    I don’t know how to comment on this. I don’t want to throw any negativity your way but it leaves a sour taste in my mouth whereas me and my wife have been patiently waiting in line. It’s disheartening when people jump the line and expect the system to facilitate it. 
     
    I don’t know you, and I’m sure you’ve gone through a lot too, but if everyone did what you do, we’d be in a mess.
     
    Whos the daft one though. You that have your family together or me whose 3.981 miles away from my wife and have been for going on for five years now of long distance.

    A "traditional polygamous situation"?  Us law allows only one spouse.......thus, there could be no adjustment of status for a "second spouse"....

    That's if he ever gets to the US in the first place which seems unlikely at this point since it doesn't seem like him nor his wife is really interested in doing anything to obtain domicile.  
     
    OP, members who have advised you wisely on how to obtain domicile; they even broke it down nicely for you.  It's a take it or leave it kind of thing.  If you take what others have advised of how your wife will need to obtain domicile, you will be fine.  If not, you will not be coming here.  It's pretty simple really.

    At the same time, if somebody can do that while abroad, how exactly does that show domicile or intent for domicile?

    Very true.  When my husband was getting his security clearance, they even asked about his nickname that wasn't mentioned.  They found every little detail about his life and questioned even minor things that appeared even remotely like a red flag.  They dig deep.

    Once hubby gets to a point where he need a security clearance he will be required to truthfully answer question about his immediate relatives and their addresses.  So he will have to out her.   And he will most likely be asked about what sort of aid he has provided for her. Depending on the level he needs it will get nasty and he could be denied the clearance and thus the position.

    ? That's news to me...I'm pretty sure they have access to the same case information.
    It's certainly possible a specific lawyer may know an IO, supervisor, or anybody else in the chain....but it would be illegal for them to provide any services related to that.

    Nobody said or implied it's your fault for the extended AP. Nor any issues with the personal personal reasons for wanting the delay.
    The part that was your own fault was most of the wait outside of USCIS and NVC processing + AP. The claimed 5 year wait was really only a minority portion due to others.
    I understand the difficulty with such a long wait. I understand that the wait right now is not your fault.

    Maybe it involved some stuff magically happening?
     
    Source? I'd love to know how security checks only take a few days if they want them done...it would help a lot of people waiting.
    As others noted, if the case was basically set aside then a WoM can light a fire under them to find it and make a decision. That does happen and is a real possibility.
    If it really is waiting on results from another agency (US-based or not), then it will take as long as it takes. They aren't beholden to the DOS and don't care about a WoM filed with them.

    I keep seeing you demand proof/links from people disagreeing with you, but have not seen you provide the same to your benefit.

    I have also seen everyone advising WoM as an option, HOWEVER may result in a denial, only state that it COULD be a denial. Not a definitive denial. I think it's safe to say it is possible one would get denied, based on the argument of security checks. Those can only be expedited so much. No one here knows what is causing the hold up on this particular case, or at what stage the hang up has occurred and remained idle at (i.e., has sufficient background check already been completed).
     
     
    The "impact" is the possibility that rushing the decision may result in a negative decision. Again - you keep citing '99%' of cases - where is this documented? Please share examples. I'm sure such examples would alleviate the OP's concerns, if any, with taking this route, as others'.
     

    Multiple people have stated, again and again, that the concern with taking this route is that forcing the embassy to make a decision before a conclusive background check has been completed, as REQUIRED, will result in a denial. They will not approve a case that has not been properly security checked. Can we say that is the case with the OP? Of course not. Neither can you. Hence, why it's continuously referred to as a risky CHANCE. As in, POSSIBILITY. And a pretty big possibility, in my opinion.

    At the end of the day - viable options have been given for the OP. INCLUDING possible outcomes, which as in most cases can vary depending on the situation. At the end of the day, it will be at the OP's discretion as to whether or not taking escalation options, such as WoM, will be worth it in their case.
    It's not anyone's business here as to why your initial extensions were requested. Lord knows I'm sure everyone here should/could have made different decisions along their respective immigration path. Everyone makes their decisions at the time as they see best for that particular time/situation. Best of luck to you and your family.

    Ron, You have made several comments on this thread that would lead one to believe you must have some special knowledge or experience with WoM
    Perhaps you could share the source of your special knowledge or share your personal experience so that we might all be better informed

    You are thinking of a writ of mandamus. In this situation it’s likely to get the visa denied. Federal law prohibits a visa from being issued until all security checks have been completed. A writ of mandamus forces them to make a decision (it DOESN’T force the case to be approved or to speed up the background checks). If the security checks are not complete and a decision is forced by writ of mandamus then the only outcome will be a denial. There is absolutely no way to speed up the AP stage.

    and this is the very reason I would like to see laws changed to stop this kind of abuse of the visa process.......this action makes it difficult for legitimate visitors to get visas to see their families.....

