Hello all

 

Just need someone advice. My wife and I filed for me to come over and be with her. Now we are waiting for our petition to be approved.

 

So recently my wife had a following out with someone and the person got quite nasty with her. She said would make sure we are not together and implied she would sabotage our immigration process.

 

So my wife and I are not sure how to deal with this. We are a real couple and spent a whole bunch of time seeing each other person. We already have almost a year of face to face time since we have met and we have other proof. But this process is exhausting and we just want to be with each other. However we are worried this person might attempt to throw a wrench in our plans just out of spite.

 

So my question is if she tries to lie to USCIS, do they just investigate any claim that comes in, or do they only investigate things when there are substantial evidence? Next is there anything we can do to pre-empt her actions?

Unfortunately you cannot control what another person does. They could report you the same way people make claims to any government office. I used to see all sorts of accusations when I worked for one.

 

A government agency is not going to put resources into an investigation unless there is some merit to it. I am sure there are thousands of allegations made to immigration so unless there is specific evidence to act on, I doubt it would go anywhere. I know when I worked for the government an investigation took several months and in some cases years to look into. They usually focused on cases where the evidence was strong enough to prove wrong doing.

 

If you were to contact USCIS it might raise their suspicions even more. Like you are trying to hide something. 

 

Unless this person has very specific evidence against you (like one of you has a boyfriend/girlfriend on the side) I wouldn't worry about it.

Without this they can’t even report their ‘findings’

 

If this person is stalking your wife, has been told not to contact but is through one method or another or if your wife feels threatened then go to a local police station or use a non emergency number to report it. I’ve had friends who were stalked, didn’t want to cause a fuss reporting it, and it has gotten very ugly.

Without evidence they won’t do anything, people on here have confessions from spouses that they have used them to get a green card but haven’t been able to get it investigated.

You are not the first or the last person to worry about this scenario. To sabotage an immigration application would be difficult. They would have to have very specific information about fraud. Even if someone cheated at some point (I am speaking hypothetically) that isn't grounds to terminate an application. I think a lot of people assume they have the power to ruin another persons life. But the reality is most government agencies are overwhelmed with spiteful ex's/family/friends they tend to act on cases they can prove not rumors.

Any claims of fraud need to be supported with evidence. Do they have any evidence? Or do they simple have USCIS' phone number and a temper?

@jakejay001  I wouldn't lose sleep over this threat at all.  To me it sounds like your wife's friend just wanted to take a cheap shot out of anger during a row they had.  But for the sake of argument, even if she meant it, How would she go about her plan to "sabotage" your immigration petition?  Supposing she made an angry phone call or wrote a letter, what could she possibly say that would stop the person reading the letter from just shredding it?  That's what evidence and background investigations are for.  If K-1 or I-130 petitions were granted based on the opinion of everyone in the neighborhood, the denial rate would be 99%.  There is always a disgruntled acquaintance or Hyacinth around.

The friend just wants to make you guys lose sleep. You're a rock solid couple, you should have have zero worries....probably negative 5 worries, even.

**Adjusting from initial Q1/changed to B1 then overstay, termination of removal proceedings**

(STAND ALONE i-130/TERMINATION OF REMOVAL)

First met: Totally random by asking for directions, June 2014 while on vacation at Disney World (L)

Engaged: Aug. 21, 2014

Married: Dec. 1, 2014

ICE phone contact: sometime in early Dec. 2014- Co-operated, retained attorney who advised the same.

Filed stand alone i-130: January 2015 (VSC)

ICE home visit, schedule time to go to DHS office and NTA issued, date TBD, was not detained and released on own recognizance within an hour: January, 2015.

Unless that person who made the threat is able to prove that your marriage is illegitimate or that you have concealed some other information that can possibly lead to a denial of a marriage-based green card, I wouldn't worry about it. I understand your anxiety. I dealt with an ex-spouse who constantly made all sorts of empty threats. At this point I am still waiting for my NOA2 for a CR1 and there have been days that thoughts have crept in that the ex may try to sabotage the application (his viciousness knows no boundaries. I can write a book) but I am confident that everything will be fine because I have been honest, and I am in a real relationship.

It's hard enough to get them to talk to you about your own case.  To call up as an uninvolved party will not go far at all. They definitely don't want to hear some crackpot's stories.
