Ate reacted to CaseyBorne88 in Fiance' landing in SFO. Question about timing....
No. It took her 4+ hours to get through the line. The Airbus system is out of service as well so she had to walk. They put her on a flight 10 hours from now. 10 hours long. Frustrating...😑

Ate reacted to nastra30 in Can you become an American Citizen through Pastport???
To OP, it means you are already a US citizen through naturalization of your parents (automatically acquired citizenship)

There's nothing like citizenship through passport; I think you are confusing the two terms.

Again, if you meet the conditions @little immigrant stated when your parents naturalized then you  automatically gained US citizenship. Your parents may have been told this during their naturalization ceremony.

Based on what you've said so far it looks like you are a US citizen so you can apply for a US passport using your parents naturalization details.

Careful with travel insurance - it doesn’t cover every eventuality. I looked into this before but it often only covers unforeseen/unavoidable issues, not getting a visa on time doesn’t fall under that.

Never ever buy a ticket before visa IN HAND unless you can afford to lose the money. Some days it's a few days sometimes it's a few weeks before you pick up visa. Besides what if you get AP for some reason? Nothing is 100% certain until you have it

Ate reacted to USS_Voyager in K1: Employment Authorization
No, it is not up to you or the employer. It's a matter of law. You have to have work authorization in the US in order to work. While your green card is in process, you're only allowed to stay in the US, not work. The work authorization requires another form which is the I-765 for EAD, which takes 6-10 months as mentioned. That's why I mentioned the CR1 route, which give you the green card and work authorization right away after you come.

Please do not work unauthorized, even if the company doesn't ask you for your proof of employment authorization after you enter the US. Doing so will land both you and the employer in troubles. When you work, there is always records and taxes withheld and if USCIS discovers you work unauthorized, they can deny your AOS. If the employer is found employing a person without work authorization, they can be fined some hefty amount and sanctioned. It is not worth it.

No difference except in cost, stress, headaches, and the groom's feeling like a useless appendage being swept along in the maelstrom of female wedding-planning.

Most women want an actual wedding, or a wedding party after the marriage.  The latter happened to me vis-a-vis Mrs. T-B.

Intentionally sending unnecessary RFEs/RFIEs would just create more work. I'm more inclined to believe they are overwhelmed and too often careless & incompetent.

Ate got a reaction from Carpe Vinum in Fiance' landing in SFO. Question about timing....
I went through SFO recently, but my experience may not be very relevant as I was on a tourist visa, not K1.  Took me just a little over an hour from disembarking to getting my checked-in luggage.  Then I spent a few days sightseeing in the Bay Area before taking a direct flight from SFO domestic terminal 2 to MSY in Kenner.

Anyway, it was easy to find my way through the airport as there were ushers directing passengers to where they needed to go.  There were also information desks at easy-to-spot areas on every floor.

One thing I found both surprising and comforting at SFO was that there were so many Filipino airport staff! ☺️  I didn't need to approach any of them, but just hearing them talking to each other relieved some of my anxiety at being somewhere I had never been to before.

I hope your fiancee will have a hassle-free time at SFO like I did ☺️

Hey!  just wanted to provide an update - both my parents got the visa without any issues.  They saw both of them have had a decent travel history and did mention that during the interview.  They had also travelled to other countries so that definitely was a plus.  Nothing too serious, they didn't ask to see any documents just asked questions verbally and that was it.  Hope that helps.

    It’s not complicated.
Your parents applications stand on their own merit.
They will tell the truth to all questions asked regarding the purpose of their visit .. to attend their daughters graduation
The challenge for them is providing a solid case that they have ties to their home country, sufficient for the interviewing officer to decide they are do not have immigrant intent

Anyone going through the Casablanca consulate should have front-loaded their petition with a strong relationship evidence. Since a huge amount of evidence is not technically required by USCIS, some don't include much more than proof that they met along with a few photos. This is also where lawyers who don't have experience with Casablanca can hurt a case, as they often think that additional evidence can be presented at the interview (not always the case).

If you didn't front load your initial I-129F petition (and even if you did), it's always worth it to bring any and all additional evidence with you to the interview. It's not guaranteed that the CO will look at or consider it, but there is no loss in trying.

Good examples of relationship evidence are photos with the friends and family of the couple (the beneficiary should be able to tell the CO who everyone in the photo is), receipts from your travels and time together, call logs, chat logs that have some degree of an actual conversation that show effective communication (more than just "Hi how are you today? I'm fine"). Proof of small gifts made or purchased for each other. For example, my husband (then fiance) brought with him to his interview a book he made out of notes that he had written to me. The CO really loved this.

