As one of those "lazy government employees" you referred to, I can assure you we are not sitting around doing nothing on our cell phones.

The vast majority of the federal workforce continues working from home or alternate work sites.  Consulate officers still have plenty of work without conducting visa interviews.

It isn't laziness that delays your packet 3.  The consulate is deliberately slowing your progress.  They have to reschedule hundreds of cancelled interviews before you continue through the process.

Sorry you are having issues finding the foods you are accustomed to eating.  Given the rising beef prices in the United States and Vietnam, I am sure many families in Vietnam and the United States would have difficulty empathizing with your struggle eating beef, chicken, eggs, noodles, and rice every day.  Vietnam is one of the greatest foodie/seafood destinations in the world.  Definitely reconsider where you are shopping if you are having so many issues with food quality.

Bread made with rice flour - like the traditional Vietnamese baguettes -  are gluten free.  Ask if it's rice or a rice/wheat mix.

Vietnam is not a third-world country.  It is usually referred to as "third world" (or "hellish") by people trying to insult the country and/or its people.

Leadership's decision to close embassies will have long-lasting impacts on immigration. The entire immigration process is a long and frustrating ride.  Patience is even more necessary now than ever before.  Best of luck to you and your fiance.

AFAIK... Visa validity is tied to medical... If you do it too early your visa will be shorter or worst case scenario you will have to redo it again.
it's from a post by @Greenbaum. Before I shared it with you I went through it and it specifically said do not schedule interviews until the embassy sends you the P3.
I would advise you you it for informative purpose only and gather the necessary documents you need for the process in advance.
Your process will be significantly faster if you respond to P3 24hrs after the embassy sends it to you... That will only be possible if you already know what they will ask for.

Can I share somethings with you that I learned long ago about this process?

        • "the man with the gold makes the rules"
        • it will take as long as it will take
        • no one with any certainty can tell you when some process will be completed
        • Your sense of urgency will never be equaled to what USCIS, NVC or your embassy demonstrates
        • Your journey is not going to mirror someone else's experience - yours and theirs are not the same
        • They only promised you a YES or NO answer. Never an exact time that their decision would be completed
        • Lowering your expectations will make you a much more relaxed individual

    Good luck on your journey

No one is being negative with the OP. What they are being is honest. He faces a practically impossible uphill climb.  People are not judging him or their relationship, they are telling him the truth.

Perhaps as you say love does not see age, or religion or any of that, but I guarantee you Immigration does. I can also assure you wholeheartedly that god does not hand out Visa's.

The OP hasn't even met this woman, in some States she would be considered a senior citizen. People can certainly be different when you actually meet them, face to face, and not on a computer screen.

I see cases like this all the time on fb pages, it never ends pretty. All the old women wonder why they can’t have their boy with them. It’s disturbing sometimes to see these old men and women marrying someone that is 20 years plus younger. I’m sure In your case your mom must be the same age as her ?? And her kids possibly the same age as you ? Think about it from a CO point of view. Met online , she comes and you marry on first visit, she comes back and petitions. No way will they think it’s real. If this really is love she will move there and spend a lot of time there. Maybe even 2 years and then marry and file. I am only 8 years older than my fiancé and nervous for a k1. In UAE but Pakistani born. I’m divorced with 5 kids but we want one quickly as soon as he’s here. And I can still have babies. I’ve made 12 trips to Dubai since feb 2017 and we just got our NOA2. We spent a lot of time together. And in February he’s taking me home to Pakistan to meet all his family. Video calls don’t cut it. This will all be before the interview but still, I’m nervous. I’m blessed his family accepts me. You have a huge uphill battle like everyone says

    Hi all,

This has been an eventful year!  For people just starting their journey, from the time of application of my wife for a K1 visa from Vietnam to approval of green card took almost exactly 1 year, which was much much faster then I had been expecting or hoping for.  We submitted the I-129 on 2 Jan.  She received her K1 visa in hand on 17 JUN 19 and traveled to the US on 18 JUN 19.  We submitted I-485 for adjustment of status, and also the paperwork for her Employment Authorization (to work while waiting for green card) and Advance Parole (to travel while waiting for green card) around 7 August 19.  EAD and Advance Parole was approved and she received her EAD card in hand around 10 December.  Her interview for her green card was on 19 DEC 19 and she was approved.  Should receive the actual card in 3 weeks.

