Trying to get my GF at least her visa

Hi, my name is Daniel

 

At the moment my girlfriend, Victoria had overstayed her visa and we have only been together for a 1 year however we have no legal documents to show we are married if were to and I don’t know how serious the government is about fraud marriages but I also want her to be able to live here and wait to actually get married and make a home but we have no money to do so. I am seeking advice to what I can do any advice I will truly be grateful for. Thank you

 

Victoria is studying English in a community college school, working in software testing, 32 (where as I am 19, in community college, and in construction), arrived with a tourist visa, and has not committed any crimes here nor in Colombia, and has college education in her country as an accountant.

So you are 19

And your partner is 32 and she entered the US on a student visa but stopped going to school AND is working in the US without authorization? 
Do you want to get married now or eventually in the future? 
Or do you think you should get married so she will receive a green card?

Hi thanks for responding, yes she got a student visa, however she is currently still taking classes and is working without current authorization

 

and honestly I do hope to be married to her in the future but this is years from now as we are still building our lives. But i want her to get her green card as soon as possible so she can visit her family in Colombia

If she is still studying and she has a current I120 she should be able to go home to see her family. 
Why can she not go see her family? 
Or did she only get an F1 stamp for 1 year and it is now expired? 
ETA oh she came to the US on a tourist visa and changed to a student visa? How long has she lived in the US?

Suggest that she join the discussion group her self. As a single person, her status in the US and her ability to travel home and re-enter  USA is her responsibility not yours.

There's a lot of contradictory information here. What visa did she last use to enter the US? And has she overstayed her current visa or not?

 

Regardless, I don't see a way for her to get a green card unless you marry her. She'll have to return to Colombia, either now or at the end of her studies, depending on the conditions of her visa.

She will not quickly get a green card.  If the "marriage" is for the purpose of getting the green card, USCIS will figure it out.  Especially with an age difference like that. Sorry, but no  32 year old woman is legitimately with a 19 year old guy.

If she's studying, she has a valid F-1 visa that she can use to get in and out to the country. You're being deceived.

Exactly why you are being used for a GC. She's preying on your naivety. I don't see *you* in that statement but *her wanting to live in US.*

 

Did she tell the IO this at her interview?

 

Your young, barely started living/ having responsibilities in life. Take it easy. 

 

P.S: you started dating when you were 18?? That's suspicious.

So, she is out of status and working illegally.  She is in danger of removal....and a 10 year ban if more than a year out of status.  She has a very, very limited path to a Green Card.

Are you an American citizen? You haven’t told us your status yet? 
If you are not interested in getting married now there is nothing you can do for her. There is no visa you can give her to help her leave the US for vacations and then return and continue to work and study. 
If you are considering marriage in the future though, make sure you know EVERYTHING and I mean EVERYTHING about your girlfriend’s life here and back home. You need to know what visa she came on, how long she has been here, any previous relationships she might have had with Americans or other people here in the US. You are worried about fraud- your inability to explain your girlfriend’s current situation and visa status is concerning and if you were separated at a green card  interview, I don’t see you being successful.

 

Good luck! And I strongly suggest you are honest with your girlfriend about the timeline for marriage. She might decide it is better to break up if she is wants to go home… and depending on her current status she might not be able to return for 10 years.

There are many red flags in your situation.  Your GF's adjustment of status case will be highly scrutinized. 

 

You mentioned that you want to eventually get married...what is her desire?  Does she want to same or want to stay GF/BF?  

 

If you are in love and she is the "one", and she feels the same, then get married and seek immigration.  If you are both just considering it (marriage, long term relationship, etc), then immigration is not something you should f-around with.

As others have stated, she should be the one posting here for advice.  You bring no benefit to the situation if you are not married to her, and you say marriage will happen many years from now.)  If that is the case, she has very little changes of getting a green card anytime soon.
