    Halli, Hallo,
    bin wieder zurück aus den USA und noch total im Jetlag! Allen noch ein schönes neues Jahr! Unser Jahr 2020!!!! 😉
    Haben die Feiertage zusammen drüben verbracht. Wollten garnicht mehr heim . War so schwierig wieder zu gehen. Aber am 09.01. ist ja dann endlich das heißersehnte Interview! Hoffentlich erfahre ich dann gleich ob das Visum bewilligt wird. Ist schon komisch so kurz davor zu sein jetzt. Hab mir ein Hotelzimmer genommen und gleich einer der ersten Termine um 07:45 Uhr gemacht. Kann die Nacht vorher wahrscheinlich eh nicht schlafen. Hoffe das alles gleich klappt und ich Ende Januar das Umzugsunternehmen kontaktieren kann, die Tickets buchen kann und endlich mal was anfangen kann zu planen. Sofern alles klappt mit dem Visum und wir wie geplant dann Anfang April in die neue Heimat können! Drückt mir die Daumen Mädels! Hab euch ja schon mal von meiner complicated Kennenlernstory mit Kind erklärt. Nach 12 Jahren bekommen wir endlich die Chance auf einen Neustart und als Familie. Es hat damals einfach nicht sein sollen. Meine Kinder sind auch schon total hibbelig und aufgeregt und mein Sohn freut sich auf seine 2 Papa`s. Finde es so schön wie gut die beiden miteinander klar kommen. Hatten ein kleines goodbye get together am vorletzten Tag in unserem neuen Haus drüben mit meinem Verlobten, meinem Ex-Mann, meinen Ex-Schwiegereltern , die Kids meines Verlobtens, meine/unsere Kids, die Kids meines Ex-Mannes...wir sind so ne richtige Patchwork Familie geworden und ich bin so glücklich dass alle miteinander auskommen und sich lieb haben. Jetzt müssen wir nur noch geduldig sein und warten bis wir zu allen zurück können.

    Where you live has nothing to do where a I-130 petition is processed.  All petitions where a LPR is a petitioner go thru California to start.

    Not wanting to sound harsh, but if the sisters wedding and your families Florida trip have priority, then you two made decisions but had options. I understand that long distance is hard (I'm in the same situation, as are most of us here), but we all sacrifice one way or the other.
    I am sacrificing all family visits and trips to other places, to spend all my time with my husband. Why? Because the long distance situation is temporary and once we're together there will be room again for visiting other people
     
    Have you thought of delaying the interview so he can come visit as a tourist?

    The I-130 is for the US and in the US gender change is legal. Heck she has a US passport with her correct gender so I wouldn't see a reason why she would have to check male

    Yes you’re right it is absolutely not the case. Being married to a US citizen doesn’t outright grant anyone permission to stay or live in the US. The only way to get permission to live in the US is by applying for a visa. You also can’t come to the US with intent to stay or adjust status, you must apply for a visa abroad. You can visit your husband throughout the process (as long as you don’t abuse your visitor privileges and as long as the CBP officer allows you to) and he can visit you but you can’t come and stay with plans to adjust status as that would be visa fraud and can actually get you banned for life if it’s found out (and they will find out). So, the safest and most sensible thing to do, is stay in Canada, go the IR1 visa route, have your interview in Montreal, and then move to the US once you’ve got your visa. Yes you will have to spend quite a bit of time apart from each other (you can’t come and “live” in the US for 6 months at a time, especially when they know you have a spouse in the US and are trying to get a visa, they just won’t allow that), but many many many of us do it and it is possible

    I was under the impression that After filing the petition I could apply to adjust status so I would be able to stay here with him while it is being processed. However I realize now from you guys that is not the case and I must go back to Canada after my 6 month time is up.  However you guys mention a visitor visa.. I’m not sure if this apply to canadians? I was never issued a visitor visa?
     
    Also basically my husband said “you’re allowed to be here as long as you want you’re married to an American and your father in law lives here and you’re not working”.  Which I knew deep down wasn’t the case.  I knew there was a 6 month rule

    I don't understand how you say you are almost ready to cry but then you cant "break it to your parents" that you would rather go to Australia instead of a vacation... Its your life and your decision... If i had the funds and time off from work i would have visited my fiancé as much as i could... Do what you need to do to be happy...

