I sent a letter to cancel my visa, as my fiancé and I broke up.  It ended up being a HUGE misunderstanding by her daughter.  I just wanted to know has any of you sent another letter in to "un-cancel?"  I don't want to go through the process all over again.  So far nothing has been cancelled yet.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).

You cannot cancel a withdrawal. It is final and you will have to start over. We see this topic here very frequently.

 

Also, just because it is not reflected on USCIS/NVC/consulate case status page and the process continues (e.g. you get a NOA2) does not mean it didn’t go through. it will come back to haunt you down the line in the immigration process as it has happened to someone here:

best take a moment and either refile I-129 F or consider marrying and I-130. In new filing you need to address the misunderstanding/ reconciliation followed by a loud-ish ..” it has brought us closer than ever and made our relationship stronger.” 

Will do.  I'll plan on doing a marriage visa this time.  Might actually work out better.

This might be blessing in disguise that this happened. Spousal visa is a much better option and I’m saying this as a former K1 beneficiary

I would apply for a spouse visa, it is a vastly superior option. Reminder for next time to let things cool down and talk about it before making rash decisions. Immigration is no joke and this could come back and hurt your case in the future. I'd get a lawyer at some point, good luck.

Just an update (I am being respectful here and keep in mind, I have listened to all of feedback given and not argued with anyone here.  My goal is just to help someone, who might be in a similar situation)

 

The visa was in fact cancelled.  I called and also wrote a letter, right away and they reconsidered, thus reinstating the k1 visa.  In the letter, I provided more pictures and a recent ticket showing that I am going on vacation with my fiancé, in Germany.  It then was approved recently.

 

Again, I FULLY accepted the responsibility that canceling the visa would have caused.  This update is only to possibly help someone who might be in a similar situation, BUT, I suggest not canceling the visa in the first place.....I get it.  (Her daughter has BPD for anyone who knows what that is and if you don't I hope you never find out)

That is great news . Hopefully you stay , post and be that hope for others…

Be sure to mail the letter in as quick as possible.  I mailed it to the California USCIS and also sent a copy of a plane ticket, showing I was again going to meet my fiancé.  I also included more recent pictures of us together.
