If the lawyer fails us and my spouse is denied what negative impact will that have on the lawyer??

 

I found a different lawyer and he initially said he'd include some of the correspondence (chats, skype screenshots, etc) NOW he's saying he's only going to include pictures. He even said we can show chats during the interview. (That's up to the discretion of the CO, no guarantee they'll look at it)

 

My spouse, who does not know details of this process, insists to let the lawyer do his job. Because It looks good on paper to the embassy. Or so he thinks.

Save the money for your AOS. Read the guide and use VJ for your questions. From what I have seen lawyers have furt many by not being through. You can do this your self. follow the guides at the top of tha page and read the instructions and you will do fine. If the lawyer screws up nothing happens except you are out the money for his fees and your filing fees and you will,have to start again.

No lawyer can guarantee that anyone submitting a petition to immigrate to US will be accepted.  If they promise a guarantee, then runaway from that lawyer.

i wonder if lawyers purposely mis-file or make small but correctable errors on the forms etc just so they can prolong the case and therefore get more billable hours from their clients. not saying all lawyers do this, but i will not surprised if this practice is much more widespread than people realize.

 

to answer your question - if your lawyer fails and your case gets denied, all harm to you and no harm to them. unless they fail badly and too often, a failure here and there will not necessarily harm their reputation. besides, they are lawyers, if it comes down to it, i'm sure they can argue their way around the fact that it wasn't their fault the case failed to begin with! on top of what you have already paid them up to that point, now they will be able milk more money out of you since you will have to retain them to appeal the case.

Some Lawyers charge a fixed fee but unlikely to include any appeal, further application.

Unfortunately your spouse is highly misinformed. The embassy doesn’t care at all if you use an attorney or not to file your petition. Ultimately if you are denied, the consequences fall on you...not the attorney. 

 

I did a consultation with an immigration attorney when our K1 was denied. She said that it wasn’t necessary to submit much until the interview. I knew that wasn’t the case based on what I had read and experienced with the K1. When I explained it, she said to frontload and make sure it is quality evidence. My point it often most immigration attorneys don’t understand the complexities of going through a high fraud embassy like Ghana. Not all petitions are the same. 

 

Th good news is you can submit more evidence during the NVC and i highly recommend you do so that a good case is in front of the CO before your interview. Mostly important make sure your spouse is well prepared for the interview. Cases are made or broken based on the interview...even if the petitioner has submitted solid evidence ahead of time.

Chats logs and the like are just secondary evidence and USCIS doesn’t really care about that. You need more concrete evidence of face to face meetings. Save all that for the embassy interview if asked for more proof of relationship. 

I have pictures and boarding passes from my three trips. Is that considered 'concrete evidence'?
