LPR Mother applying for out-of-status adult, single Son.

Hey there community! My journey started in 2006 when my son, daughter and I migrated to the US with a tourist visa. looking for a better future. Long story short story. Along the way my daughter became USC. And she was able to apply for me. Her Mother and I became LPR. back in 2015 applied for my adult

, single son the i-130 In which it was approved 4 months later. Now 5 years later his Priority date became available. Due to his currently lack o status. I was advised that I’ll have to file a waiver for him. I-601 for the extreme hardship. And he will have to go for  A consular interview in our home country. He has been here for a along time. now he’s afraid of not coming back after leaving the U.S for the interview. He was a minor when I migrated here. So he barely speaks his native language. 
 

looking for a word o encouragement 

and similar cases.

I don’t know how to comment on this. I don’t want to throw any negativity your way but it leaves a sour taste in my mouth whereas me and my wife have been patiently waiting in line. It’s disheartening

It leaves a sour taste in the mouth of many, trust me. Even people who are generally very pro-immigrant can see the need for certain immigration reforms to prevent incentives like this.

What type of encouragement are you hoping for? Given the way you arrived everything has turned out as best you could possibly hope for rather than you all remaining undocumented. You are lucky that you found a way to all become legal. Your son has no option but to go back for CP.

I agree you seemed to have worked the system very well, I do not see how it could have been done better.

 

Encourage him to work on his language skills?

I don't believe there is any way around consular processing for your son.

Thanks for the support. I was just wondering how the consulate process works and chances of him getting approved. I haven’t cross a similar case. Neither the lawyers I talk to.

He goes to the interview, presumably has a ban, file the waiver, the I 601 when it is approved goes back and gets his immigrant visa and enters the US.

 

If the Lawyers you talk to are not familiar with the process I would get one who is, not exactly uncommon.

Visa is never guaranteed. That’s always a possibility, one has to be prepared for that.

2015-06-16: I-130 Sent

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

And second what boiler said about a new lawyer. The waiver is common, but it’s not guaranteed. You want a lawyer who knows what they’re doing.
