aleful got a reaction from Stephanillia in RFE Issue, marriage didnt work out
hi
you don't need to send anything, cancel the petition

aleful got a reaction from aaron2020 in I-864a cosponsors
hi
you fill out the i864 as the primary sponsor, where it says I am the sponsor
your friend files an i864 as the only joint sponsor, and his wife files the i864A as his household member
-
aleful got a reaction from aaron2020 in I-864a cosponsors
hi
yes, to submit the i864A, the person who lives with you has to be an immediate relative, such as parents, siblings or adult children to be a qualifying household member
but you can find joint sponsors who are USC or LPR who don't live in the same house and that qualify,. they would submit the i864, not the i864A, or instead, they can file the i864 and not combine income with you, instead of the i864A
they would have to have enough income to cover themselves, their family if they have one and your wife as the beneficiary

aleful got a reaction from geowrian in Sponsor
hi
exactly, she is the petitioner, she can't withdraw sponsorship, she can get a joint sponsor or co sponsor, but as the petitioner, she always will be the primary sponsor. you can't send the i864A, without an i864
or as stated, she cancels the petition, and you file the i130 and start all over. if he is under 21, the wait will be over 2 years
what I don't understand is why would she want to cancel the petition? she knows the process, she filed for you and signed the i864 as your primary sponsor. the same goes with your son's petition

aleful got a reaction from Boiler in I-130 (Brother or Sister )
https://travel.state.gov/content/travel/en/legal/visa-law0/visa-bulletin/2019/visa-bulletin-for-december-2018.html
check the second table of the visa bulletin
For category 4, they are in Feb of 06, you are November, so you still need to wait a bit longer

hi
it's the same thing, the notice comes in a letter form, it's more commonly called NOA or Notice of Action
All NOAs come in a letter form

aleful got a reaction from geowrian in Filling a I-130 petition for my stepdaughter?
hi
you can't. to be able to file for her as your stepdaughter, the marriage had to take place before she turned 18. since you got married when she was 19, you can't file for her. her mom will be able to file for her when she is a green card holder, but the interview will be in her country of origin
if he turns 21, then the petition will take over 7 years, and she will have to file a waiver and her mom to do a hardship letter

aleful got a reaction from geowrian in I-765, Sponsor's Household Size
hi
you don't count the beneficiary twice, so you don't put anything there
and it's the i864 and not the i765
-
aleful got a reaction from SusieQQQ in Documents for sibling petition - sibling's entire family records or just sibling?
hi
no, that's all for the nvc stage
now the important thing is to demonstrate relationship between the petitioner and the beneficiary
the wait is 14 or more years, so depending on the ages of the children, they might or might not be able to come
-
aleful got a reaction from TM92 in i94 timing question
it doesn't
that's for people who have a petition filed for them before April 30th 2001, and have been here illegally in the country
nothing to do with your case

aleful got a reaction from Visitor User in 245i and AOS in USA?
hi
just because the i130 doesn't mean anything, I don't know if they will accept the grandfathering because the petition was withdrawn.

aleful got a reaction from John & Rose in K1 visa Immigrant Deportation
hi
there is nothing you can do to deport him, he can remove conditions without you, as said many times here, divorce and move on
you can write a letter to immigration, whether they do something, it's up to them, but you can't get him deported. so divorce him and maybe in the future find a good man, he doesn't deserve any more time of your suffering.
-
aleful got a reaction from Carpe Vinum in A few questions
so why don't you file for divorce
if he needs to remove conditions, he can remove as divorced, or if he has the 10 year GC, it is irrelevant if he is divorced or not.
you couldn't help him anyway because you don't live with him, if he had to renew his 2 year GC
you could have divorced him at any time, so both of you have been dragging your feet

aleful got a reaction from geowrian in Question about Co-Sponsor
herself and her husband will always be counted, it is part of her household, it's their household plus the beneficiaries
-
aleful got a reaction from Unlockable in I-751 not free?
hi

aleful got a reaction from Hamada91 in joint sponsor income, urgent answer please
hi
your wife and son don't count they aren't being sponsored, you are
they are already USC
regardless of income or not, your wife will have to submit an affidavit of support and there she will list your family
the joint sponsor will only be sponsoring you
he or she has to make enough to cover him or herself, if she or he has their own family, not yours, and you the beneficiary
so it will depend on how much family the joint sponsor has, check out the form above mentioned
