IR-1 IMMIGRANT VISA REFUSED- 221G handed - CO asking for Proof of Domicile

Hi guys, i have my interview today at the Abu Dhabi, the CO handed me the blue slip, with the cross marked on Proof of Domicile, no AP was crossed.
little background: My spouse the petitioner, came to Pakistan in 2020, and we got married in 2021, since then she did not go back to US, 

i think that is the reason the CO told me, to provide a written explanation of your spouse's plans to reestablish domicile in US. like staying there where will she stay, even though she co-owns the house with her brother.

May i ask what Proof/evidence i should provide? and do i need to upload this evidence, in CEAC portal? 

After i submit the 500 words letter, as mentioned on the link given on the blue slip, + uploading evidence, how much time do they take to respond in UAE?

Well it's pretty easy - either she gets on the plane and you then provide proof she's in the US like an ATM receipt, purchase of something, medical appointment, voter card, or she shows evidence that's she's already looking for a job in the US (has an interview lined up for a certain date), has packed out and given notice at her current residence, has gotten quotes from movers to move what she's accumulated to the US...

wells, getting on a plane is not possible, we will go together, 
however, she co-owns a house, has paid taxes on that house, has a homestead Exemption on that house,
she is also using her bank account in USA to pay bills etc,

also mentioned in my draft letter is the reason why she could not travel for 2 years, that is because of back to back pregnancies, proof is in the form of birth certificates of the children. 

The question is is this evidence enough? what more should i add to bolster my statement.

also attached is the affidevit from the co-owner of the house (her brother) that he lives there, and has ample space for us, since its a 4 bedroom house.

Actually, that is not proof of intent to re-locate.  Concentrate on actions showing real intent and concrete actions toward actually moving to the US as @milimelo explained.  Good luck on your move.

Proof is not a "say so" like a letter

the CO wants actual proof

copy of the deed to the house if u plan to live there

copy of bank record to show when she opened account and she still uses it to deposit money and pay US bills

copy of current state driving license

waiting to travel with you is not important to CO

you will both have a long wait even after supplying embassy with what they want./ the CO should have said what they will acceptan BUT u being from Pakistan will go thru additional long security checks (read post from other Pakistan members by going to that portal)

Lovestoteach is still waiting for her husband to be approved .  He also interviewed in another country not his own Pakiistan

That may not be possible if you can't prove that she intends to re-establish domicile. It sounds like you do not have very strong evidence for this. The strongest evidence would be if she actually moved back to the US ahead of you.

At the NVC stage, did they not flag this? The reason I ask is because I am a USC spouse living with my spouse in their home country while we await for the immigrant visa. I got a case FE note about me maybe not having a US domicile and we had to submit all the evidence you are now planning to accumulate. I just wonder why the NVC didn't give you a heads up like me. I provided bank statements that show I was gradually transferring money to my US accounts. That I have entered into a lease agreement with my mom. Emailed schools for my child's enrollment in school.

I don't really think that's relevant. She needs to focus on her future plans to return to the US and provide evidence for that. It sounds like the embassy is very skeptical that she actually plans to move back permanently. 

 

Did she show any evidence at all of abandoning her residence abroad?

Our 2nd child was born on 1st Dec in Pakistan, do you think that can be the reason?

Exactly? They did not have an issue when we submitted the documents at the nvc stage, at the time of filing back in 2021, we clearly mentioned that petitioner and applicant both are together living in Pakistan.

 

They had no issue at that time, I will update my case here, as I go along

You seem to be in the business of finding excuses and explanations why things should be the way you want. Unfortunately immigration doesn’t work that way.

 

Your wife can provide proof of domicile, e.g getting on a plane and returning to the USA 🇺🇸 and providing documents, otherwise if as you say “getting on a plane is not possible, we will go together”, then go ahead and issue yourself since it appears you have that authority and go together.

Your spouse can take the children to the US. She is going to live with her brother so she will have some support.  She can do like others suggested. She can also file her taxes, update documents. Show bills that comes to the house that she pays supported by the bank statements. Show paid taxes on the house.

However, since I have uploaded everything required at ceac portal ,and also emailed the NVC enquiry forum, ( as mentioned in the 221g paper), do I need to wait for their response before I send my passport? Or should I send my passport anyway?

 

What should be my line of action?

She should relocate to the US. Then you submit evidence of her arrival and domicile , get your visa and go.
