And it’s because of people like this man, that we are going through this process, having to prove our love to complete strangers that have no idea how we suffer day in and day out without our loved ones next to us. 😡😡

 

If the guy was alread married, how did uscis not discover this? 😳

I don't know how one would determine in the USA if a USC, born in the USA, and never left the USA was married. There are at least 50 different state jurisdictions and a thousand or so counties.

 

So it is easy to imagine USCIS and DOS missing this when dealing with an alien in an alien country. The world is a big place, and there is no global registry of marriages and divorces.

 

This is why the beneficiary of the K-1 has to attest that he is not married. So that if this turns out to be false, DHS has a pretext for undoing a petition, whether it be a an I-129F/I-130, green card, or naturalization.

 

Because the beneficiary lied, I disagree that USCIS won't do anything about it.

Anyway if you really think that some investigation will be done based on a possible scenario with no supporting information based from a disgruntled spouse, well I have news for you.

Nope (although presumably the current spouse would be the first in line to take care of her, or if there was spousal support ordered if divorced again).

Not a newbie but lost my old info years ago) I have been through this process before --all the way through naturalization-- This site has always been a great help to me.

They depend a lot on people being honest. Especially concerning divorces and marriages in foreign countries. In most places it is impractical for them to find out this information...

I guess if you’ve never been married before, they don’t know. I got an RFE because they wanted a different type of divorce decree from my husband.

They do checks for previous marriages, but things definitely slip through the cracks. As has been stated many times on this website (usually in the context of being found "too married" for a K-1 visa), there's no way to prove somebody wasn't married. OIt's trying to prove a negative. All one can do is check off some common things and then presume they are honest until shown otherwise.
