Hi everyone,

I'm looking for some help. I came to the US on the 11th July 2019 and married on the 19th July 2019, we filed AOS Aug 21st 2019. I had a biometric appointment in September and since had no updates until this week. We got denied based on not including the I-864. 

I'm basically asking what should we do now? I know we can't appeal and know it was our mistake but we know of a couple of cases who have had a RFE for missing evidence, we didn't even get that, just a straight up denial. 

 

Any help during this stressful and worrying time would be very much appreciated

Refile..with a new, complete package..asap......no other option.....

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

Is there a reason you didn't send the i-864?

 

It might be harder to get a new AOS approved now after the changes in February. Depends on your situation.

 

All you can do is refile, and don't forget the new public charge form that is needed.

Honestly, I think your application should have been rejected rather than denied (you forgot a required form), which would have the advantage of them not taking your money.

 

But in any case refiling is your only option.

We just simply forgot that part.

Would I need to get a new medical and police certificate?

You have a valid point.  However, an I-864 is an essential item.  So, USCIS has a lot of discretion with these cases which appear to be "placeholders".

Maybe you missed the RFE? Anyway I agree file again.

Probably denied because as you remember they stopped issuing RFEs for basic information like the 864

Sometime in 2018, there was a memo from USCIS issuing a policy change that they won't be doing RFEs for missing evidence and that they would be doing straight up denials. It means basically, file afresh.

Same thing happened to me. Mine was denied July 2019 for failure to submit i864. I did not appeal. I just refilled the whole application In August  and now I have my interview scheduled for next month (but that would most likely get rescheduled)
