Hi guys, i need help. I hardly can't keep a job. We haven't file the AOS yet due to my job issues and financial.

Can she file for self petition to get a green card?

No. This is your responsibility.

 

Make more effort to keep a job because you're her sponsor. Or at least find a joint sponsor.

This is the importance of research and planning.  Immigration is expensive.  She needs a financial sponsor.  

 

Why can’t you keep a job?  Or a get a second job?  Why didn’t you save during the K1 adjudication process?

 

The quicker you file (get a joint sponsor - family or friend), the quicker she can start working and contribute to your household.

We are seeing this more often lately - people not filing AOS in a timely manner because they can’t afford it. 

 

OP, you do realise that once the 90 days on her passport stamp/I-94 are up your wife can be deported if AOS hasn’t been filed? Why would you put your wife in that situation? Borrow the money. Deliver pizzas. Drive for Uber. Sell your electronics. Do what you have to do to keep your wife here. I’ve never driven past a McDonald’s that didn’t have a “help wanted” sign outside. Use a joint sponsor. 

 

There have been some horror stories about this on here lately. One K-1 wife was a passenger in a car involved in a collision. Once the cops realized AOS hadn’t been filed and she was out of status she was taken to jail. For 5 weeks. Also anyone planning on a trip that involves driving anywhere near the southern border should be aware of random CBP checks in that region.

I would do everything humanly possible to obtain the funds needed to file adjustment of Status. As stated, once the I-94 has expired, she is subject to detention and removal.  There is also the matter of her not being to work, drive, etc.........I would borrow the money from family.

Good luck.  You finding a job in this robust economy should be very achievable.

Did you sponsor her for K-1? Did you use a cosponsor? 

If you used a cosponsor, you can just them as a joint sponsor, but I heavily recommend getting things together and figuring it out. AOS is 1225$, you have to make enough to sponsor her (21,137$ for a household of 2 (you and your wife), 26,662$ for a household of 3 (you, your wife and a dependant) etc More Info Found here , and in 2 years she will have to remove conditions on her Green Card and that will be another 680$.

I had a joint sponsor for my husbands AOS, but I was working at a grocery store and took whatever hours they could give me to make sure we were financially fit. I jumped jobs once a better job was offered to me, but I was willing to stay at a job I -hated- because having money is kind of important.

Also note that it looks like you were inquiring about AOS in Feburary. If you haven't filed for your wife's AOS within the 90 days of her coming into the US, she is subject to deportation. The only way to protect her is to file AOS.

More planning should have been done in advance. I personally am tired of seeing people going through this process only to realize later that at every stage it costs, one - money, two, they have to be able to sponsor and prove financially they can support someone. If someone can't even afford the AOS fees and prove sponsorship, how are they honestly bothering to keep up a foreign relationship and international travel? Plan a head!!

Sounds like you need to set some priorities, create a plan of action, and take action.

So, even if she were able to self sponsor, how would she sponsor herself without a job? 

 

Definitely need to figure out your priorities. Try harder to keep a job like most other people are. Get a joint sponsor. The sooner you apply, the sooner she can start working as well. What a mess.

And again I would stress that she is most likely out of status and at risk of deportation based off prior posts. When did she come into the US on her k-1?
