I Messed up - Conditional Green Card Expired

Hello,

 

I got my conditional green card in 2018 and was not aware of the 90 day application before expiration period until today. We had a baby in mid 2019 and COVID happened, it just skipped my mind to check status of my green card, until today.

 

Now I am 7 months past the expiration date and online the details are limited. USCIS even talks about removal from the country(scary part). However it does mention that you can still file for the form but with a letter explaining why there was a delay? 

 

Has anybody gone through this process? What are my options? Should I hire an attorney? 

 

What should I do?

What should I do?

Gather as much as evidences, then send a I-751 together with a letter explain the situation(COVID-19, new child). With your situation, I'm recommend send the package with next day deliver + tracking number .

They're likely to accept the application and send you the extension letter. You're not the only one that this has happened to but the GC's expiration date was right there.

Thank you Liam2021 and mushroomspore for the quick reply. I know I messed up, never needed green card for anything as I had my DL. So it was out of sight-out of mind. 

 

Do you happen to have a link to or a sample explanation letter, so I can get an idea of what the format should look like?

 

Also have you seen cases where folks get deported for this? Just trying to keep my sanity in check.

The format is not important, just make sure the cover letter explains things clearly.

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Depends on the state. I had a 10yr license in SC and OR, with the conditional GC. Other states use the date on the ID you show them as the expiration. Just depends. 

2015-11-23: Last TN received at CBP

2017-06-12: Married

2018-06-25: Mailed I-485, I-864, I-130/I-130A, and I-765 to USCIS

2018-07-24: Biometrics appointment

2018-08-28: Expedite request submitted for EAD via USCIS support line

2018-09-21: EAD and SSN received in the mail

2018-10-31: Interview is scheduled

2018-11-21: Last TN expired

2018-12-11: AOS Interview - Card is being produced

2018-12-18: Green Card received

2020-09-23: Mailed I-751 to USCIS

2020-10-03: 18-month extension NOA 

2020-10-15: Biometrics from AOS applied to ROC

2020-12-11: Conditional green card expired 

2021-05-17: Card is being produced

2021-05-24: Green Card received

2022-05-04: Interview is scheduled

2022-06-13: N-400 Interview

Thanks guys, almost done with the docs, getting my taxes and affidavit together tomorrow. Regarding DL, mine expires 2028. 

 

For proof, I got the below :

 

- Birth certificate for our baby.

-Latest apartment Lease

-Car ownership docs

-Photos

-Utility Bill.

 

Working on the cover letter/explanation for delay in filing.

What about joint bank account statements and leases from prior years? They want evidence from the beginning of the marriage. If you can't get the other evidence fast enough, don't worry though, just send what you have. Mailing it ASAP is more important.

Insurances, it is not the right time to blame anything. File it ASAP .

05/05/2015: Oath letter was sent

05/22/2015: Oath Ceremony

I guess it depends on the state. Not sure if it has anything to do with the real id? Mine also won't expire on the date when my GC will.
