and 2) seeing if Tier 2 could help/answer questions before the appointment needed to be scheduled.

But it sounds like they didn't update the need for more Tier 2 officers to match the increase in demand. Also, for people who actually do need appointments, it's now a 2hr process of waiting on hold/talking to someone to convince them of the need to schedule an appointment and then going to that appointment. It's a lot of hassle.