    You had better check the validity date on your K1 where it says valid until, and if you have an entry stamp/I94 that shows you entered after the visa was expired, you should leave the country now as you are accumulating unauthorized stay. Your whole immigration path is completely done now if that is the case. Even if it was their mistake you will suffer as soon as you AOS, ROC, or naturalization. They will go back and check your whole immigration past, and if the first step was you entered on an invalid/ expired Visa, your done. But, hey, ride it out and let us know how it goes.

    You could email the consulate and try to reschedule his interview.
    But imo I would definitely go to Aus to visit him and break it to your family you can't go on their trip. I'm pretty sure they will survive without you there. That way you can be with him and go to his sister's wedding with him, maybe even fly back to the US with him.
     
    I feel like he's putting his needs before yours (as a couple) and doesn't seem willing to compromise much. I dunno.

    Sorry to hear this. Three questions here:
     
    1. If he interviews on February 5 and his visa is approved, what is your plan as to when he will come to the USA?   He only has six months from the date of his medical exam to use the visa, right? Would his visa be expired by July 1 or whenever he plans to travel?  Or has he not had his medical exam yet?
     
    2. Are you just finding out now that his sister is getting married on June 29? 
     
    3. If he moves to the USA in 2020 and you guys get married in the USA, will his whole family including his sister attend?
     
    I really don't see the problem with him telling this sister "Oh, sorry, I'll be in the USA in June and probably won't be able to leave so I don't think I can make it to your wedding."  Especially if he has made all of his life plans before she announced her wedding plans for a date that may be impossible for him to attend.
     
    For him to put his entire life on hold for six months waiting around in Australia just to attend a ceremony for a day or two in late June seems nuts to me, but perhaps I'm not the sentimental type. 
     
    Also, it seems the average processing time for EAD/AP applications now is 4-5 months. It's POSSIBLE, though probably unlikely, that if he comes to the USA and immediately marries you and applies for AoS and AP before, say, February 15 that he might get the AP approved before June 25 so he can travel for the wedding.

    At the end of the form, after reviewing and clicking "submit", you'll be re-directed to online payment. I paid via credit card, got charged within minutes and received our case number momentarily.

    Also online of course. It's a guided process which tells you where to upload which document, when to pay etc. Plus you can create a draft which gets stored for up until a month (and extends whenever you safe an edit) so I recommend that you just get started and see for yourself, and come back with specific questions if you get stuck. There are also plenty topics about this already if you search for I-130 online filing.

    Ugh I'm sorry. So strange some messages get almost instant replies, and others seem to just disappear somewhere in their ticketing system.
    By the way - I'm ready to file my N400, so hopefully soon I'll officially belong in this group hahaha.
    I'm currently with my husband so I'm filing (online) two weeks before my return to not miss the biometrics appointment

    Yes I think if there was no representation of the petitioner there shouldn't be a conflict. And I found it very convenient. I only had to collect proof of abuse etc, since she already had all proof of bonafide marriage

    Hellooo, hoffe ihr habt alle schoene Feiertage egal wo ihr gerade seid
     
    Ich habe endlich meine Urkunde zur Beibehaltung der deutschen Staatsbuergerschaft in den Haenden. War eine kleine Stressnummer da der Versand der Unterlagen aus Deutschland um die Weihnachtszeit herum natuerlich super langsam war. Als das Konsulat in New York mir dann die email schrieb dass ich einen Termin machen kann, war tatsaechlich nur noch ein einziger Termin vor den Feiertagen frei. Und da ich am 27. nach Bagdad zum Hubby geflogen bin und erst Ende Januar zurueck fliege, wollte ich es natuerlich vorher "ueber die Buehne" bringen damit ich mein N400 von hier aus online filen kann um dann hoffentlich bei meiner Rueckkehr das biometrics appointment zu haben. Phew.
    Ich hoffe dass die Citizenship Geschichte aufgrund der anstehenden Wahlen beschleunigt wird, damit dann unser I-130 etwas schneller geht
