Marriage Abroad Affect k1?

I remember a news story about a woman who was deported after doing this but I can't find it. I recall the wife was Japanese and they had 2 kids in the US before the US found out. But there is no statute of limitations on fraud, and entering the US on a fiance visa while married is fraud. Anyone have it handy?

This is the US government you are dealing with. They can look at your face book ( even it is marked private) and your emails and text messages. Share a picture of you two celebrating your wedding and it could be brought out at your interview. Because you are communicating with a foreign national seeking the quick and easy path to the US poking into private messages is allowed and has increased over the years,

It very much can lead to deportation and getting annoyed for someone telling you this shows you have no intellect or ability to process what you plan to do is just wrong. Being marked to a USC does not make any difference they will deport her if she's committed immigration fraud. Also, depending where she is coming from they will align her name up with marital records and if she gets caught it will be bad for both her and you.

Yes, you're right. Everyone is just fear mongering. You should totally break the law. Nothing bad will happen.

Sorry to rain on your parade, but you're not the first person to come up with this idea. I think it's naive to think the government wouldn't be able to find out. And they don't even need solid proof - as many threads will attest to on this site - to deny the K-1 altogether on just the suspicion of a pre-existing marriage.

The law is clear, entering the US using a visa she was no longer eligible for is straight up immigration fraud. Even if you were able to sneak it past them and get the K-1, it's not like you're suddenly home free. Any future benefits or status (like her green card or possible one-day citizenship) can be revoked if it ever came to light someday that her original entry was illegal. At the very least you'd be in for a huge legal battle, appeals, etc. to avoid deportation.

Those are pretty big stakes to roll the dice on. Not something I'd want hanging over my marriage. But hey, do what you want to do.

You can go ahead and get married to your "wife" or fiance or whatever she is (since you say wife sometimes I think you are already married already.) You can do that whenever you want.

The fraud issue (and the US government defines it as fraud, not us) is when you try to get immigration benefits meant for a fiance when you have a wife. The fiance is visa is faster so the US Gov is very wise to married people who try to obtain it.

If you are married, you cannot get a fiance visa. You can get a spousal visa.

There's a visa for married people. You should withdraw your I-129F and file an I-130 after your small ceremony.

They can, but they don't. At least they didn't before the San Bernardino shootings last year. USCIS said they actually don't look at social media when processing K-1 visa applications. That's a security problem now... Maybe they've changed policies since then due to that security problem.

Just wondering- why did you ask this question? Are you not familiar with VJ? Anyone who has checked this forum out just a couple times would know the replies you'd get to your inquiry...

Maybe USCIS doesn't do it for petitions, but embassies certainly DO check social media and have for a long time. Many stories here on VJ about people seeing private facebook stuff of theirs in the IOs lap.
