Khallaf got a reaction from Exanuage in Waiting time after DQ for the US embassy in Egypt
currently Egypt is about 5-7 months backlogged.

you can expect it to be at least that long to get an interview, those from May are still waiting, some even as far back as March.

    Good luck in your journey.

YOU need to check the facts.  She is not currently in the US.  If she enters now on a B visa, intending to adjust status, that is FRAUD.  I have asked for this thread to be closed due to your persistent TOS violations in planning for fraud.

She's not in the US, though. She would have to commit fraud by entering with intent to file for AOS first...wherein lies the problem.

    @OP
Just ignore that guy. He's posted all sorts of incorrect information in this thread and others previously.

Correct information has been provided by others. Once AOS is properly filed, one has a period of authorized stay granted by the AG. The overstay is not held against you for AOS purposes as the spouse of a USC. This is written in the INA, and indicated directly in the USCIS Policy Manual (https://www.uscis.gov/policy-manual/volume-7-part-b-chapter-3).

Most people AOS from VWP entry just fine. It's not an issue.

Does this apply if my mother is going to do the I-864? I know I still have the legal obligation to my ex which is binding in the previous I-864.
Pretty sure my ex husband had the 2 year and now has a 5 year green card. It is possible. Thank you!

I am going to be the third confused.

one moment you said you had a religious marriage, and then you said your wife told them you will be married soon.

soooo, being as you are a USC did you get married through the way and have it registered legally for the USA government?

IE: The traditional way? getting a religious marriage such as in Egypt is not binding for the US Embassy, so too married for a Fiancee visa but not married enough for a spouse visa, this could very well be your issue.

then USCIS wants all the papers as it relates to the case, you need to have him push a little harder at the court to get it, if you don't have it your looking at a denial of the petition.

does the petitioner have any kind of criminal background that would be cause for denial?

This has happened before where someone has disclosed a previous 'crime' or what ever you'd like to call it, then the court either drops charges or it's 'sealed', but USCIS still wants proof but the court has no records allegedly. If this were the case you could try searching top right hand side of the screen in the search bar for topics relating to that and see what others have done.

But, as others said, until you get the letter you won't actually know what it is all about.

again as others have said that isn't how it works, you have to wait in line like everyone else.

NVC will send you the interview letter and from there you would use that to get the medical done.

now you are welcome to send NVC a letter and ask for an expedite but must have good reason for this.
jumping ahead of the line simply because you want to, just isn't how it works

    sorry

we could all tell you what you want to hear, but then you will get mad when it doesn't happen.

fair to say you could have likely made a costly mistake in booking tickets when you don't have the visa in hand.

and you havn't even had the interview to say APPROVED.

not sure why people seem to believe that immigration is a cut and dry, that you no matter what will be approved, when stranger things have happened.

I would hold off on the one who is not moving.  You have a year to interact with thr NVC. Continue normally with the one child's and slow down the other one's until closer to moving time.

    1. you do not need to start a new application
    2. you can continue just get a joint/co sponsor
    3. once you have the information on joint./co sponsor upload it to ceac and contact the embassy, they should have given you instructions on what to do
4.being a public charge has nothing to do with the amount of time you wife has been there.

just get a joint/co sponsor upload the documents and sent email to embassy attaching the documents as well.

Khallaf got a reaction from Danny1991 in Is it ok when interviewing in other country?
if you have an approved I-130 you only need to get the papers that NVC would be sending out to the embassy listed on the USCIS papers to the embassy where you are now at

so you can interview in Frankfurt I have heard it can take up to 6 months to get it moved but it could be less.
