Effects of police report on pending AOS application (merged)

Greetings, 

 

What effects does a police report have on a pending AOS application? I need to file a report against my wife for violence in the home in front of our children. 

 

She has an explosive temper and resorts to throwing objects and destroying things when she gets upset. She's done this on multiple occasions now in front of our two children. One is hers from a previous relationship and the other is our 4 month old child.   

 

Both my wife and her son are pending AOS which we filed last year.  

 

I don't want to press charges, but I need to get this stuff reported so there is a record. 

 

Could a report with the police cause any issues with the AOS.?

If USCIS learns of it, it could:

 

* deny the case

 

* hold it for resolution

Pressing charges is not a thing in America. Only a prosecutor presses charges.

Yes if USCIS learns of it.

 

If the report is made before her I-485 interview and she fails to disclose, this would be a material misrepresentation and she could be subject to a permanent ban.

You report it to the police so they can press charges if appropriate otherwise maybe something for Child Services.

 

I am going to assume you need a lawyer

people that have issues such as u describe also take the anger out on children and house pets

you need to report each time to protect not only u but the kids(or a neighbor or teacher will ) 

 

I would see a lawyer /get her into anger management 

but keep a notebook of each temper tantrum  and take photos of things she destroys 

 

best to protect yourself or this will  come back to bite u

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

Look at the choice of username. Same pattern as the other. That's what I said.

Immigration journey is not: fast, for the faint at heart, easy, cheap, for the impatient nor right away. If more than 50% of this applies to you, best get off the bus.

@Thesearethedays why are you even filing / continuing with violent wife's AOS?

 

Withdraw your support for her AOS, divorce and move on. If you press charges, and depending on history of violence, you may get full custody over the children if that's what you would like to do. That's outside of immigration though.

You forgot same city/state… and timeline for k1 for this account seems very suspect….filed k1 in 2021 and received visa EARLY 2022? Incredible…

Create a record by assembling the photos of past damage and call a “family intervention “ meeting with someone you trust .( be it therapist, priest, relative or friend) and Talk Openly about the violent outbursts.

 

Put your wife on notice that you will call 911 if it happens again…,and if she hurls a plate at your head, they will arrest her for domestic violence.

 

They will not make a police report  for past incidents.. without an arrest there will not be any impact on AOS…as USCIS won’t know.

Sometimes people need more or different kind of help …not much gets through I-told-you-so approach.

 

I am knee deep in the Letecia Stauch trial and my instinct is to tell OP….list your Red Flags , trust your instincts and if you have that unsettling feeling that you don’t really know/trust  your wife ….RUN!,,,