If you look on the USCIS website, their estimated processing times are much longer then this.  My experience has been (and from what I've seen from others) is that if your case has no RFEs or potential flags, it moves through the pipeline pretty quickly.

One thing I should note is that you should definitely get the vaccinations done with the medical exam in Vietnam.  The vaccinations are required for the I-485 for the green card even though its only optional for the K1 visa.

It works both ways.  If a person takes a new job, enrollment is automatically open with that company as being a new hire is a “qualifying event” for the coverage offered at that company.  It has nothing to do with the marketplace.

Once enrolled and covered under the employer insurance, the marketplace insurance can be cancelled.

Regarding the evidence I included :
-Statements for each month ( joint bank account, utilities bills, cable...)
    -State & Federal Tax transcripts
    -Lease
-Photos with descriptions but printed and not a real photo like the one you get from a photographer . If the photos were from a trip I attached the tickets/boarding. I also sent photos of us from posts on facebook.
    -Joint health insurance
    - joint ownership of a car ( Title ).
There are also more things you can include....
My file was ridiculously thick and heavy  but very organized and really easy to navigate through because I had a cover letter with Exhibits style.  If you're organized and willing to do a lot of research and read a lot of reviews here you'll have no problems... Good Luck!

For someone who is apparently so knowledgeable about the inner workings of the federal government, it’s super weird you didn’t realize that getting your SSN and your (STATE’S) driver’s licenses are completely separate process and not what you should base immigration matters on AT ALL. I feel like that’s basic common sense.

Also, I’m a federal worker and I can promise you that your entitled attitude means your complaints are getting filed directly into my non-urgent pile, letter from Lady Trump be damned.

you're unaware that the first lady has staff that handles the same stuff that the Prez is asked to fix? He gets 100's of thousands of request per day. She get a hundred, but when her staff calls some fed employee, it's STILL "the white house calling". and if you dont want to be working in Alaska and it's your fault, best fix it. One of her clerks tells her, "Mrs trump, so and so is ignoring me", and Melania says, "Donald, I have a problem".  you think that any fed employee wants to risk that? I got action really well with a letter to Barbara Bush and believe me, the Fed did NOT want to do what I was asking. 🙂

As said, it’s the quality not the quantity that matters, i’d include statements from every few other months only.

    Not required.

Yes your son will file i751 separately and is a formality as it’s based on her parent’s marriage with you.

Just for clarification, Part 5 is asking for the children of your wife which may include your children too as stepchildren if you have any. All of her children shall be listed while selecting “Yes” to the only kids applying with her thru the same form.

Again, that is asking for children of your stepson not yours which i believe will be None at the time of filing.

I’d think its the same evidence as it’s based on the bonafide marital relationship of the parents. Some others my chime in.

The son will gain citizenship through his mother only when he becomes the LPR which is when his ROC is approved.

Note: The petitioner for i751 is NOT you but the one who is filing for ROC, so fill the last few sections accordingly.
  24. Thanks
JasonGG reacted to Sukie in Questions regarding ROC Application
Jason, I can only address the first half of your letter...Your ROC submission should stress QUALITY not QUANTITY.  When you print out every page of every bank statement, it is going to be a lot of pages.  If you have a lot of co-mingling financial data, you might just send one statement per quarter (which is what we did).  You list a lot of great evidence in your first paragraphs.

You do not need phone logs, text messages, chats this time around.  Those things can be important for ROC if, for some (good) reason, you have lived apart during the two years - but that does not seem to be the case in your life.

Your documents should easily tell your story of living together, paying bills from the same accounts (if this is the way you handle your finances), and of thinking about the future together (such as being each other's beneficiary).  Submit documents that paint this type of picture, and you will be fine.

I will have to let someone else talk about dependents, as we did not have any during our process.

    Good luck!
