you can not have 2 active petitions at the same time. try that, and youll find both denied.

Actually you can have multiple petitions running at the same time. It’s not uncommon for people to file F4 sibling petitions but then the parents become LPRs and file for the other children that way also. USCIS will accept as many petitions as you are prepared to pay for. An approved petition does not guarantee a visa.

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

 

Now a US citizen!

I don't think so.......an I-130 from an immediate family member is totally separate from a K-1.....

August 7, 2022: Wife filed N-400 Online under 5 year rule.

November 10, 2022: Received "Interview is scheduled" letter.

December 12, 2022:  Received email from Dallas office informing me (spouse) to be there for combo interview.

December 14, 2022: Combo Interview for I-751 and N-400 Conducted.

January 26, 2023: Wife's Oath Ceremony completed at the Plano Event Center, Plano, Texas!!!😁

February 6, 2023: Wife's Passport Application submitted in Dallas, Texas.

March 21, 2023:   Wife's Passport Delivered!!!!

May 15, 2023 (about):  Naturalization Certificate returned from Passport agency!!

 

In summary, it took 13 months for approval of the CR-1.  It took 44 months for approval of the I-751.  It took 4 months for approval of the N-400.   It took 172 days from N-400 application to Oath Ceremony.   It took 6 weeks for Passport, then 7 additional weeks for return of wife's Naturalization Certificate..

it may be allowed but it sure looks like grabbing for needles in a haystack to me.

DONE FOR TWO YEARS!!! ;)

 

Filed everything ourselves with no RFE's or delays.

 

CR1 for Child under 21 (20 at time of filing)- Filed by LPR Spouse for his son

4/4/20     Mailed packet

4/12/20   NOA1 rec'd

10/14/21 (havent heard anything... when do i start to get worried?)

9/15/22 APPROVED! Now to wait for NVC and interview....

 

ROC

10/14/21 Mailed to AZ PO Box. Let the waiting begin. Again.

10/16/21 Received at PO Box

10/19/21 Received Text NOA1

10/23/21 Received Mailed NOA1

To me, I-130 is a better choice here.

 

However, as I mentioned earlier. It does not matter. My wife was in very much same situation, she got petitions from her grandparent, then her father (as she was aged out on grandparent). 

 

Before her interview, I was little worried toward the nature of our arranged marriage but interviewer did not ask/concern.

Wrong. If you don't know the answer to a question, it's best not to answer so there won't be any confusion.

There's nothing wrong with having multiple petitions from different petitioners. This is both allowed and shouldn't raise any flags.

 

Personally, I see no good reason not to just ride out the existing I-130 now.

  • You get an immigrant visa instead of a non-immigrant one (no AOS in the US required!).
    • Can work right away.
    • Can travel right away
    • Cheaper
  • It'll likely be faster at this point.
  • Very little case scrutiny (a biological relationship is much easier to demonstrate than a valid marriage/relationship)
  • You'll get a 10 year green card (no ROC required) vs the 2 year green card you'll eventually get from a K-1.
  • You can still obtain citizenship based on the 3 year rule once you marry and are an LPR. So it's faster to citizenship as well, if you want.
