    I just checked as an add-on to my previous post. Uber is available in your area, and Dulles international airport is only at most 30 miles from where you are. I have already saved the airport in my Uber account, so when your ready, pm me an address and time and I'll schedule a pick-up. I hate to see someone suffer after giving up so much to come here.

    I give up after page 3 of posts. Just get out of here as fast as possible. Take the easy solution and leave before it gets worse. I would be on a plane in less than 12 hours from now. Trying to stay and fight it out doesn't sound like your cup of tea. Human trafficking, VAWA, come-on, let's be real, people have been watching too many reality TV shows. I would avoid that nightmare and just bail out. You get home and you can work, you should still have some support there, and it might take a few months, but things will get straightened out. This is what I would do.
     
    I'll even get you a Uber to the airport. I've got a bunch of free rides from them due to points. If you need transportation to the airport, it's on me. Hopefully Uber is in your area.

    Will do. I can't decide quickly. So many factors at play. Each route is difficult. I need the SAFEST route for everything is messed up.
     
    I am NOT holding on to stay here. If anything, my experience here has been horrible. I want to forget the people and places and start over somewhere else.
     
    I just really hate to face all the old chatty women and be stigmatized for nothing. That path is SO hard for anyone knowledgeable in eastern cultures.

    Many people in this situation are sill concerned about their status in the US, that’s the entire reason the U and T visas exist, to remove the fear or retribution. Even if the situation isn’t ideal, sometimes people want to stay. Other times it’s not just about staying in the US, but making sure they have legal status and don’t have to worry about getting picked up by ICE. Human traffickers often use threats and fear mongering to keep their victims from speaking up. I had a recent case of a restaurant owner who would play news footage and share reports about the camps people are being held in and told his victims that’s that where they would end up if they ever went to the authorities.
     
    So yeah, I don’t think her asking about her immigration concerns (ON AN IMMIGRATION FORUM) make this story any less believable. I work for one of the smallest US Attorneys Offices in the country, and we get multiple cases like this every year.

    I don’t know. To extend the cynicism, is it possible for example that spouse realized OP was really just after a green card and is loathe to be on the hook indefinitely with an i864 in that case? How many stories like this do we see on VJ? And we know that some people get their lives messed up by false VAWA claims against them. 
    to me it’s obvious: if it’s abusive, she needs to get out and go home. Her friend can lend her money for an airplane ticket. There is a plan B, and it’s not going to Texas without status.

    Holy moly She's acting like she's 15... My advice along with everyone else's . 
    File for Divorce. ASAP. Money can be replaced, mental health not. Do NOT blame yourself for ANYTHING, and don't take anything she says at this point.
    I believe (not 100% on that) if you can prove to the judge that she hasn't worked a minute while you were married, you might be entitled to the house/apartment/bank account savings etc. NOT SURE. 
    Secondly, file a restraining order ASAP, as it seems like they wanted to make a Domestic Violence report, but your neighbor shuffled cards there, and they called the cop off for that exact reason. 
    thirdly, separate ALL of you assets that she has access to. ASAP. 
    lastly, you'll have the upper hand. I'd also file for harassment on her mom. If you start all the proceeding, THEY have to defend themselves. Her mom is just trying to milk YOU now, and they are doing it by all means. DO NOT be alone with her, DO NOT meet her alone anywhere, ONLY TALK THROUGH the lawyer. 

    Dude.. I'm so sorry you're going through this.. Immigration is hard already, and dealing with nuthead like that... is shattering. Be proud, stand your ground, and in no time you're gonna find someone who appreciates you like you should be appreciated. Don't give in to those sobs and crocodile tears.     Both jumped the gun? What kind of reality do you live in? OP's wife should know the value of things and that money doesn't grow on trees. Also if she likes shopping maybe she can get a job to sustain it. I wouldn't dare go to my fiancé or anyone else and just ask for money to "shop around".
     That's just delusional.

    Start the divorce. Get your taxes done do married filling separate. I'm sure it won't be as nice as jointly but the peace of mind will be well worth it. 
    Stay far far away from her. If you can move do it so she will not know where you moved.

