Hi everyone, a few days ago we got an RFE regarding the i 864. On it it stated I (the petitioner) am supposed to file the i 864 as well even if we have a joint sponsor (which we do). Then it said the joint sponsor'd income wasn't meeting the requirements for the 125% poverty guidelines, which he makes way above the required minimum .  And finally it said that the household number was calculated incorrect "The joint sponsor must correct the and/or complete page 4 of the form I-864." 

My questions are:

1. I wont be able to qualify for sponsor, do I still have to try to meet the required minimum (using assets) even if we will get a joint sponsor or it doesn't matter?

2. Could the miscalculated household size trigger the system to say that the joint sponsor doesn't meet the requirements  125% Poverty Guidelines?

3. When calculating the household size does the principal immigrant count in as well? (For example: joint sponsor has a wife and three children and will be sponsoring my spouse)

Hey even if you don’t qualify as a sponsor long as your the petition you must file a i-867 as well and yeah the house hold size does have a lot to do with the poverty guide line so you have to check what the guide line is for that house hold size An yeah if they depend on that person they will be counted for

the petitioner is the primary sponsor and always must file the i864 even if you have a joint sponsor

so you should have filed the i864 even if you have a joint sponsor, you don't need assets since you are using a joint sponsor

 

the joint sponsor is counted on his own i864, there is a 1 for self, and yes, a mismatch in the household size can be the reason for the RFE

Thank you for your reply...So my husband would also be calculated into the household size of the sponsor?

Refill the entire form and re-send it.

Side note: I turned my maiden name into second middle name. In the combo card, my given name is First Firstmiddleinitial, however on the back of the card, they attempted to list my second middle name.

On the i 864 of the joint sponsor, does he include the person that is going to be sponsored into the household size total? For example, the joint sponsor is married and has 3 children, and will be sponsoring my spouse. does that make the household size total 5? or 6?

yes and the total is 6

 

himself, his wife, 3 children, and the beneficiary, your husband

 

he is sponsoring your husband, so of course, the beneficiary has to be counted

 

the joint sponsor has to make enough to cover his entire family plus 1