Affidavits are better than nothing, but very, very weak overall. Literally no rational person would submit a negative affidavit.
Notarization verifies that the person who signed them is who they say they are. It does nothing for the content of the letter.

Ate reacted to SusieQQQ in Validity of IR-Visa 6 months from issue date or from medical?
From the dates and description of the issues, your husband has posted on another forum.
he noted that on his 221g slip it said “On the bottom of the form it is written “ The validity of visa is limited to the validity of the medical exam which will not exceed six months””
He was advised that he has one of two options (1) contact the embassy and request if he can do another medical to extend the visa expiry (2) make a quick trip to the US so he can enter (and gain LPR status) before the visa expires, return to finish his employment obligation, and then after that make his permanent move to the US.

No...travel tax is what is paid separately from your ticket (PHP 1,620). This is the exit tax payable by Philippine citizens...except for OFW. Terminal fee is payable by all but it is automatically collected when you buy the ticket flying from Manila. In Cebu when you fly internationally this is collected separately...I know, I had to pay it))))

Do not let the process deter you, stick to the process, ask when you need help. The people here are great and will bend over backwards to help you reach your goals. If you have the nature to just give up you will fail. Dealing with the government doesn't always make sense, but it is usually consistent

Ate reacted to George & Roth in Misadventures of getting a drivers license (K-1, New Jersey)
I am writing this to help anybody else out that entered to get a license that entered the USA on a K-1 Visa. It matters very much which office you go to. I am leaving out all the details however I had SEVEN visits to the MVC/DMV and about EIGHT phone calls to the main MVC office.

First is more of a rant but see the bottom of this post for relevant info if you want to get your DL.

    1)      DO NOT GO TO RAHWAY NJ office
We went in here, they do not know how to handle K-1 immigrants.
    ·        Incorrectly told her she can drive immediately using her foreign license. Dangerous!
    ·        Would not issue permit for taking test. WRONG
    ·        After obtaining permit from other MVC office and passing test they said she is not eligible for license until green card arrives. I explained the absurdity of this and escalated it all the way to the top of the chain (management and coordinator) to no avail.

    2)      GO TO Bakers Basin (Lawrenceville NJ)
    ·        Provide permit to allow for knowledge test with I-94 and SS# as parts of support
    ·        Provided license after the passed test
    ·        Screwed up translator appointment but was helpful otherwise

    3)      Do not trust phone center in Trenton NJ
    ·        50% of the time they were helpful
    ·        I was called and yelled at that my wife did not study because they had mixed up her record with someone else who was using a translator repeatedly (5 times) at the cost of the MVC. After I went ballistic they figured out they mixed up her record and apologized profusely.
    ·        I told them Rahway office does not understand the immigration and I was told it is up Rahway, no set way to handle immigrants across different locations
    ·        I told them I am confident I can go to another location and receive the license, instead of rectifying the issue it was recommended I try the other MVC. (I did and we did get license)

How it worked for us in New Jersey at Bakers Basin MVC (May vary by STATE!):
    A)      You need to first get your SS#.
    B)      With your SS# & I-94 you can get a permit to take the knowledge test and after passing get a license issued for the period ended the date of I-94. (We did not do this, skipped to D below)
Bring everything with you (passport, visa, DL from home country, marriage certificate, I-94) Get bank statement jointly right away Add fiance to any lease right away Get fiance a credit card right away (no SS# needed) Get fiance on driving insurance (no SS# needed with progressive) C)      You can get a translator for the test if you fail it once without a translator. Challenge for some is studying the material which is in English.
She had a bad translator who was not able to translate all of the words (did a combo English/khmer) so was not helpful She passed with no translator by practice of questions and looking up words herself, and I helped as well. For reference, she has a fair level of English not an expert level D)      After you get married and submit your AOS paperwork you can use the NOA 1 (form 797) that you receive for the AOS to get a 6 month license (this is what she received)
    E)       Once you receive permission to work (EAD) or the green card you will be able to get a longer license. We will expect EAD is received by this time and use it for next driving license extension.

Ate reacted to coa24 in Is the Medical still one week before interivew?
We pushed through with the medical. She ended up having her menses this past Monday two days before her medical. She typically has 5-day cycle. It was not an issue with St. Luke's that she was in the middle of her menses. Though obviously not the heaviest days which are typically the first two days. Our interview is on Monday. No available slots for Friday this week. Gives us time to tour Manila and shop.