    I am a laid back person who hates drama. 
    I had already taken her off accounts as of this past Tuesday. 
    We don't have joint properties. We are still young. Though last year, one of the cars was breaking down. I asked her to choose a car that we could afford. Mistake. She chose a Mercedes Benz and went at the rich neighborhood dealer. I called her mom to talk sense into her cz I'm always the bad one, as she claims. Lol and behold. The mom tells me to get her shat she wants...a $30000+ car yet she has the same ins student loans which I am paying for. I had encouraged her to apply for scholarships while in school and she refused.  Anyway, we applied for the car loan jointly and got denied, probably due to the loan.
    I don't have anything left for her to claim. She took everything. I am only left with one TV, the couch, bed, cutlery which dint meet her standard and my clothes.

    I am not seeing any fraud here. My spouse recently had her CR1 interview so all I can suggest you is, have evidence of bonafide relationship available with you during interview and answer CO questions, you will do fine. Take everything what helps you to show that relationship is genuine such as photos together, boarding pass, chat/call logs etc and be confident during interview.

    If your wife is overseas, you start with I-130. If your wife is here in States, you can file I-130 and I-485 together. If you are going to be citizen soon, i suggest you file 130 as USC. Yes you can file now as permanent residence (F2A) and later upgrade to CR1 but if you are scheduled to be citizen within 30-60 days, i would wait to file as a citizen. If it is going to take longer to become citizen, go a head and file now. (This is my suggestion only as i filed a PR and later upgraded to CR1) 
     
    Start filling I-130 (https://www.uscis.gov/sites/default/files/files/form/i-130.pdf) and gather documents such as marriage certificate, photos together, boarding passes, receipts etc. I would also suggest front loading your petition to avoid any RFE. Front loading is where you include as much as evidence of bonafide relationship.

    Being outstanding citizens and being a recently disabled combat veteran does not matter.  
     
    Did you meet all the requirements?  Are there any red flags with your relationship for the US Embassy?
     
    If you want help, then give us the full story.  You are angry.  I get it.  But if you want good help, you have to give us good information about your case.  
     
    Immigration to the US is a privilege.  It's not a right.   You are coming off as another entitled veteran.

    Yes most employment is at will employment that employer doesn't have to have reason to let OP go. However in this specific case, they already sent a written letter that OP is not eligible for employment authorization due to their HR' error or whatever issues they may have. 
     
    So in this specific case OP can seek an legal process to claim that employer had shown an intent to fire him based on immigration status that is even wrongfully concluded. 
     
    Without written letter the burden of proof could be tough to prove that employer discriminated but since they already gave a letter it will be much easier to prove. 
     
    And to be clear, i suggested OP to write a letter to HR that their conclusion is wrong and IF the employer continue to take adversarial action such as termination of employment he would seek legal process. 
     
    Since the part of immigration process always considers a worst cade scenario, it would be advisable that the employer still doesnt understand the immigration laws and regulations, OP has a right to seek for court intervention if adversarial action is taken. 
     
    In that sense i would suggest that OP should collect all HR documents such as yearly performance evaluation and any prizes if any so that sudden termination of employment was resulting from the employers malpractice of discrimination and therefore at-will employment clause doesnt kick in, and therefore subject to civil fines as well as compensation for OP's wage loss

    Hi @Lyes, my upgrade update is posted just above your post by saladboye. As far as current update: I-130 was approved by USCIS on Sep 17, received by NVC on Oct 30 and currently waiting for case number to be created.

    I think that everyone from vietnam are lovely, and anyone from anywhere are lovely. I don't get the big fuss about keeping Northern traditions versus southern traditions. My mom said she accepted my wife at the beginning because she was of northern decent. But then in her argument she said that my wife is actually in fact only northern blood but she does not act like a northern person. It's basically terrible emotional abuse and unjust discrimination  
     
    This is funny to me because then, what do other people think of me? Im northern but i say things how I see it, and most times not "classy"

    It would only be fraud if mom enters the US on the visitor visa with the intent to immigrate.
     
    Perfectly fine for mom to file the I-485 now and wait for AP to leave and be permitted back into the US to continue her AOS.  
     
    OP genuinely thought it was legal for her mom to leave and come back on the B2.  Seems like she now understands that is not possible.  There doesn't seem to be an intent to commit fraud.

    This is what sucks about this forum. People throw stones then try to hide their hands and play innocent. I don't think OP was referring to either of you two, he was referring to that other member with the snarky "A lawyer ain't gonna change a denial into an approval" comment. How is that "helpful"? If you yourself, weren't being sarcastic or unduly harsh, then you shouldn't take offense to the OP feeling hostility. The pack mentality on Visa Journey sometimes is sickening, honestly. You see people commenting rudely but you defend them and say it's under the guise of "being real". Please.
