Lifting conditions - Sponsor not wanting to go through with signing any further documentation

Hello All,

 

I am trying to find out what to do if I feel like now my husband may have come here under false pretenses.  He and I have not been doing well and I am not wanting to go through with lifting the conditions for his green card.  Can I get removed as being his sponsor? Does he still need me to go through with lifting the provisions?  He is trying to go through with it but can he do that and I be removed?  Very emotional times so please be nice.

1.  He doesn't need you to complete his removal of conditions.  He can do it on his own with a divorce waiver.

2.  You cannot be removed as his sponsor until he has attained citizenship, gained 40 quarters of work credit, lost his status and departed the US, or has died.

3.  If you have solid evidence of fraud, you can report it to USCIS.  But remember that you have already provided a LOT of evidence that the relationship is bona fide.

 

 

i honestly have a child with this man and we just do not get along. I do not want to ruin his life but do not want to be his sponsor because he is very irresponsible. This is so difficult.

1. You are still hooked in terms of i864 commitments that you signed. No more sponsorship required for i751 though.

2. He cannot lift conditions on his own if you two remain married or even remain separated.

3. He can lift conditions on his own if divorced.

2015-08-17: I-130 approved

2015-09-23: NVC received file

2015-10-05: NVC assigned Case number, Invoice ID & Beneficiary ID

2016-06-30: DS-261 completed, AOS Fee Paid, WL received

2016-07-05: Received IV invoice, IV Fee Paid

2016-07-06: DS-260 Submitted

2016-07-07: AOS and IV Package mailed

2016-07-08: NVC Scan

2016-08-08: Case Complete

2017-06-30: Interview, approved

2017-07-04: Visa in hand

2017-08-01: Entry to US

The I-864 is a binding legal document.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

So therefore I am stuck with being his sponsor for the next 10 years unless he decides to change it.  He has every right now but I have no rights in this as an american citizen.

That is correct, but as @Lucky Catpointed out, there are other outs, not just the 40 quarters of work.

You signed the document. Therefore you accepted the terms and conditions... If he becomes a citizen then I presume it'll be less than 10 years. it would be best for you if he becomes one sooner rather than later.

If  you divorce, he then can  procede with ROC himself.. but he will be questioned regarding the validity of the marraige as bonafide. If you do not divorce, he cannot proceed with ROC without you

I wouldn't worry about it. The govt won't come after you telling to feed him or to give him money or recuperate money if  he uses any benefits. It can but it won't.

 

You worry about divorce terms if you are heading there.