    The consular officers and the CBP agents are the "gatekeepers" to the U.S.
    Run afoul of either, and your further battles are steeply uphill and almost certainly a losing cause.
    CBP can refuse entry to a K-1 recipient for any reason that the consulate would refuse a visa.
    In my extensive experience at least, CBP agents are typically in foul moods and are looking to nail someone.
     
    Perhaps the most consistent situation reported on this website over the years is "We had a party in my country, and now we're too married for the K-1 but not married enough for the CR-1!"  The only solution is to spend more years and more thousands of dollars trying to ameliorate the naive (at best) and perilous (in reality) decision to hold a pre-entry party.
     
    The one poster in this thread who has been blithely endorsing irresponsible, perilous behavior is strongly advised to knock it off, in this thread and permanently.  This forum is meant to guide people through this broken, infernal immigration process with as little damage as possible.

    Okay in all seriousness, what would you think is in the envelope? It's your immigration documentation. The reason it's sealed is to prevent people from changing their documents.

    I feel sorry for you but for what you say it seems that he got used to the good life of getting his living expenses taken care of by a nice (wealthy?) american lady. It was your decision to give this person money so don't feel surprised is you never see the $ back.
    This may sound harsh but this is the kind of things it happens when you start bankrolling someone in a relationship (long distance or not). You may end up with someone that will take advantage of your generosity and love you for the wrong reason.
     
    When my now husband and I were engaged, he lost his job and and called me desperately at work to ask me if I could loan him some money (it was about $300). He needed to pay some bills and of course I loaned him the money he needed. He did pay me back a few months later when he was in better shape and sent me flowers also to give me thanks. He as a proud man he is, he felt so terrible to ask for money. That was the only time during our long distance relationship that he asked me for that kind of help. And I never asked him to pay me for anything (debts or bills). 
    When you are in a relationship it should be 50/50. You help me, I help you and we help each other. That is how I see it.  BUT when you start feeling that you do most of the work and you pay ALL of his stuffs and he is not willing to cooperate with your/his debts, then it's time to consider the possibility that you found an scammer. One with a big family, children and God knows what else left in his home country and that is why he send all his money there.
    Is he using you? No one here can know 100% but it does give that vibe. If you feel he is using you then do not proceed with AOS and you will see how much love or cash he wants to share with you. I hope you can solve this situation for your own good.

    An infant who needs specialized care after birth could run up a bill in the MILLIONS. I just spent 5 days in the hospital of which only 2 were in the ICU and the bill is upwards of $50K and all bills are not in yet.  Imagine  the bill for a baby with a 2 or 3 MONTH stay in the NICU. Your claim that you can afford it is absurd.
     
    Why would any physician want to take on a patient late in her pregnancy?  Does your wife plan to try to cross the border for routine medial care during her entire pregnancy?  Is she willing to take whatever doctor will see her or are you going to claim that a physician of your ethnicity will give her priority treatment and deny an American care because of her?
     
    You admit you don't want to be Canadians. Why did you deprive others of that privilege? Canada deserves to admit people who intend to be loyal Canadians and not just be using it to go to the US.
     
    During your time on H-1B, did you bother to obtain professional licensure?  Be careful about claiming to be an engineer. Be very careful about your US employers.
     
    Americans are getting disgusted with CHAIN MIGRATION especially of parents of babies born of birth tourism. Your child may not be able to sponsor you when (s)he turns 21.

    People are interested in giving birth in the US because they want their child to be US citizen - they also often think that giving birth in the US give parents some magical US legal residency or rights. Which it doesn't.
     
    Also there is no "I want anchor baby" type of visa. You just apply for B2 visa, tell officer at POE your plans and hope for the best.
     
    IMO the whole thing allowing babies of foreign parents to automatically become US citizens is ridiculous.

    I live in Fairfax County, Virginia. It is not cheap. Not to mention the cost of birth is expensive too. 
     
    Sorry, but this kind of thing grinds my gears a bit since most of the time tax payers do end up paying ultimately, but people will do what people want to do. 
     
    Anyway, if the friend wants to come here to give birth and has the means to, she can, but as other members stated, she needs to provide proof of ties to her home country, have enough $$ to show, and it's 21 years before parent has any kind of eligibility for US status.
